Site Plan Application #SP-08-41 of Catherine Antley to amend a previously approved plan for a 5800 sq. ft. building consisting of 2500 sq. ft. of medical office use, 2900 sq. ft. of laboratory use, and 400 sq. ft. for mechanical use. The amendment consists of changing uses in the building resulting in the following: 1) 1500 sq. ft. of medical office use, 2) 1000 sq. ft. of laboratory use, 3) 1957 feet of general office use, and 4) 1318 sq. ft. of mechanical use, 30 Farrell Street (old American Lung Association building): Mr. Belair noted that the application includes a parking waiver of 4 spaces, 18.2%. No other issues were presented. Ms. Quimby moved to approve Site Plan Application #SP-08-41 of Catherine Antley subject to the stipulations in the draft motion. Mr. Farley seconded. Motion passed unanimously. 6. iscellaneous Application #MS-08-09 of Munson Earth Moving for re -approval o extend the expiration date for removal of approximately 40,000 cubic yards of fill on the property beyond the October 15, 2007 expiration date, 284 Meadowland Drive: Mr. Marshall noted that the Board had previously granted an approval through December 11, 2009. The person who was supposed to pull the permit left the company, and the permit did not get pulled within the required time. This is the exact same application. Ms. LaRose noted that the Storm Water Superintendent has been on site and the site has been stabilized now. Mr. Belair noted that the soil piles on the site will come and go until they are completely gone. Mr. Marshall said the general intent is to remove all the soil. Ms. Quimby moved to approve Miscellaneous Application #MS-08-09 of Munson Earth Moving subject to the stipulations in the draft motion. Mr. Farley seconded. On December 11, 2007 the applicant received approval to extend the date for removal of the fill to December 11, 2009, at which time the site shall be restored to the original grade and condition. However, the applicant never secured the zoning permit within the required six month period after the December, 2007 approval and therefore that approval is void. The applicant is now seeking to re-establish this extension. Associate Planner Cathyann LaRose and Administrative Officer Ray Belair have reviewed the plans submitted on August 22, 2008 and have the following comments. This application shall be reviewed under Section 3.12 of the Land Development Regulations. The removal from land or the placing on land of fill, gravel, sand, loam, topsoil, or other similar material in an amount equal to or greater than twenty (20) cubic yards, except when incidental to or in connection with the construction of a structure on the same lot, shall require the approval of the Development Review Board. The Development Review Board may grant such approval where such modification is requested in connection with the approval of a site plan, planned unit development or subdivision plat. This section does not apply to the removal of earth products in connection with a resource extraction operation. Standards and Conditions for Approval (1) The Development Review Board shall review a request under this Section for compliance with the standards contained in this sub -Section 3.12(B). An application under Section 3.12(A) above shall include the submittal of a site plan, planned unit development or subdivision plat application showing the area to be filled or removed, and the existing grade and proposed grade created by removal or addition of material. The applicant submitted a plan showing the placement of the fill on the subject property. The heights of the mounds appear to be a maximum of 24 feet. Furthermore, the highest elevation of the proposed fill will be lower than that of Hinesburg Road. (2) The Development Review Board, in granting approval may impose any conditions it deems necessary, including, but not limited to, the following: (a) Duration or phasing of the permit for any length of time. The applicant previously noted that this fill would be used as a temporary location for the placement of fill from the Kennedy Drive reconstruction project. Although that project has been completed, the applicant is requesting an extension of the date. The Development Review Board should consider imposing a limit on the length of time the fill is allowed to remain on the property. The previous approval was to be valid to December 11, 2009. The approval for the placement of fill on this property shall expire at a date determined by the Development Review Board. (b) Submission of an acceptable plan for the rehabilitation of the site at the conclusion of the operations, including grading, seeding and planting, fencing drainage, and other appropriate measures. The proposed fill poses a potential problem with stormwater runoff. The applicant has submitted a plan to ensure proper erosion control, including appropriately placed silt fences. The City Stormwater Superintendent has reviewed the plans and requested revisions. Those revisions have since been made and he has stated that the new plans are acceptable. (c) Provision of a suitable bond or other security adequate to assure compliance with the provisions of this Section. Staff does not feel this requirement will be necessary for the subject application. (d) Determination of what shall constitute pre -construction grade under Section 3.07, Height of Structures. The pre -construction height for future development will be the grade which existed prior to the fill. This is noted on the plans which have been submitted by the applicant. Other: 2. No fill shall be placed in the public right of way of Hinesburg Road or Meadowland Drive. 