HomeMy WebLinkAboutAgenda 08 & 09_SD-19-31 SP-19-39_793 907 Shelburne Rd_R L Vallee 575 Dorset Street South Burlington, VT 05403 tel 802.846.4106 fax 802.846.4101 www.sburl.com               TO:    South Burlington Development Review Board  FROM:    Marla Keene, Development Review Planner  SUBJECT:   SD‐19‐39 793 & 907 Shelburne Road – Site Plan Application  DATE:     June 2, 2020 Development Review Board meeting      R. L. Vallee, Inc., hereinafter referred to as the applicant, is seeking site plan approval to demolish the existing  structures at 907 Shelburne Road and a portion of an existing service station at 793 Shelburne Road and  construct an expanded service station with two additional fueling positions for a total of ten and an associated  4,265 square foot retail sales and restaurant building, 793 and 907 Shelburne Road.  CONTEXT  The Board held its initial site plan hearing on February 4, 2020, continued on March 4, 2020 and April 21, 2020,  and now to June 2, 2020.  At the April 21 hearing, the Board clearly enumerated that there were 5 issues on  which they were requesting modifications and additional testimony:   Façade   Parking   Stormwater   Fire   Champlain Water District    The applicant submitted revised materials on May 11 and May 20, 2020.  Staff therefore recommends the  Board take testimony on the below topics, and any other topics the Board wishes to discuss, and close the  hearing.    Staff refers the Board to the packets from February 4 and March 4, 2020 for a full review of all applicable  criterion.  Staff has excluded from this memo criterion for which in their opinion the Board has concluded their  discussion.  APPLICABLE STANDARDS  This complete application was submitted on October 25, 2019.  The applicant requested the Board consider the  project under the LDRs adopted on October 7, 2019, and effective October 28, 2019 based on the fact that the  City Council published a warning on the proposed amendments on August 29, 2019.  The Board reviewed the  request in deliberative session and directed staff to report to the applicant that it would accept the applicant’s  request therefore these notes reflect the applicable criteria under the LDr adopted October 7, 2019.    #SP‐19‐39  2   COMMENTS  Planning Director Paul Conner and Development Review Planner Marla Keene (“Staff”) have reviewed the  revised materials submitted on 5/11/2020 and 5/20/2020 and offer the following comments.  Comments for  the Board’s attention are indicated in red.  Final Plat Application #SD‐19‐31  The Board is concurrently reviewing final plat application #SD‐19‐31 to consolidate the two subject lots into one lot.   Staff consider there are no outstanding issues on that application.  Until this point, the Board has kept both  hearings open to allow them to be concluded together.  Since, if approved, the final plat will include the  requirement to record the related mylar within six months, and if it is not recorded the subdivision will expire, Staff  considers the Board could close final plat application #SD‐19‐31 and issue it’s decision without waiting for the  hearing on SP‐19‐39 to be closed.    1. Staff recommends the Board ask the applicant’s preference for SD‐19‐31, and then recommends the Board  discuss whether they will close the hearing on #SD‐19‐31.  Site Plan Application #SP‐19‐39  In addition to the non‐compliant expansion of an existing nonconformity discussed in detail at earlier hearings,  the Board indicated that the applicant’s proposed configuration did not meet urban design overlay criteria of  10.06 or the requirements of 14.06B(2) requiring parking to be located to the rear and sides of a building.  Staff  communicated with the applicant between hearings to recommend improvements based on DRB guidance to  enhance the prominence of the building and relocate parking, which the applicant has partially incorporated into  their plans.  The applicant’s proposed modifications, included in the packet, involve moving the building bump out on the  north side of the building towards Shelburne Road by approximately five (5) feet, adding a decorative eaves  over the Shelburne Road facing entrances, widening the existing fuel canopy by 6’‐6”, adding three non‐ conforming spaces along Queen City Park Road, relocating the dumpster to be fully visible from Shelburne  Road, removing one parking space along the western property line, and relocating one space from east of the  building bump out to west of the building bump out.  The revised configuration results in an increase in the  proposed number of spaces from 21 to 23.    2. Staff considers that the proposed installation of a fifth pump and associated fueling canopy, which Staff and  the Board consider to be a prohibited expansion of an existing non‐conformity, precludes this site from  being designed to comply with the standards regarding parking and Urban Design Overlay.  If the delivery  truck movements were not constrained by the additional pump, then the building bump‐out could be moved  forward, additional parking placed behind the bump out, and the prominent front entry standards more  fully complied with.  Staff considers the current attempt appears to attempt to incrementally comply with  the parking standards by further expanding an existing non‐conforming structure, and present minor  improvements to the Shelburne Road façade without fully embracing the purpose of the Urban Design  Overlay district to have a strong street facing presence.    