Based upon the Findings contained in this permit, the Secretary has determined that the proposed
project will comply with Chapter 49A of Title 10, § 1441 et seq. and is hereby approved under the
following conditions and specifications.
1. Specific Conditions
1a. All impervious surface associated with this project shall not be expanded towards the mean water
level, 95.5 feet National Geodetic Vertical Datum 1929.
1b. All impervious surface associated with this project shall be located on a site with a slope of 1% or
less.
1c. All new impervious surfaces associated with this project shall not exceed 300.5 square feet.
1d. No new cleared area shall be created by this project. All remaining vegetative cover shall be
managed in accordance with the Vegetation Protection Standards contained within 10 V.S.A. § 1447.
Cleared areas are those areas not managed in accordance with the Vegetation Protection Standards
in 10 V.S.A. § 1447.
1e. The project shall be completed as shown on the application, plans, and support documents as
submitted by the applicant, and approved by the Shoreland Permit Program.
2. Standard Conditions
2a. Demarcation of project areas. All authorized impervious surfaces and/or cleared areas shall be visibly
demarcated prior to the commencement of the project.
2b. Erosion control and bank stability management. Best management practices shall be used to provide
erosion control and bank stability of the project area while completing the project and be maintained
as necessary.
2c. Requirement to record in the land records. The conditions of this permit shall run with the land and
shall be binding upon and enforceable against the permittee and all assigns and successors in
interest. The permittee shall record and index this permit in the associated municipal land records
within 30 days of issuance of this permit and prior to the conveyance of any parcel subject to the
jurisdiction of this permit. The permittee, or any other interested party, may request a copy of the
approved application plans and support documents from the Shoreland Permit Program.
2d. Compliance with other regulations. This permit does not relieve the permittee from obtaining all
other approvals and permits prior to construction or the responsibility to comply with any other
applicable federal, state, and local laws or regulations.
2e. Authorization for substantial changes. No alterations to existing structures other than those
indicated in this permit that would change or affect the authorized impervious surface or cleared
area shall be allowed without prior written approval by the Shoreland Permit Program. Construction

of additional nonexempt impervious surface or cleared area may not be granted unless the proposal
conforms to the applicable laws and regulations.
2f. Transfer of parcel. Each purchaser of this parcel shall be provided a copy of this Shoreland Protection
Permit and related support materials prior to conveyance of any portion of the parcel to that
purchaser.
2g. Access to property. By acceptance of this permit, the permittee agrees to allow representatives of
the state of Vermont access to the property covered by the permit, at reasonable times, for the
purpose of ascertaining compliance with Vermont's statutes, regulations, and Shoreland Protection
Permit conditions.
2h. Legal responsibilities for damages. The Secretary, by issuing this individual permit, accepts no legal
responsibility for any damage direct or indirect of whatever nature and by whoever suffered arising
out of the approved activity.
2L Riphts and Privileges. This permit does not convey any property rights in either real or personal
property, or any exclusive privileges, nor does it authorize any injury to public or private property or
any invasion of personal rights, nor any infringement of federal, state, or local laws or regulations.
2j. Duty to comply and enforcement. The permittee shall comply with all terms and conditions of this
permit. Any permit noncompliance shall constitute a violation of 10 V.S.A. Chapter 49A and may be
cause for any enforcement action and revocation, modification, or suspension of the permit. It shall
not be a defense for the permittee in an enforcement action that it would have been necessary to
halt or reduce the permitted activity to maintain compliance with the conditions of this permit.
2k. Reopener. If, after granting this permit, the Secretary determines, at his or her discretion, that there
is evidence indicating that an authorized activity does not comply with the requirements of 10 V.S.A.
Chapter 49A, the Secretary may reopen and modify this permit to include different limitations and
requirements. A reduction in the size of the parcel by dividing the land by sale, gift, lease, mortgage
foreclosure, court -ordered partition or decree, or by filing of a plot, plan, or deed in the records of
the municipality in which the act of division occurred, may require the reopener and modification of
this permit to ensure compliance with the requirements of 10 V.S.A. Chapter 49A.
21. Appeals. Pursuant to 10 V.S.A. Chapter 220, any appeal of this decision must be filed with the clerk of
the Environmental Division of the Superior Court within 30 days of the date of the decision. The
Notice of Appeal must specify the parties taking the appeal and the statutory provision under which
each party claims party status; must designate the act or decision appealed from; must name the
Environmental Division; and must be signed by the appellant or the appellant's attorney. In addition,
the appeal must give the address or location and description of the property, project, or facility with
which the appeal is concerned and the name of the applicant or any permit involved in the appeal.
The appellant must also serve a copy of the Notice of Appeal in accordance with Rule 5(b)(4)(B) of
the Vermont Rules for Environmental Court Proceedings. For further information, see the Vermont

