HomeMy WebLinkAboutZB-95-0000 - Decision - 0054 Bartlett Bay RoadR STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 24th day of April, 1995 the South Burlington Zoning Board of Adjustment heard testimony regarding the appeal of Jere and Carole Meserole of 54 Bartlett Bay Road, this meeting was also attended by Mary Mazur of 52 Bartlett Bay Road. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) Applicant owns a lot containing approximately 13,500 square feet located on the westerly side of Bartlett Bay Road. 2) The property is developed with a 201x 36' residential single family dwelling including a lllx 131 addition. 3) The dwelling is located to within thirty-two (32) feet of elevation 102.5 feet which is the high water mark of Lake Champlain. 4) The City Conservation & Open Space District is defined as a strip of land 150 feet in depth along Lake Champlain. 5) The structure is located within the Conservation & Open Space District. 6) The applicant proposes to construct a 151x 18' addition to the southerly side of the existing dwelling. Conclusions 1) The Bartlett Bay area is located within a Residential 1 District, single family residential uses are permitted. 2) Section 26.003 of the Zoning regulations do not permit expansions of non -conforming structures. 3) The setback from the lake is not affected by the proposed addition. 4) The dwelling is a converted summer camp which is the same with the majority of the dwellings constructed along the westerly side of Bartlett Bay Road. 1 5) The physical construction of the dwelling limits the design of the proposed addition. 6) The addition is in keeping with the essential character of the neighborhood. 7) The addition is a reasonable use and reasonable modification that does not increase the non -conformity. 8) The narrowness of the lot prohibits the placement of the addition in any other location. 9) The entire structure and lot is already non -conforming. This small addition will be the minimum variance that will afford relief. Based upon the findings and conclusions setforth above, the Zoning Board of Adjustment hereby grants the applicants request to construct a 15'x 18' addition to the southerly side of the dwelling located at 54 Bary,-I-e�tt_Bay Road. unairman; South Burlington Zoning Board of Adjustment MAY 0 8 M5 2