3. Staff recommends the Board take these overall concerns into their written decision on the project.  Staff  considers an overall finding that the project fails to adhere to the LDR is important for the purpose of  conveying, in the event of appeal, that the removal of the nonconforming fuel pump would not result in  automatic compliance with the LDR.    #SP‐19‐39  3 3.11 NONCONFORMITIES  B(5).  A nonconforming structure shall not have its degree of nonconformance increased  B(6).  A nonconforming use shall not be extended or enlarged, nor shall it be extended to displace a  conforming use, nor shall it be changed to another nonconforming use, nor shall it, if changed to a  conforming use, thereafter be changed back to a nonconforming use.  C.  Alterations to Conforming Structures with Nonconforming Uses.  A conforming structure used by a  nonconforming use shall not be reconstructed, structurally altered, restored or repaired to an extent  exceeding one hundred percent (100%) of the gross floor area of such structure unless the use of such  structure is changed to a conforming use.  D.  Alterations to Nonconforming Structures.  (1)  Except as otherwise provided in sub‐sections (2) and (3) below, and in Article 4, Section 4.08, Queen  City  Park  District,  and  in  Article  12,  Section  12.01(D),  any  nonconforming  structure  may  be  altered,  including additions to the structure, provided such alteration does not exceed in aggregate cost thirty‐five  percent (35%) for residential properties and twenty‐five percent (25%) for industrial and  commercial  property of the current assessed value as determined by the City Assessor and in compliance with Section  3.11(B) above.   (2)  In the event an addition or an expansion to a nonconforming structure is proposed, the addition or  expansion itself must conform with the provisions of these regulations (e.g., dimensional requirements  such as setbacks, coverage, etc.).  The Board previously discussed that the vehicle fueling operations on the property are nonconforming, and  that the fueling canopy is a nonconforming structure.  As clearly conveyed by the Board at previous hearings,  the applicant’s proposal includes expansion of the existing nonconforming use by adding a fuel pump, and the  applicant’s revised proposal submitted on 5/20 now also includes a further expansion of the nonconforming  fuel canopy structure by widening it by 6’‐6”.  Omitting discussion of the additional fuel pump and associated  canopy, Staff considers the widened canopy would be subject to 3.11D above.      4. The present value of the building on this parcel is $80,100, therefore the cost of the expansion would be  limited to $20,025. Further, the applicant has previously testified that no permanent structures may be  located over the fuel tank pads, therefore Staff considers the proposed widening appears to be in conflict  with the applicant’s testimony.  Staff recommends the Board determine whether they have any additional  questions for the applicant on the proposed canopy widening.  10.06 URBAN DESIGN OVERLAY DISTRICT (UDO)  The project is located within the urban design overlay district.  Only new buildings are subject to compliance with  these standards.  Portions of an existing building not being modified may remain as is, provided alterations do  not increase the degree of nonconformity.  (1) Entries. Buildings on subject properties must have at least one entry facing the primary road in the  corridor. Any such entry shall:    (a) Be an operable entrance, as defined in these Regulations.   (b) Serve, architecturally, as a principal entry. Front entries shall be a focal point of the front façade  and shall be an easily recognizable feature of the building. Possibilities include accenting front  entries with features such as awnings, porticos, overhangs, recesses/projections, decorative  front  doors  and  side  lights,  or emphasis  through  varied  color  or  special  materials.  This  requirement does not preclude additional principal entry doors.   #SP‐19‐39  4 (c) Shall have a direct, separate walkway to the primary road. This walkway shall be at least eight  (8) feet in width and may meander for design purposes, but must serve as a pedestrian‐oriented  access.  5. As noted above, Staff considers the addition of eaves incrementally improves the project’s compliance with  this criterion, but the orientation of the building, with the principal glassed entry facing the north and the fuel  pumps, detracts from the project’s ability to meet this criterion.  Staff recommends the Board discuss whether  they have any additional questions for the applicant as it pertains to compliance with urban design overlay  standards.    14.06 GENERAL SITE PLAN REVIEW STANDARDS  B.  Relationship of Proposed Structures to the Site.  (2)   Parking:  Parking location is a complex issue on this property because it both has multiple fronts and multiple  structures.  Staff has again provided all the relevant criteria, and then consolidated the discussion  because the criteria are interrelated.   (a)   Parking shall be located to the rear or sides of buildings. Any side of a building facing a public  street shall be considered a front side of a building for the purposes of this subsection.  (b)   The Development Review Board may approve parking between a public street and one or more  buildings if the Board finds that one or more of the following criteria are met. The Board shall approve  only the minimum necessary to overcome the conditions below.  (i) The parking area is necessary to meet minimum requirements of the Americans with Disabilities  Act;  (ii) N/A;  (iii) The lot has unique site conditions, such as a utility easement or unstable soils, that allow for  parking, but not a building, to be located adjacent to the public street;    (iv)  The lot contains one or more existing buildings that are to be re‐used and parking needs cannot  be accommodated to the rear and sides of the existing building(s);   These exceptions do not require the Board to allow parking to the front; rather it allows the Board  to consider the location of the parking and the building relative to one another, and if necessary  parking cannot be accommodated to the side or rear due to site conditions, allows parking to be  located to the front.  (c)   Where more than one building exists or is proposed on a lot, the total width of all parking areas  located to the side of building(s) at the building line shall not exceed one half of the width of all  building(s) located at the building line. Parking approved pursuant to 14.06(B)(2)(b) shall be exempt  from this subsection.  13.01C(5):  All parking areas adjacent to a public street shall be screened from the street by fencing,  walls, or vegetation measuring at least three (3) feet in height.  The property has two fronts – that which faces VT Rte 7 and that which faces Queen City Park Road.   The applicant has requested the Development Review Board consider the fueling canopy a building  for the purposes of this standard.  At the previous hearing, the Board indicated that in order to do  so, the applicant would have to structure the canopy so it provided screening for the parking located  #SP‐19‐39  5 behind it.  The applicant has added three “movable planters (by owner)” within the Shelburne Road  right‐of‐way, and added one planter between each pair of existing fuel pumps, for a total of five  planters.    6. Staff recommends the Board ask the applicant to provide an image of what these planters could look  like, either an inspiration photo or a drawing, and also that the Board ask the applicant whether they  have received preliminary approval from VTrans for the proposed planters in the state right‐of‐way.  Assuming the widened canopy does not move forward, or even if it does, assuming the widened  portion does not provide screening for the parking spaces, the applicant is now proposing six parking  spaces to the front of the building along the Queen City Road front where they were previously  proposing five.  Of those, two were previously proposed to be directly along Queen City Park Road  and three were proposed to be along the western line.  Now the applicant is proposing five directly  along Queen City Park Road.    7. Staff recommends the Board discuss whether they consider the change along Queen City Park Road  to be an improvement over the previous configuration in which three parking spaces were fully visible  from Shelburne Road and partially screened from Queen City Park road.  14.06B(2)(c) above limits the width of parking areas to the sides of buildings when there is more than  one building on a lot to no more than 50% of the width of the building.  Along Shelburne Road, the  total width of the retail and restaurant building and the fuel canopy at the building line is 99‐feet (or  105.5 ft if the canopy is widened).  Therefore the total width of parking spaces at the side of buildings  along Shelburne Road is limited to 49.5 (or 52.75) feet.  The applicant is proposing 55‐feet of parking  area width, excluding the ADA space.  If the canopy is widened, the width of parking is reduced to  48.5 ft.  These values are based on the applicant’s “Shelburne Road Gulf Dimension Sketch,” dated  4/22/2020.    8. If the Board and applicant conclude the canopy widening is in fact feasible under 3.11D and under  the operational constraints of a fueling station, Staff considers the Board must also find the entire  width of the fueling canopy contributes to screening.  If the Board finds the canopy widening to be an  infeasible proposal, Staff considers the Board must find 14.06B(2)(c) not met.  Staff recommends the  Board discuss whether they need any additional information to conclude their review of this criteria.    13.06C Screening or Buffering  (1)   All off‐street parking areas, off‐street loading areas, outdoor storage areas, refuse, recycling, and  compost collection (excluding on‐site composting) areas, and utility improvements such as transformer(s),  external heating and cooling equipment shall be effectively screened.  a. Such  screening  shall  be  a  permanently  maintained  landscape  of  evergreen  or  a  mix  of  evergreen and deciduous trees and shrubs, and/or a solid fence.  b. The landscaping shall be designed to minimize erosion and stormwater runoff, and to protect  neighboring residential properties from the view of uses and parking areas on the site. The  landscaping shall be of such type, height, and spacing, as in the judgment of the Development  Review Board, will effectively screen the activities on the lot from the view of persons standing  on adjoining properties. The plan and specifications for such planting shall be filed with the  approved plan for the use of the lot.  (4)   A solid wall or fence, of location, height, and design approved by the Development Review Board,  may be substituted for the required planting.  #SP‐19‐39  6 (5)  Modifications. Where the existing topography and/or landscaping provides adequate screening or  would render the normally required screening inadequate, the Development Review Board may modify the  planting and/or buffer requirements by, respectively, decreasing or increasing the requirements.  9. With the proposed revised parking lot configuration, the dumpster enclosure is now in direct line of sight  from Shelburne Road.  The applicant has proposed chain link fence with green slats as a dumpster  enclosure.    Though  this  configuration  is  generally  acceptable  as  a  back‐of‐house  measure,  Staff  recommend the Board discuss whether a solid fence, complimentary with the architecture of the site,  should be provided given the highly visible nature of the currently proposed location.    12.03 Stormwater Management Standards  10. At the previous hearing the applicant provided responses to outstanding questions of the City Stormwater  Section pertaining to 25‐year storm flows and to seasonal high groundwater.  The Stormwater Section  indicated on 5/1 the responses were generally acceptable but Staff is awaiting final comments based on  the revised plans.  Staff anticipates they will have an update for the Board at the hearing.     Standards for Roadways, Parking and Circulation. Standards of Section 15.12 Standards for Roadways,  Parking, and Circulation shall be met.  The Fire Chief has provided comments indicating a fire truck would access the site from the north either by pulling in  or setting up in Shelburne Road, and from the north by pulling into the south driveway.    The applicant has provided  a fire truck turning movement plan, which shows that the fire truck is expected to back onto VT Route 7 when  providing service to the site.  Staff advised the applicant that they should send alternative fire truck movements to  the Fire Chief for his review.  On 5/18/2020, the applicant sent the same fire truck turning movement to the Fire  Chief.  To Staff’s knowledge, no additional progress has been made on compliance with this criterion.    11. Staff recommends the Board provide the applicant with an opportunity to provide additional correspondence  with the Fire Chief that either occurred after publication of this document or that Staff was not included on,  and then recommends the Board discuss whether they have any further questions for the applicant as it  pertains to emergency access.    OTHER  Water Supply  Champlain Water District provided comments on both the relocation of the transmission main and the service  for the proposed project, and provided testimony at the March 4 hearing.  On April 13, CWD requested the  hearing be continued for the purpose of addressing the comments of CWD.  In a letter dated May 20, 2020, CWD  concluded that the waterline relocation should include the installation of boltless restrained joints through the  project area and through the existing sleeve under Shelburne Road.  They also request the following conditions,  in addition to those provided by email to staff on November 20, 2019, be included in the decision by the Board.   A new 24” butterfly valve shall be installed on the east side of Shelburne Road on Lindenwood Drive.  The  existing 24” valve on Lindenwood Drive, ~50’ off from Shelburne Road, shall be removed as part of this  project.  #SP‐19‐39  7  The following appurtenances shall be provided with the new 24” boltless restrained joint pipe through  the existing sleeve under Shelburne Road:  stainless steel casing spaces, rubber casing seal, and stainless  steel band.  .   RECOMMENDATION  Staff recommends that the Board strive to conclude their review, and continue the hearing for the narrow purposes  of conducting deliberations and asking questions which may arise during deliberative session prior to issuing a  decision.    Respectfully submitted,    Marla Keene, Development Review Planner    JON T. Vallee, Inc. (“Vallee”) to assist in responding to the five remaining requests from the Development Review Board (“DRB”). Attached are the following: Request 1. Proposed Façade Redesign. The proposed elevations have been revised to incorporate additional design features to make the eastern entrances more pronounced. See attached rendering. Request 2. Plans Showing Screening for Parking. Although Vallee disagrees with your building/parking width calculation, Vallee is prepared to ask the DRB to waive an additional 39- inch-wide section of parking north of the extended northerly dimension of the canopy or, in the alternative, Vallee proposes to widen the canopy behind the front setback line by 39 inches on the north and south sides. The area of this addition is shown on the attached plans. Additional landscaping both east of the canopy and east of the south parking spaces is also being proposed to further screen the parking. Request 3. Champlain Water District (“CWD”) Line. R.L. Vallee has directed CEA to coordinate with CWD the replacement of the line in the sleeve. CEA has reviewed this with Nate Pion, on behalf of CWD, and will be providing updated plans to CWD for the line relocation and replacement in the sleeve. This is the preferred option by CWD. In response to DRB Request 4 concerning stormwater, since the DRB meeting additional correspondence and plans were provided by Watershed Consulting to the City for review. With regard to Request 5 concerning fire truck circulation, attached is Sheet C1.3a which includes additional truck turning movements (WB-40 per city direction). CEA will reach out to the fire chief and copy you for further review and discussions of the movements. CWD concurs with the approach outlined within the aforementioned documents, in concluding that the best approach for the waterline relocation is to install boltless restrained joints through the proposed R.L. Vallee Associates project area; and furthermore, through the existing sleeve under Shelburne Road. However, CWD has the following comments that will need to be incorporated into the recommended project: 1. A new 24” butterfly valve shall be installed on the east side of Shelburne Road on Lindenwood Drive. The existing 24” valve on Lindenwood Drive, ~50’ off from Shelburne Road, shall be removed as part of this project. 