3. Access to the proposed fill shall only be via Meadowland Drive. No access shall occur via Mansfield View Lane. Staff recommends that the DRB approve miscellaneous application #MS-08-09 subject to the numbered conditional items in the staff section of this report. Dear Ray: As per our discussion, Munson Earth -Moving Corporation would like to extend the Miscellaneous Application for the placement of fill on their property located at 284 Meadowland Drive in South Burlington. Please find attached a completed Application for the Development Review Board, site plans, fee and abutter list for the existing placement of fill on this property. An extension for the placement of this fill was granted on December 11, 2007 and was valid until December 11, 2009. It is our understanding that a Zoning Permit was not filed within the necessary time period and that a new Development Review Board Application is required at this point for the existing placement of this fill. There are not any proposed changes from what was previously permitted as part of this application. We have attached a site plan for your review which depicts the existing grades at the site which are consistent with the previously approved site plan. The stockpile area is stabilized and was constructed in conformance with the approved plans. There is a pile within the fill area which consists of sand which has not been topsoiled, seeded and mulched to eliminate the contamination ofthe sand. Munson Earth -Moving Corp. will be moving this material out of the stockpile area once a suitable off site location has been chosen. As part of this application, Munson Earth -Moving Corp. would like to have their existing permit extended (or a new permit issued) to allow them to maintain the existing stockpile on site. All erosion and sediment control measures which were previously approved and implemented will be maintained as long as the material is on site along with the erosion control measures necessary for the removal of this material. Continued Sketch Plan Application #SD-07-69 of Pizzagalli Properties, LLC, to subdivide a 14.54 acre parcel into three lots of 1.01 acres, 5.76 acres, and 7.77 acres, Old Farm Road and Tilley Drive: Mr. Belair said staff has no problem with the 1-acre lot, and it makes sense to put a small building on it. There is a concern with access, and staff wants an access as far back from Hinesburg Rd. as possible. They are waiting for information from the traffic consultant on this. He asked the Board to continue the hearing to get the consultant's input. Staff is suggesting the access be opposite the other curb cut. Mr. Bouchard said the access was placed to be perpendicular with the access across the street. They feel it is the best location. This is a private drive which the city does not want to maintain. Mr. Dinklage felt the Board needed the results from the traffic study before going further. Ms. Wilson expressed concern that the road is adjacent to a residential district, and 550 cars a day is a lot. She asked if there is another possible site for the road and whether the development can be moved further to the east. There are also some questions about the size of the buildings. Ms. Quimby moved to continue SD-07-53 until 8 January 2008. Mr. Behr seconded. Motion passed unanimously. 10. ontinued Miscellaneous Application #MS-07-12 of Munson Earth Moving Corp. to extend the expiration date for the removal of 40,000 cubic yards of fill beyond the October 15, 2007 deadline, 284 Meadowland Drive: Mr. Marshall noted they had a one-year permit which expired. They are asking to keep the fill there until they can find a place for it. He showed the location on the plan and noted they have an erosion control plan. Mr. Dinklage asked if the city has experienced any problems with this. Mr. Belair said it has not. The concern is that the city is involved as a co -applicant with Munson on removal of this fill. Mr. Marshall suggested a 2-year period for removal of the fill. There were concerns with stability of the site when the material begins to be removed, and also with dust going onto neighboring properties. They feel the erosion control plan is adequate. Mr. Belair said 2 years is OK with the city. Ms. Quimby moved to extend the expiration date for the removal of 40,000 cubic yards of fill at 284 Meadowland Dr. until 11 December 2009. Mr. Behr seconded. Motion passed unanimously. The meeting was scheduled for November 6, 2007 and November20, 2007 but continued to December 11 t" so that the applicant could provide more information. Associate Planner Cathyann La Rose and Administrative Officer Ray Belair have reviewed the plans submitted on October 17, 2007 and November 14, 2007 and have the following comments. This application shall be reviewed under Section 3.12 of the Land Development Regulations. The removal from land or the placing on land of fill, gravel, sand, loam, topsoil, or other similar material in an amount equal to or greater than twenty (20) cubic yards, except when incidental to or in connection with the construction of a structure on the same lot, shall require the approval of the Development Review Board. The Development Review Board may grant such approval where such modification is requested in connection with the approval of a site plan, planned unit development or subdivision plat. This section does not apply to the removal of earth products in connection with a resource extraction operation. Standards and Conditions for Approval: (1) The Development Review Board shall review a request under this Section for compliance with the standards contained in this sub -Section 3.12(B). An application under Section 3.12(A) above shall include the submittal of a site plan, planned unit development or subdivision plat application showing the area to be filled or removed, and the existing grade and proposed grade created by removal or addition of material. The applicant submitted a plan showing the placement of the fill on the subject property. The heights of the mounds appear to be a maximum of 24 feet. Furthermore, the highest elevation of the proposed fill will be lower than that of Hinesburg Road. (2) The Development Review Board, in granting approval may impose any conditions it deems necessary, including, but not limited to, the following: (a) Duration or phasing of the permit for any length of time. The applicant previously noted that this fill would be used as a temporary location for the placement of fill from the Kennedy Drive reconstruction project. Although that project has been completed, the applicant is requesting an extension of the date. The Development Review Board should consider imposing a limit on the length of time the fill is allowed to remain on the property. 