HomeMy WebLinkAboutAgenda 05 06 07_SP-20-020 SP-20-021 MS-20-03_South Village_Lot 4A 4B and 1 575 Dorset Street South Burlington, VT 05403 tel 802.846.4106 fax 802.846.4101 www.sburl.com               TO:    South Burlington Development Review Board    FROM:   Marla Keene, Development Review Planner    SUBJECT:   SP‐20‐020 64 Aiken St, SP‐20‐021 96 Aiken St, and MS‐20‐03 1840 Spear St    DATE:    June 16, 2020 Development Review Board meeting      South Village Communities, LLC has submitted the above‐referenced applications to construct two twelve‐unit  three story multifamily building with underground parking on an existing 0.53 acre lot (Lot 4A) at 64 Aiken  Street and an existing 0.52 acre lot (Lot 4B) at 96 Aiken Street.  At the May 19, 2020 hearing, the Board heard  the applicant and continued the hearing to allow review of materials submitted between the time of packet  publication and the hearing, and to accept additional testimony on subjects described below.  DIMENSIONAL REQUIREMENTS  The applicant has indicated they would like to provide coverage on the subject lots of 72%.  The master plan  approval granted a waiver to increase the allowable lot coverage for multifamily buildings from 35% (the standard  allowable lot coverage) to 65%.  The Board may choose to grant a further waiver of overall coverage to 72% in this  case if the overall approved coverage of 13.9% (from MP‐05‐02) and the SEQ‐NR coverage of 35% allowed in the  current LDRs are not exceeded.  The applicant provided written testimony that they have an overall coverage of  14.9%.    Staff considers it is unclear if this coverage is calculated for the entire master plan area or the SEQ‐NR portion of the  project.  If for the entire master plan, the applicant is in fact over their allowable coverage and the Board should not  grant the waiver for this lot.  If 13.9% is only for the SEQ‐NR area, Staff considers the Board may grant the  requested waiver for this lot.  WATER SUPPLY  The applicant has obtained preliminary water allocation.  Staff considers this no longer needs to be included as a  condition of approval.  FIRE DEPARTMENT COMMENTS  The applicant has obtained written approval from the fire department that the fire truck turning movements are  acceptable.  The applicant has agreed to locate a hydrant on the same side of the street as the proposed buildings.  Staff recommends the Board ask the applicant to clarify where the hydrant will be located and whether they are  proposing to not construct one of the hydrants on the other side of the street, to allow a clear condition of approval  to be written.  LANDSCAPING  The applicant has provided landscaping around the transformer and augmented the landscaping plan to meet the  minimum required landscaping budget.  The City Arborist reviewed the revised plans on May 20, 2020 and  indicated there were no issues.  #SP‐20‐020  #SP‐20‐021  #MS‐20‐03  2  STORMWATER MANAGEMENT  The Stormwater section had provided comments pertaining to erosion prevention and sediment control which can  be incorporated as conditions of approval, as well as comments pertaining to design of the stormwater  management system.  The Applicant has made modifications to their plans to address the comments on the  stormwater management system, which the Assistant Stormwater Superintended indicated satisfied the  comments of the City Stormwater Section on May 4.  ROADWAYS AND CIRCULATION  The applicant has reduced the curb cuts to a standard 20‐ft radius and corrected the alignment of the driveway so  that it is a smooth curve.  Staff considers this criterion met.  MS‐20‐03  Concurrent with the subject applications, the applicant submitted MS‐20‐03 for alteration of grade on the lot  adjacent to the two twelve‐unit buildings.  The Board reviewed this application and found no issues other than  those identified on the adjacent parcels, but continued that hearing in order to allow adjustments necessary to  address comments on SP‐20‐020 and SP‐20‐021.    Staff recommends the Board close the hearing on MS‐20‐03 at this time.  RECOMMENDATION  Staff recommends that the Board discuss the project with the applicant and close the hearings.  Respectfully submitted,   ____________________________________  Marla Keene, Development Review Planner   STW W WWWWWWWWWWWW W W W W GGGGGGGGGGGGGGG G G G G G GGGST ST ST STSTST ST STSTSTSTST ST ST ST STSTSTST SSSSSSSSSSSSSS S S S S S S S S S S UEUEUEUEUEUEUEUE UE UE UE UE UE UE UE UEUEUEUEUEUEUE UEUEUEUEUEUEUEUEUEUEUEUEUEUEUEUEUE UEUEUESEX. approved per Master Plat.  For the record, all Plats, recorded and proposed have always  shown these two 12‐plex multi‐family buildings at Aiken St, including Master Plat labeled  MP 1 distributed to all homeowners with their Common Interest Community documents at  the time of their purchase and sale agreement engagement, as required by VT  Statute.  There should be no buyers not apprised of this intention, unless they chose not to  read through those legal documents.     We have consistently over the past decade or more shared intentions of these two 12‐ plex buildings in presentations and public hearings and more recently in conjunction with  the Staff and DRB requested Affordability Plan.  There was only a brief slice of time when  we explored different concepts which never materialized, we were honest is sharing that’s  what they were.  Most recently, since fall and over the winter, in all three public hearings  for the Affordable Plan, the two 12‐plex were consistently represented on the  plans.   They’ve been viewed by many residents as was evident by the many residents who  participated in those public hearings. None of those residents had any concerns about the  12 plexes.  Many residents have communicated to us, they acknowledge they were and  remain a viable and accepted option and were good planning in achieving the 321 ‘  Affordable Plan’ success. We also have residents who have been waiting for these buildings  to be built so they can move into a one level home and still remain at South Village.  RE#2 Traffic;  South Village traffic approvals incorporate approvals for 344 units and a  100 student school and the Farm.  With the recent approval of the Affordable Plan, overall  units were reduced to 321 and the 100 student school use was eliminated, both greatly  reducing traffic in the neighborhood.   We maintain that the traffic impacts are reduced by  our recent applications and approvals and this was validated in the recent traffic studies for  the recent negation of need for a left hand turn from Spear St into S. Jefferson Rd.  The  traffic studies updated at that time which was only a few month ago,  concluded that  2 overall trips were less than originally scoped for the Master Plan.  At present, unit  reduction and the school elimination, are further reducing impacts.   The Lot 4s have always  been anticipated to have 24 units and our onsite parking meets parking needs for  inhabitants.  The Master Plan covered this scope.  Lots 5 and 5A are approved building lots  and always have been and are needed in order to reach out required overall density and  affordability plans.   RE#3 Height;  The three story design has been shared since the projects onset and has  previously received Master Plan approval, two separate DRB Site Plan Approvals and even  an Architectural Design Review Board approval (when there was one) The height allows us  to build 12 units in each building which enables us to meet the density requirements we  have agreed to in the Affordable Plan and for the overall requirement of South Village to  produce 321 unit, of 295 market rate and 26 Affordable Units.  These buildings are  designed in the South Village vernacular with a mix of clapboard, shakes and stone, and will  be sited with significant landscaping, with Oaks and evergreens softening the boundaries of  the adjacent lots. The previous DRB & ARB reviews and approvals have also lead to the  buildings being complemented by glazing, balcony’s, and variation of the building planes to  offer a visually appealing structures.    We believe the buildings will not only be visually  pleasing, but will provide a long awaited offering of a needed unit type, flats serviced by a  central elevator to provide a home for folks who need or prefer a home without  stairs.   This style of home has been in demand for years and we’re looking forward to filling  the need in our community.      Lastly, we acknowledge the lots being vacant and some of the last to be developed is a  change for folks who are used to, and likely have become accustomed to, them being  vacant, and understand they might not like the thought of them being developed, but it is