2. The following appurtenances shall be provided with the new 24” boltless restrained joint pipe through the existing sleeve under Shelburne Road: stainless steel casing spacers, rubber casing seal, and stainless steel band. These comments, along with those outlined in the letter to Marla Keene dated November 20, 2019, shall be resolved during the final design. We acknowledge that the above referenced plans show the concept of what is being proposed with the understanding that final design plans and associated State permitting will occur at a later date. Vallee Associates) Shelburne Road Water Main Crossing This memorandum describes and evaluates two alternative treatments for the existing sleeved 24-inch diameter water main crossing of Shelburne Road (US Route 7) as part of the proposed R.L. Vallee Associates project at 793 and 903 Shelburne Road in South Burlington, Vermont. The existing 24-inch diameter water transmission main crosses the subject property before passing under Shelburne Road in a 71-foot long, 36-inch diameter sleeve. To allow for the proposed development on the subject property, the 24-inch transmission main will be relocated as a 30-inch transmission main along the southern edge of the parcel. It is recommended that the relocated 30-inch transmission main be constructed with boltless restrained joints (TR Flex or equal) to avoid the requirement for very large concrete thrust blocks at unrestrained bends (both horizontal and vertical), valves, and other fittings. Large concrete thrust blocks or more moderately sized in-line thrust collars will still be required at the two transitions between the new restrained-joint and existing unrestrained-joint pipe. At question is whether or not it is advantageous to extend the new restrained-joint pipe through the existing sleeve to the opposite side of Shelburne Road, where a more advantageous location for a thrust collar may exist. Both of these alternatives are described below, with more detailed construction cost estimates attached to this memorandum. Alternative No. 1 – Leave Existing 24-inch Carrier Pipe As-Is Under this alternative, the new 30-inch diameter water main would be connected to Page 2 of 3 the existing 24-inch diameter water main just west of the end of the sleeve under Shelburne Road using two 30-inch diameter 45-degree bends and a 30- by 24-inch diameter reducer that would be restrained on the 30-inch side and unrestrained on the 24-inch side. Two large concrete thrust blocks would be required for the two 45-degree bends. The estimated cost of these thrust blocks is approximately $32,000. In addition to the cost of these large subsurface concrete structures, they will occupy an estimated 20-foot by 20-foot area in front of the proposed dining/retail building; this area would need to be located at least 20 feet away from the end of the sleeve to allow for future access to the carrier pipe.  Alternative No. 2 – Replace Existing 24-inch Carrier Pipe Under this alternative, the existing 24-inch diameter ductile iron carrier pipe would be removed from the existing 36-inch diameter sleeve, and a new 24-inch diameter ductile iron carrier pipe would be inserted. The new carrier pipe would use boltless restraints, thereby eliminating the need for thrust blocking on the west side of Shelburne Road. A thrust collar would be required on the east side of Shelburne Road, where the new restrained-joint ductile iron pipe connects to the existing water main. The estimated cost of removing the existing carrier pipe, installing the new carrier pipe, and installing a new thrust collar is approximately $59,000. While there is a substantial reduction in the amount of concrete required, there is substantial additional labor, equipment, and materials required to remove the existing 24-inch carrier pipe and install the new 24-inch carrier pipe in the sleeve. Additionally, there is a water distribution main and gas line located near the east end of the 36-inch sleeve. These two utilities (as well as any other utilities located near the ends of the sleeves) may require relocation or temporary support, since relatively unhindered access to both ends of the sleeve will be necessary to implement this alternative. While this alternative is more expensive, it has the benefit of occupying significantly less space on the subject parcel. Conversely, there is significantly more potential for constructability problems, since many sleeving practices in common use when the waterline was installed (such as using unrestrained pipe and filling annular spaces with stone or sand) could make removal of the existing carrier pipe difficult and expensive, and the existing sleeve must be in adequate condition for re-use.