1. The approval for the placement of fill on this property shall expire at a date determined by the Development Review Board. The proposed fill poses a potential problem with stormwater runoff. The applicant has submitted a plan to ensure proper erosion control, including appropriately placed silt fences. The City Stormwater Superintendent has reviewed the plans and requested revisions. Those revisions have since been made and he has stated that the new plans are acceptable. (c) Provision of a suitable bond or other security adequate to assure compliance with the provisions of this Section. Staff does not feel this requirement will be necessary for the subject application. (d) Determination of what shall constitute pre -construction grade under Section 3.07, Height of Structures. The pre -construction height for future development will be the grade which existed prior to the fill. This is noted on the plans which have been submitted by the applicant. Other: 2. No fill shall be placed in the public right of way of Hinesburg Road or Meadowland Drive. 3. Access to the proposed fill shall only be via Meadowland Drive. No access shall occur via Mansfield View Lane. Staff recommends that the DRB approve miscellaneous application #MS-07-12 subject to the numbered conditional items in the staff section of this report. My understanding is that the temporary fill permit covers ALL of the fill that has been brought to the site. If this is correct, there is a substantial amount of material on the site that would have to be removed at the expiration of the temporary fill permit. The EPSC plan provided on sheet C2 indicates that only a portion of this material is to be removed. On sheet C1.1 you can see the pre-existing contour lines (light colored) overlaid by the existing contour lines (darker). These elevations were created after fill was added. If the requirement of the temporary fill permit is that all of the material on the site must be removed, than the plan is not sufficient. There are large areas, closer to the stream, that are currently only protected by silt fence. If the expectation is that only the shaded portions on sheet C2 are to be removed before the expiration of the temporary fill permit, than the EPSC measures shown on the plan are sufficient. Also, if you look at the notes on page C3 they give the authority to require additional and appropriate EPSC measures to the State and soil conservation service, but not the City (1.02B). The notes also authorize the use of hay bales which are no longer allowed under VT standards (1.02D). In addition, tributary 9 of Potash Brook is not clearly indicated on the plans. Section Includes: 1. The work under this section includes but is not limited to providing all labor, equipment and materials for the Installation of all required site related erosion control measures. If not otherwise directed on the plans, erosion control shall be in strict conformity with the latest revision of the 'Vermont Handbook for Soil Erosion and Sediment Control on Construction Sites'. B. Related sections: 1. Section 02210 - Site Earthwork 2. Section 02936 - Permanent Seeding 1,02 GENERAL. NOTES A. The discharge of sediment laden water from the project site is prohibited. All discharged water from dewatering operations shall discharge Into a temporary sedimentation basin. B. Contractor shall Install all erosion control measures as depicted on plans and details or as recommended by the Vermont Agency of Natural Resources, or Soil Conservation Service and The City of South Burlington, prior to any construction. Contractor shall also be responsible for Inspecting and maintaining all erosion control measures until project is completed. C. Contractor shall also limit the soil disturbance and seeding application dates to between May lot and October 15th. If soil disturbance occurs later than October 15th and prior to May let, winter erosion control measures will be necessary. Contractor shall consult with the Engineer for additional site specific winter eroslon control measures. D. All stockpile material (topsoil, borrow, etc.) will have a silt fence constructed around the perimeter. Seed and mulch stockpiled material as soon as possible to prevent soil erosion and sedimentation off site. Locate stockpiles on the uphill side of the disturbed areas, If possible. During windy conditions, stockpiled material shall be covered or watered appropriately to prevent wind erosion. E. Control dust through the application of calcium chloride or water. An average application of one pound of calcium chloride par square yard of exposed area should be considered for each treatment. The exact number of applications and amount of dust controller shall be based upon field and weather conditions. It shall be spread in such manner and by such devices that uniform distribution is attained over the entire area on which it is ordered placed. PART 2 - PRODUCTS 2.01 EROSION CONTROL NETTING A. Jute netting shall consist of undyed and unbleached yam woven into a uniform open plain weave mesh. 2.02 EROSION CONTROL MATTING A. Where required on the plans or where directed by the Engineer, erosion control blankets (matting) shall be North American Green C125BN for swales, and SC150BN for slope stabilization, or approved equal, for all areas for permanent Installation, and C125 and SC150 where matting Is being used as temporary protection of disturbed soils until a final surface stabilization method Is employed. 2.03 FILTER FABRIC A. When filter fabric Is required, it shall conform to the requirements of Mirafi SOOX or approved equivalent. 2.04 CALCIUM CHLORIDE A. Calcium chloride shall conform to the requirements of AASHTO M 144. Either regular flake calcium chloride. Type 1 or concentrated flake, pellet or other granular calcium chloride. Type 2, may be used. 2.05 WATER A. All water used shall be clean and free of harmful amounts of oil, salt acids alkalies sugar, a ga , organic matter and other substances Injurious to the finished product, plant life or the establishment of vegetation. 2.06 SEDIMENT WATTLES A. Sediment wattles shall be King Fibre Corporation silt trapper sediment wattles or approved equal. 