3. Findings
3a. The Secretary received an application from Diane & Peter Sande for a Shoreland Permit under 10
V.S.A. 1444(a), Permit Standards, on October 15, 2014.
3b. Within the Protected Shoreland Area, and as described in Permit Application #49, the project is to
reconstruct and expand the existing habitable structure 106 feet from the mean water level, creating
300.5 square feet of new impervious surface no closer to the mean water level. In accordance with
10 V.S.A. 1441, a permit is required for the creation of cleared area or impervious surface.
3c. The subject parcel has a surface area of 10,550 square feet, 1,403 square feet of existing impervious
surface, and 9,139 square feet of existing cleared area located within the Protected Shoreland Area.
3d. 10 V.S.A. 1444(a)(1): All cleared area and impervious surface associated with the project is located at
least 100 feet from mean water level.
3e. 10 V.S.A. 1444(a)(2)(A): The project area is located on a slope of 1%, a less than 20% slope.
3f. 10 V.S.A. 1444(a)(3)(A): The project and existing impervious surface consists of no more than
1,703.50 square feet, 16.1% of the total parcel within the Protected Shoreland Area, resulting in no
more than 20%.
3g. 10 V.S.A. 1444(a)(4)(A): No new cleared area is proposed with this project. The existing cleared area
consists of 9,139 square feet, 86.6% of the parcel within the Protected Shoreland Area, more than
40%.
3h. No public comments have been received in response to this permit application.
3i. The Secretary approved the application from Diane & Peter Sande for a Shoreland Permit on
December 3, 2014.
Authorization
The Vermont Department of Environmental Conservation has made a determination that the project above
qualifies for individual shoreland permit coverage if conducted in accordance with the Shoreland Protection
Act, per Chapter 49A of Title 10, § 1441 et seq., and is subject to the conditions herein specified.
This permit shall be effective on the date of signing.

Hi Dan:
Good to speak with you yesterday. As I mentioned Diane & Peter Sande are applying for a City
of South Burlington Conditional Use permit to demolish their existing cottage and replace it with
a larger home. Here is some additional detail from their application to the City:
Parcel size -—10,550 sq. ft.
Existing building coverage is 1135.75 SF or 10.77 %
Proposed " is 1703.63 SF or 16.15%
Existing overall impervious coverage is 1135.75 SF (house) plus driveway (-1004 SF) for a
total of—2,139.75 SF or approximately 20.28 %. This is approximate based on measuring the
impervious myself off their plat.

In concert with City staff here, we have discussed whether it is best to advise the applicant to
wait before proceeding further with their City permit until they receive their State Shoreland
Permit (which may include additional plantings, stormwater treatment required by the Permit) or
go ahead and meet with the City Development Review Board on November 4th as now
scheduled. As you probably realize, we would not want to grant the applicant a City permit
including detailed plans for building coverage, lot coverage and landscaping only to have to
force them to come back and amend to be in compliance with a State permit.
We are meeting next Tuesday at 1:30 p.m. to discuss the application further with the Sandes with
an eye to reviewing their proposed landscaping and other measures related to the City's Surface
Water Protection Standards, Lakeshore Neighborhood Zoning District, Conditional Use
standards, etc.
If you can prior to noon on Tuesday, give us a sense of how the State is currently assessing their
application and what measures the State may require for approval that would aid us in our
discussions with the Sandes.

