HomeMy WebLinkAboutVR-96-0000 - Decision - 0056 Bartlett Bay RoadSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 24th day of June, 1996 the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of George and Judy Bowers, 56 Bartlett Bay Road. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: 1) The area in question is zoned R-1 and C.O. District. 2) The existing structure is located within thirty-six (36) feet of elevation 102 feet of Lake Champlain. 3) The Cons ervati on -Open Space District is a 150 foot setback from elevation 102 or the mean water line level. 4) The entire structure is non -complying and expansion is prohibited. 5) The structure is a converted camp and was constructed in the 19301s. 6) The proposed addition will not increase the non -conforming setback towards the lake. Conclusion 1) All structures located along the lake are converted camps into single family year round dwellings which were constructed prior to zoning by-laws. 2) City sewer and water is available within this district. 3) No possibility that the property can be developed in total compliance. 4) The proposed addition will be designed so it will be in compliance with the general character of the area. 5) Addition will square off the structure, not increase the setbacks in any way. 1 6) No neighborhood concerns or opposition. Based upon Board of construct located at the findings and conclusion set -forth above, the Zoning Adjustment hereby grants the applicants request to a 121x 15' addition to an existing residential unit South Burlington Zoning Board of Adjustment AUb �cqn wQU F