2.07 POLYACRUMIDE A. Polyacrumide (polymer) logs (blocks) shall be Applied Polymer Systems, Inc. floc log or approved equal. The type of floc log used shall be based upon a site specific testing of the native soils. 2.08 STONE CHECK DAMS A. Stone check dams should be constructed of 2 to 3 Inch stone. Hand or mechanical plocement will be necessary to achieve complete coverage of the ditch or swale and to ensure that the center of the dam is lower than the edges. The maximum contributing drainage area from any one check dam shall not exceed two acres. See the detail drawing located at the back of this section for the proper Installation of stone check dame. PART 3 - EXECUTION 3.01 SILT FENCES A. The silt fences shall be constructed In accordance with the construction detail. The fence shall generally be placed 10 feet from the toe of the slope or as shown on the plans. The ends of the fence shall be placed uphill to form a horseshoe shape to trap all runoff. B. The silt fences shall be Inspected periodically for damage or build-up of sediments. All damaged fences shall be repaired or replaced. Sediment deposits shall be removed from the fence as they build up and be placed In an area where there Is no danger of further erosion. 3.02 EROSION MATTING A. Erosion matting shall be placed on all grass -lined ditches with profile grades exceeding 5.0% and all other areas called out on the plans, and shall be placed and maintained in accordance with the Vermont Agency of Transportation Standard Specifications Sections 654 and 755.07. 3.03 RESTORATION A. As soon as construction Is completed in a given area, It shall be topsoiled, seeded, fertilized and mulched as specified In Section 02936 - Permanent Seeding. 3.04 STABILIZED ROAD ENTRANCE A. A stabilized pad of crushed stone located at any point where traffic will be entering or leaving the construction site to or from a public right-of-way or street or as shown on the drawings shall be constructed for the purpose of preventing the tracking of sediment onto public rights -of -way. B. Design Criteria: 1. Use 1.5 to 2.5 Inch stone. 2. Use 8 Inch layer of stone. 3. Stone pad shall be full width of entrance. 4. Minimum length shall be 50 feet. 3.05 GRASS -LINED DITCHES A. All ditches that are not stone -lined shall be topsoiled, seeded, fertilized and mulched. Any area which shows signs of erosion shall be reseeded Immediately and maintained until pernonent vegetation is established. 3.06 MAINTENANCE A. All erosion control measures shall be inspected daily and repaired and/or replaced as needed. B. All erosion control measures shall be Inspected after periods of heavy rain. C. The stabilized road entrance shall be top dressed with additional stone should the existing stone become clogged with sediment. D. Hay or straw mulch is subject to wind action. Mulch may require anchoring as the weather conditions warrant. 3.07 STONE CHECK DAMS A. The drainage area of the ditch or swale being protected should not exceed 10 acres. B. The drainage area to any check dam shall not exceed 2 acres. C. The maximum height of the check dam should be 2 feet. The center of the check dam must be at least 6 Inches lower than the outer edges. The maximum spacing between the dams should be such that the toe of the upstream dam is at the same elevation as the top of the downstream dam. D. Check dams should be Installed before runoff Is directed to the swale or drainage ditch. 3.08 DEWATERING METHODS A. Budlangton SECTION 02936 - PERMANENT SEEDING PART 1 - GENERAL 1.01 SUMMARY A. Section Includes: 1. Furnishing all labor, materials, and equipment to complete all seeding work as shown on the drawings and specified herein. 2. Except where otherwise shown or specified, the Contractor shall seed all areas where new contours are shown on the drawings and all areas where existing ground cover has been disturbed by the Contractor's operations. B. All work and materials of this Section shall conform to the applicable requirements of the VAOT Standard Specifications, Division 600. 1.02 SUBMITTALS A. Provide the following for approval prior to delivery to the site: 1. Supplier's Certificate of Compliance attesting that lime, fertilizer and seed meet the requirements specified. 2. The Contractor shall provide representative topsoil samples for testing and approval, deliver samples to a public extension service agency testing laboratory, hove testing report sent directly to the Landscape Architect and pay all costs. Testing shall report on mechanical and chemical (pH soluble salts) analysis. Report shall be submitted at least one month before any looming Is to be done. 1.03 SEEDING SEASONS A. Seeding and Initial fertilizing shall be done between April 1 and June 1, between August 15 and October 15, or as permitted. Seeding shall not be done during windy weather or when the ground is frozen, excessively wet, or otherwise untillable. If seeding Is done during July or August, additional mulch material may be required by the Engineer. PART 2 - PRODUCTS 2.01 LIME A. Lime shall be standard, ground dolomite limestone, agricultural grade, containing a minimum of 95% of calcium and magnesium carbonates. 100% shall pass the 10 mesh sieve: minimum 90% shall pass the 20 mesh sieve; minimum 40% shall pass the 100 mesh slew. 2.02 FERTILIZER A. Fertilizer shall be commercial grade granular fertilizer as required for soil conditions as specified in Section 643 of the VAOT Standard Specifications. The fertilizer shall be delivered to the project In new, clean, sealed containers which bear a label fully describing the contents, the chemical analysis of each nutrient, the fertilizer grade, the net bulk, the brand and the name and address of the manufacturer. The fertilizer and labels shall conform to all existing State and Federal regulations, and shall meet the standards of the Association of Official Agricultural Chemists. 