Hi Diane and Peter:
A few small things that would be helpful for you to bring to our meeting on Tuesday.
1) Can you double-check the existing footprint of the house + porch + shed. Your
application says 1,135.75 sq. ft. Measuring from the plans you submitted I came up with
1,120.35 sq. ft. with the house measuring 35 ft. x 29. Ft., the porch at 18 x 3.5 ft. and the
shed at 7.1 ft. x 3.5 ft.
If you do have a chance to physically measure the house, porch and shed, be sure the
measurements include any eaves or overhangs as these should be included in the
calculation.
2) One of the main issues to discuss will be landscaping, namely:
Section 12.01(D) Pre -Existing Structures along Lake Champlain and within Queen City
Park
a) A landscaping plan showing plans to preserve maintain and supplement existing
trees and ground cover vegetation is submitted and the DRB finds that the overall plan
will provide a visual and vegetative buffer for the lake and/or stream.
While the landscaping plan you provided is a start, it would be best if the plan was
revised to show:
-the location of existing vegetation
-the number of proposed new plants/trees in addition to their location.
With this information the Board can assess to what degree existing trees and ground
cover vegetation is supplemented.
3) On a related note, we'll also want to examine
Section 12.01 (C) (2) General Stream and Surface Water Protection Standards
C. Surface Water Buffer Standards ("Stream Buffers")
(1) Applicability. The requirements of this Section shall apply to all lands described
as follows:
....... (e) All land within one hundred fifty (150) feet horizontal distance of the high
water elevation of Lake Champlain, which for purposes of these regulations shall be one
hundred two (102) feet above mean sea level datum.
(2) General standards. It is the objective of these standards to promote the
establishment of heavily vegetated areas of native vegetation and trees in order to reduce
the impact of stormwater runoff, reduce sedimentation, and increase infiltration and base
flows in the City's streams and Lake Champlain. Therefore, except as specifically
permitted by the DRB pursuant to the standards in Section 12.01(C)(3), (C)(4), (D)
and/or (E) below, all lands within a required stream buffer defined above shall be left in
an undisturbed, naturally vegetated condition. Supplemental planting and landscaping
with appropriate species of vegetation to achieve these objectives shall be permitted. The
specific standards for the vegetation and maintenance of stream buffers are as follows:
(a) The clearing of trees that are not dead, heavily damaged by ice storms or other
natural events, or diseased, and the clearing of any other vegetation other than invasive
species, is permitted only in conjunction with DRB approval pursuant to (3) or (4) below.
(b) Any areas within a required stream buffer that are not vegetated or that are
disturbed during construction shall be seeded with a naturalized mix of grasses rather
than standard lawn grass, and shall not be mowed more than one (1) time per calendar
year after establishment.
To that end, we'd also like to discuss ways to see if there are areas of the property where
you'd be able to plant more densely or thickly vegetated buffer, even unmown grass or
wildflowers, in order to improve water quality by absorbing, adsorbing, and filtering
nutrients and sediment, and enhancing the ability of the land to absorb stormwater runoff
so that it does not sheet flow directly into Lake Champlain.
If you can relay these comments to Betty Ellis that would be great. If she can make it to
the meeting on Tuesday that would be even better.

I'm just checking in on a few things.
1) Have you heard back from the State yet on your Shoreland Permit application?
2) Have you had a chance to update your landscaping plans so it delineates existing
plantings and then proposed new plantings and also any revisions to increase the amount
of "native grasses" or ground cover?
3) Lastly, as you know, for measuring the footprint of the existing house, we had you
measure including the eaves/overhangs of the house. I believe your first drawing of the
proposed new house was just based upon the footprint of the walls. Did you have your
builder give you "new" dimensions that are inclusive of eaves/overhangs?
We aim to finalize our staff comments by December 12th so if you can provide this
information by early next week that would be great.