2.03 GRASS SEED A. Provide fresh, clean, new -crop seed of the grass species, proportions and minimum percentages of purity, germination and maximum percentage of weed seed as follows: 1. Park seed shall normally be used on loom areas. Mulch must be Installed on all seeded areas. The following mulches are acceptable for use. 1. Hoy mulch free of weeds and coarse matter at a rate of 90 pounds per 1,000 square feet. 2. Wood fiber applied in a slurry (1/6" or longer) at a rate of 40 pounds per 1,000 square feet. 2.05 WATER A. All water used shall be obtained from fresh water sources and shall be free from injurious chemical and other toxic substances harmful to plant life. No water which is brackish will be permitted at any time. The Contractor shall Identify to the Engineer all sources of water at least two weeks prior to use. The Engineer, at his discretion, may take samples of the water at the source or from the lank at any time and have a laboratory test the samples for chemical and saline content. The Contractor shall not use any water from any source which is disapproved by the Engineer following such tests. PART 3 - EXECUTION 3.01 PREPARATION A. Examine finish surfaces and grades. My understanding is that the temporary fill permit covers ALL of the fill that has been brought to the site. If this is correct, there is a substantial amount of material on the site that would have to be removed at the expiration of the temporary fill permit. The EPSC plan provided on sheet C2 indicates that only a portion of this material is to be removed. On sheet C1.1 you can see the pre-existing contour lines (light colored) overlaid by the existing contour lines (darker). These elevations were created after fill was added. If the requirement of the temporary fill permit is that all of the material on the site must be removed, than the plan is not sufficient. There are large areas, closer to the stream, that are currently only protected by silt fence. If the expectation is that only the shaded portions on sheet C2 are to be removed before the expiration of the temporary fill permit, than the EPSC measures shown on the plan are sufficient. Also, if you look at the notes on page C3 they give the authority to require additional and appropriate EPSC measures to the State and soil conservation service, but not the City (1.02B). The notes also authorize the use of hay bales which are no longer allowed under VT standards (1.02D). In addition, tributary 9 of Potash Brook is not clearly indicated on the plans. (2) The Development Review Board, in granting approval may impose any conditions it deems necessary, including, but not limited to, the following: (a) Duration or phasing of the permit for any length of time. The applicant previously noted that this fill would be used as a temporary location for the placement of fill from the Kennedy Drive reconstruction project. Although that project has reached completion, the applicant is requesting an extension of the date. The Development Review Board should consider imposing a limit on the length of time the fill is allowed to remain in piles on the property. 1. The approval for the placement of fill on this property shall expire at a date determined by the Development Review Board. CITY OF SOUTH BURLINGTON 3 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \drb\misc\munson\misc-fill extension doc (b) Submission of an acceptable plan for the rehabilitation of the site at the conclusion of the operations, including grading, seeding and planting, fencing drainage, and other appropriate measures. The proposed fill poses a potential problem with stormwater runoff. The applicant has submitted a plan to ensure proper erosion control, including appropriately placed silt fences. The City Stormwater Superindent has reviewed the plans and provided the following comments: I reviewed the EPSC plan that Munson sent as part of their request for an extension to the temporary fill permit for the site on Meadowlands Drive. My understanding is that the temporary fill permit covers ALL of the fill that has been brought to the site. If this is correct, there is a substantial amount of material on the site that would have to be removed at the expiration of the temporary fill permit. The EPSC plan provided on sheet C2 indicates that only a portion of this material is to be removed. On sheet C1.1 you can see the pre-existing contour lines (light colored) overlaid by the existing contour lines (darker). These elevations were created after fill was added. If the requirement of the temporary fill permit is that all of the material on the site must be removed, than the plan is not sufficient. There are large areas, closer to the stream, that are currently only protected by silt fence. If the expectation is that only the shaded portions on sheet C2 are to be removed before the expiration of the temporary fill permit, than the EPSC measures shown on the plan are sufficient. Also, if you look at the notes on page C3 they give the authority to require additional and appropriate EPSC measures to the State and soil conservation service, but not the City (1.02B). The notes also authorize the use of hay bales which are no longer allowed under VT standards (1.02D). In addition, tributary 9 of Potash Brook is not clearly indicated on the plans. It would be helpful if it was clearly labeled. 2. The applicant shall submit a revised plan detailing proposed erosion control measures which meet the satisfaction of the City Stormwater Superintendent. 3. Silt fence shall be maintained for the duration of the stockpile. The applicant shall be responsible for periodically checking the sediment loading at the fence so that it does not compromise the integrity of the silt fence. (c) Provision of a suitable bond or other security adequate to assure compliance with the provisions of this Section. Staff does not feel this requirement will be necessary for the subject application. (d) Determination of what shall constitute pre -construction grade under Section 3.07, Height of Structures. The pre -construction height for future development will be the grade which existed prior to the fill. This is noted on the plans which have been submitted by the applicant. Where required on the plans or where directed by the Engineer, erosion control blankets (matting) shall be North American Green C125BN for awales, and SC1508N for slope stabilization, or approved equal, for all areas for permanent installation, and C125 and SC150 where matting is being used as temporary protection of disturbed soils until a final surface stabilization method Is employed. 2.03 FILTER FABRIC A. When filter fabric is required, it shall conform to the requirements of Mirafi SOOX or approved equivalent. 2.04 CALCIUM CHLORIDE A. Calcium chloride shall conform to the requirements of AASHTO M 144. Either regular flake calcium chloride, Type 1 or concentrated flake, pellet or other granular calcium chloride, Type 2, may be used. 2.05 WATER A. The type of floc log used shall be based upon a site specific testing of the native soils. 2.08 STONE CHECK DAMS A. Stone check dams should be constructed of 2 to 3 Inch stone. Hand or mechanical placement will be necessary to achieve complete coverage of the ditch or swas and to ensure that the center of the dam is lower than the edges. The maximum contributing drainage area from any one check dam shall not exceed two acres. See the detail drawing located at the back of this section for the proper installation of stone check dams. PART 3 - EXECUTION 3.01 SILT FENCES A. The silt fences shall be constructed In accordance with the construction detail. The fence shall generally be placed 10 feet from the toe of the slope or as shown on the plans. The ends of the fence shall be placed uphill to form a horseshoe shope to trap all runoff. B. The silt fences shall be Inspected periodically for damage or build-up of sediments. All damaged fences shall be repaired or replaced. Sediment deposits shall be removed from the fence as they build up and be placed in an area where there Is no danger of further erosion. 3.02 EROSION MATTING A. Erosion matting shall be placed on all grass -lined ditches with profile grades exceeding 5.0% and all other areas called out on the plans, and shall be placed and maintained in accordance with the Vermont Agency of Transportation Standard Specifications Sections 654 and 755.07. 3.03 RESTORATION A. As soon as construction is completed in a given area, It shall be topsoiled, seeded, fertilized and mulched as specified in Section 02936 - Permanent Seeding. 3.04 STABILIZED ROAD ENTRANCE A. A stabilized pod of crushed stone located at any point where traffic wIII be entering or leaving the construction site to or from a public right-of-way or street or as shown on the drawings shall be constructed for the purpose of preventing the tracking of sediment onto public rights -of -way. B. Design Criteria: 1. Use 1.5 to 2.5 inch stone. 2. Use 8 Inch layer of stone. 3. Stone pod shall be full width of entrance. 4. Minimum length shall be 50 feet. 3.05 GRASS -LINED DITCHES A. B. All work and materials of this Section shall conform to the applicable requirements of the VAOT Standard Specifications, Division 600, 1.02 SUBMITTALS A. Provide the following for approval prior to delivery to the site: 1. Supplier's Certificate of Compliance attesting that lime, fertilizer and seed meet the requirements specified. 2. The Contractor shall provide representative topsoil samples for testing and approval, deliver samples to a public extension service agency testing laboratory, have testing report sent directly to the Landscape Architect and pay all coats. Testing shall report on mechanical and chemical (pH soluble salts) analysis. Report shall be submitted at least one month before any looming is to be done. 1.03 SEEDING SEASONS A. Seeding and initial fertilizing shall be done between April 1 and June 1, between August 15 and October 15, or as permitted. Seeding shall not be done during windy weather or when the ground is frozen, excessively wet, or otherwise untilloble. Wood fiber applied in a slurry (1/6" or longer) at a rate of 40 pounds per 1,000 square feet. 2.05 WATER A. All water used shall be obtained from fresh water sources and shall be free from Injurious chemical and other toxic substances harmful to plant life. No water which Is brackish will be permitted at any time. The Contractor shall identify to the Engineer all sources of water at least two weeks prior to use. The Engineer, at his discretion, may take samples of the water at the source or from the tank at any time and have a laboratory test the samples for chemical and saline content. The Contractor shall not use any water from any source which Is disapproved by the Engineer following such tests. PART 3 - EXECUTION 3.01 PREPARATION A. Examine finish surfaces and grades. Do not start seeding work until unsatisfactory conditions ore corrected. Perform seeding work only after planting and other work affecting ground surface has been completed. B. Notify Landscape Architect at least seven (7) working days prior to starting seeding C. Prepare areas immediately prior to seeding as follows: 1. Loosen soil of seed areas to a minimum depth of 4". 2. Remove stones over 1" In any diameter and sticks, roots, rubbish and extraneous matter. 3. Remove existing weeds and grosses by pulling or tilling under. 4. Grade areas to be seeded to a smooth, free draining even surface with a loose, moderately coarse texture. 5. Remove ridges and fill depressions as required to drain. 6. Restore prepared areas if eroded or disturbed prior to seeding. 3.02 SEEDING CONDITIONS A. Seeding shall not be done when the ground Is frozen, snow covered, muddy, or In any other unsatisfactory condition for planting. No seeding operations shall be conducted under adverse weather conditions or when soil moisture conditions are unfavoroble (too wet or too dry) or when winds exceed 5 MPH. B. Construction methods shall be those established as agronomically acceptable and feasible. The Contractor shall keep all equipment and vehicular and pedestrian traffic off areas that have been seeded to prevent excessive compaction and damage to young plants. Where such compaction has occurred, the Contractor shall rework the soil to make a suitable seed bed; then reseed and mulch such areas with the full amounts of the specified materials, at no extra expense to the Owner. C. Surface and seepage water should be drained or diverted from the site to prevent drowning or winter killing of the plant.. 