Any development, new construction, or substantial improvement of a property affectod by a LOMA must
comply with all applicable State and local criteria and other Federal criteria.
The NFIP offers two types of flood insurance policies to property owners: the low-cost Preferred Risk
Policy (PRP) and the Standard Flood Insurance Policy (SFIP). The PRP is available or one- to
four -family residential structures located outside the SFHA with little or no loss histo�y. The PRP is
available for townhouse/rowhouse-type structures, but is not available for other types lof condominium
units. The SFIP is available for all other structures. Additional information on the PtP and how a
property owner can qualify for this type of policy may be obtained by calling the Flood Insurance
Information Hotline,,toll free, at 1-800-427-4661. Before making a final decision about flood insurance
coverage, FEMA strongly encourages property owners to discuss their individual flood risk situations and
insurance needs with an insurance agent or company.
FEMA has established "grandfather" rules to benefit flood insurance policyholders w�o have maintained
continuous coverage. Property owners also may wish to note that, if they live outside, but on the fringe of
the SFHA shown on an effective NFIP map and the map is revised to expand the SF to include their
structure(s), their flood insurance policy rates will not increase as long as the coverag for the affected
structure(s) has been continuous. These property owners would continue to receive a lower insurance
policy rates.
LOMAs are based on minimum criteria established by the NFIP. State, county, and community officials,
based on knowledge of local conditions and in the interest,of safety, may set higher st dards for
construction in the SFHA. If a State, county, or community has adopted more restrictive and
comprehensive floodplain management criteria, these criteria take precedence over th minimum Federal
criteria.
In accordance with regulations adopted by the community when it made application td join the NFIP,
determinations issued by FEMA to amend an NFIP map must be attached to the community's official
record copy of the map. That map is available for public inspection at the community's official map
repository. Therefore, FEMA sends copies of all such determinations to the affected (community's official
map repository.
When a restudy is undertaken, or when a sufficient number of revisions or amendmei
flood map panels, FEMA initiates the printing and distribution process for the affecte
notifies community officials in writing when- affected -Mood map panels are being phy
distributed. In such cases, FEMA attempts to reflect the results of the LOMA on the
results of particular LOMAs cannot be reflected on the new flood map panel because
FEMA notifies the community by letter and revalidates the LOMAs in that letter. LC

ADDITIONAL INFORMATION REGARDING
LETTERS OF MAP AMENDMENT
When making determinations on requests for Letters of Map Amendment (LOMAs), the Federal
Emergency Management Agency (FEMA) bases its determination on the flood hazard information
available at the time of the determination. Flood conditions may change or new information may be
generated that would supersede FEMA's determination. When necessary, FEMA will inform the
community by letter about superseded determinations.
Removal of a property (parcel of land or structure) from the Special Flood Hazard Area (S',FHA), where
flood insurance is required by law in connection with certain federally backed loans, means that FEMA has
determined that the property is not subject to.inundation by the base (I-percent-annual-chance)flood. This
does not mean the property is not subject to other flood hazards.
A LOMA removes the Federal requirement for the lender to require flood insurance coverage for the
affected property. It is not a waiver of a lender's condition that the property owner maintain flood
insurance coverage for the property. Only the lender can waive the flood insurance purchase requirement,
because the lender imposed the requirement. The property owner must request and receive, a written
waiver from the lender before canceling the policy. The lender may determine, on its own, as a business
decision, that it wishes to,continue the flood insurance requirement to protect its financial risk on the loan.
If a lender releases a property owner from the flood insurance requirement, and the property owner decides
to cancel the policy and seek a refund, the National Flood Insurance Program (NFIP) will refund the
premium paid for the current policy year, provided that no claim is pending or has been paid on the policy
during the current policy year.. The property owner must provide a written waiver of the insurance
requirement from the lender to the property insurance agent or company servicing the policy. The agent or
company will then process the refund request.
Please note that your risk of flooding has not been eliminated, only reduced. The property could be
inundated by a flood with a magnitude greater than the base flood or by localized flooding not shown on
the effective NFIP map.
Therefore, canceling or not renewing your flood insurance policy could have disastrous consequences,
leaving you with no insurance protection from future flood losses. There's a big differencje between
having to buy flood insurance because the law says you must and choosing to keep your flood insurance
because it is in your best interest to do so.
Floods occur, with all too tragic frequency, in areas of moderate or minimal flood risk. In fact, about
25 percent of all flood insurance claims occur in these areas — outside the higher -risk designated A and V
zones. Tropical Storm Allison (2001), Hurricane Floyd (1999), Hurricane Fran (1997), and the Great
Midwest Flood (1993) all caused major flood damage beyond SFHAs where property owners must buy
flood insurance. That's why FEMA encourages you to keep your flood insurance coverage, even if you are
no longer required to do so by law.
The good news is that you now may be eligible to pay much less for your flood insurance coverage.
Contact your insurance agent to discuss the pricing benefits you may enjoy as a result of this map action.
The LOMA provides FEMA's comment on the mandatory flood insurance requirements of the NFIP as
they apply to a particular property. A LOMA is not a building permit, nor should it be construed as such.