0. All areas and parts of areas which fail to show a uniform stand of grass for any reason whatsoever shall be reseeded, and such areas and parts of area. shall be seeded repeatedly until all areas are covered with a satisfactory growth of grass. E. Watering is considered a necessary element for establishment and survival. F. Where ryegross has been planted for temporary erosion control and has not been eliminated prior to the completion of the work, such areas shall be diced at least 3 inches deep and seeded to permanent grasses to prevent the ryegrass from reseeding and becoming competitive with and retarding development of the permanent cover. 3.02 SEEDING A. Lime and fertilizer should be applied prior to or at the time of seeding and Incorporated Into the soil. Kinds and amounts of lime and fertilizer should be based on an evaluation of soil tests. When a soil test is not available, the following minimum amounts should be applied: Agricultural limestone, 2 tons per acre or 100 lbs. per 1,000 square feet. Nitrogen (N), 50 lbs. per acre or 1.1 lbs. per 1.000 square feet. Phosphate (P205), 100 lbs. per acre or 2.2 lbs. per 1,000 square feet. Potash (K20), 100 lbs. per acre or 2.2 lbs. per 1,000 square feet. (Note: This Is the equivalent of 500 lbs. per acre of 10-20-20 fertilizer or 1,000 lbs. per acre 5-10-10). B. Seed should be spread uniformly by the method most appropriate for the site. Methods Include broadcasting and hydroseeding as follows: 1. Broadcasting: Sow seed using mechanical spreader at a rate of 4 lbs./1,000 square feet. Distribute seed evenly over entire area by sowing equal quantity In tow directions at right angles to each other. Rake seed lightly Into top 1/8" of topsoil, roll lightly and water with a fine spray. 2. Hydroseeding: Mix specified seed, fertilize and pulverize mulch In water, using equipment specifically designed for hydroseed application. Continue mixing until uniformly blended Into homogenous slurry suitable for hydraulic application. Apply slurry uniformly to all areas to be seeded. Rate of application as required to obtain specified seed sowing rate. 3.03 MULCHING A. Mulch materials shall be spread uniformly by hand or machine at a rate of two 50 lb. bales per 1.000 square feet. B. Organic Mulch Anchoring - Straw or hay mulch must be anchored Immediately after spreading to prevent wind blowing. 3.04 MAINTENANCE A. The maintenance period shall begin immediately after seeding and shall continue until acceptance. B. All mulches must be Inspected periodically, In particular after rainstorms, to check for rill erosion. Where erosion Is observed, additional mulch shall be applied. Net should be Inspected after rainstorms for dislocation or failure. If washouts or breakage occur, reinstall net as necessary after repairing damage to the slope. Inspections should take place until grasses are firmly established. Grasses shall not be considered established until a ground cover is achieved which Is mature enough to control soil erosion and to survive severe weather conditions. Where mulch is used In conjunction with ornamental plantings, Inspect periodically throughout the year to determine if mulch is maintaining coverage of the soil surface; repair as needed. C. Seeding areas shall be protected and maintained by watering, reseeding, mowing, weeding, rolling, insect or disease control measures, re -fertilizing and repair of washouts which are necessary. D. The Contractor shall maintain all seeded areas until full vegetation is established. E. All seeded areas shall be kept free from weeds and debris, such as stones, cables, baling wire, and all slopes 4:1 or less (flatter) and level turf shall be mowed in the following manner: 1. When grass reaches a height of 4-6 mow to a height of 3". 2. At least two cuttings shall be made prior to final acceptance. F. Following mowing, all permanent seeding grass areas (mowed and unmowed) shall receive a uniform application of slow release fertilizer hydraulically placed at the rate of 10 pounds per 100 square feet. 3.05 ACCEPTANCE A. Associate Planner Cathyann La Rose and Administrative Officer Ray Belair have reviewed the plans submitted on October 17, 2007 and have the following comments. This application shall be reviewed under Section 3.12 of the Land Development Regulations. The removal from land or the placing on land of fill, gravel, sand, loam, topsoil, or other similar material in an amount equal to or greater than twenty (20) cubic yards, except when incidental to or in connection with the construction of a structure on the same lot, shall require the approval of the Development Review Board. The Development Review Board may grant such approval where such modification is requested in connection with the approval of a site plan, planned unit development or subdivision plat. This section does not apply to the removal of earth products in connection with a resource extraction operation. Standards and Conditions for Approval: (1) The Development Review Board shall review a request under this Section for compliance with the standards contained in this sub -Section 3.12(B). An application under Section 3.12(A) above shall include the submittal of a site plan, planned unit development or subdivision plat application showing the area to be filled or removed, and the existing grade and proposed grade created by removal or addition of material. The applicant submitted a plan showing the placement of the fill on the subject property. The heights of the mounds appear to be a maximum of 24 feet. Furthermore, the highest elevation of the proposed fill will be lower than that of Hinesburg Road. (2) The Development Review Board, in granting approval may impose any conditions it deems necessary, including, but not limited to, the following: (a) Duration or phasing of the permit for any length of time. The applicant previously noted that this fill would be used as a temporary location for the placement of fill from the Kennedy Drive reconstruction project. Although that project has reached completion, the applicant is requesting an extension of the date. The Development Review Board should consider imposing a limit on the length of time the fill is allowed to remain in piles on the property. 1. The approval for the placement of fill on this property shall expire at a date determined by the Development Review Board. The applicant should submit a plan for future seeding or planting. Furthermore, the fill poses a potential problem with stormwater runoff. The applicant should submit a plan to ensure proper erosion control, including appropriately placed silt fences. 2. The applicant shall submit a plan detailing proposed erosion control measures. Silt fence shall be maintained for the duration of the stockpile. The applicant shall be responsible for periodically checking the sediment loading at the fence so that it does not compromise the integrity of the silt fence. (c) Provision of a suitable bond or other security adequate to assure compliance with the provisions of this Section. Staff does not feel this requirement will be necessary for the subject application. (d) Determination of what shall constitute pre -construction grade under Section 3.07, Height of Structures. The pre -construction height for future development will be the grade which existed prior to the fill. This is noted on the plans which have been submitted by the applicant. Other: 3. No fill shall be placed in the public right of way of Hinesburg Road or Meadowland Drive. 4. Access to the proposed fill shall only be via Meadowland Drive. No access shall occur via Mansfield View Lane. RECOMMENDATION Staff recommends that the DRB continue miscellaneous application #MS-07-12 until the applicant submit the necessary grading and erosion control plans for staff review. The applicant said 15 October 2007. Mr. Belair said there is a question of access to the site by either Meadowland Dr. or Hinesburg Rd. The applicant indicated the majority of access would be from Meadowland Drive with an option for Hinesburg Road. They would exit from Hinesburg Rd. Ms. LaRose suggested restricting hours of use for Hinesburg Rd. The applicant agreed to 7:30 a.m.-5:30 p.m., Monday -Friday with some possible Saturday use at the same hours. Mr. Rowley, who lives next to that road, said the last time there was construction there was noise and dust, and it was awful for them. He asked that the applicant use only the paved section of road. The applicant agreed to use only Meadowland Drive. The approval motion was amended to add 15 October 2007 as a removal date for fill. Ms. LaRose noted that the person who now lives there is not an employee, and he says he has never performed any duties for the Humane Society. He added that he was asked to sign a paper saying he was an employee. Mr. Belair stressed that the occupant of the house will have to meet the staff definition of an employee. Mr. Belair also noted there are some light fixtures on the building that are not downcasting, and these must be removed. In addition, the Health Officer has asked to examine the property. We have attached a site plan for your review which depicts the existing grades at the site which are consistent with the previously approved site plan. The stockpile area has been stabilized and was constructed in conformance with the approved plans. There is a pile within the fill area which consists of sand which has not been topsoiled, seeded and mulched to eliminate the contamination of the sand. Munson Earth -Moving Corp. will be moving this material out of the stockpile area once a suitable off site location has been chosen. This application shall be reviewed under Section 3.12 of the Land Development Regulations. The removal from land or the placing on land of fill, gravel, sand, loam, topsoil, or other similar material in an amount equal to or greater than twenty (20) cubic yards, except when incidental to or in connection with the construction of a structure on the same lot, shall require the approval of the Development Review Board. The Development Review Board may grant such approval where such modification is requested in connection with the approval of a site plan, planned unit development or subdivision plat. This section does not apply to the removal of earth products in connection with a resource extraction operation. Standards and Conditions for Approval: (1) The Development Review Board shall review a request under this Section for compliance with the standards contained in this sub -Section 3.12(B). An application under Section 3.12(A) above shall include the submittal of a site plan, planned unit development or subdivision plat application showing the area to be filled or removed, and the existing grade and proposed grade created by removal or addition of material. The applicant submitted a plan showing the placement of the fill on the subject property. The heights of the mounds appear to be a maximum of 24 feet. Furthermore, the highest elevation of the proposed fill will be lower than that of Hinesburg Road. (2) The Development Review Board, in granting approval may impose any conditions it deems necessary, including, but not limited to, the following: (a) Duration or phasing of the permit for any length of time. The applicant has noted that this fill will be used as a temporary location for the placement of fill from the Kennedy Drive reconstruction project. The applicant is estimating a completion date of 2007/2008. The Development Review Board should consider imposing a limit on the length of time the fill is allowed to remain in piles on the property. 1. The approval for the placement of fill on this property shall expire at a date determined by the Development Review Board. However, the fill poses a potential problem with stormwater runoff. The applicant has submitted a plan to ensure proper erosion control, including appropriately placed silt fences. This is sufficient for a temporary stockpile. 2. The silt fence shall be maintained for the duration of the stockpile. The applicant shall be responsible for periodically checking the sediment loading at the fence so that it does not compromise the integrity of the silt fence. (c) Provision of a suitable bond or other security adequate to assure compliance with the provisions of this Section. Staff does not feel this requirement will be necessary for the subject application. (d) Determination of what shall constitute pre -construction grade under Section 3.07, Height of Structures.