to install water -oriented development consisting of concrete stairs down to the lake, 50
Bartlett Bay Road.
This application is being reviewed under Conditional Use criteria and Section
12.01(1)(3) of the South Burlington Land Development Regulations.
Associate Planner Cathyann LaRose, referred to herein as Staff, has reviewed the
plans submitted on July 22, 2011 and has the following comments:
CONDITIONAL USE CRITERIA
Pursuant to Section 14.10(E) of the Land Development Regulations, the proposed
conditional use shall meet the followin standards:
The proposed use, in its location and operation, shall be consistent with the
planned character of the area as defined by the City of South Burlington
Comprehensive Plan.
The proposed project is consistent with the planned character of the area, as defined by
the South Burlington Comprehensive Plan.
The proposed use shall conform to the stated purpose of the district in which the
proposed use is located.
The proposed changes conform to the stated purpose of the Residential 1-Lakeview
Neighborhood Zoning District. The use of property is not proposed to change. The
changes are minimal and are in large part the simple construction stairs to connect to
an existing cement dock.
The Development Review Board must find that the proposed uses will not
adversely affect the following:
(a) The capacity of existing or planned municipal or educational facilities.
The proposal does not adversely affect the capacity of municipal or educational
facilities.
(b) The essential character of the neighborhood or district in which the

property is located, nor ability to develop adjacent property for appropriate
uses.
The proposal does not adversely affect the character of the neighborhood. .
(c) Traffic on roads and highways in the vicinity.
The proposed measures will have no affect traffic on roads or highways in the vicinity.
(d) Bylaws in Effect
The proposed water -oriented development shall also adhere to Section 12(D)(3) of the
South Burlington Land Development Regulations, Surface Water Protection Standards,
governing water -oriented development.
(a) The improvement involves, to the greatest extent possible, the use of natural
materials such as wood and stone.
The applicant is proposing cement stairs to be set into the existing rocks which lead to
an existing cement dock. The board should discuss whether this material is sufficient.
(b) The improvement will not increase the potential for erosion.
The proposed improvements will result in more natural, sturdy, and modern steps which
will guide people to the dock. Staff does not believe that there will be any increased
erosion resulting from the proposed changes.
(c) The improvement will not have an undue adverse impact on the aesthetic
integrity of the Lakeshore.
The changes proposed are comparable to those which already exist along to the
shoreline in the area. This proposed steps will be no greater in size or view than what
currently exists.
(d) A landscaping plan showing plans to preserve, maintain, and supplement
existing trees and ground cover vegetation is submitted and the DRB rinds that
the overall plan will provide a visual and vegetative buffer for the lake.
There are no proposed changes to the existing landscaping.

Staff recommends that the Development Review Board approve conditional use
