MISCELLANEOUS APPLICATION #MS‐20‐03
FINDINGS OF FACT AND DECISION
Miscellaneous application #MS‐20‐03 of South Village Communities, LLC for alteration of
existing grade on an existing 5.6 acre lot developed with an existing recreation path and
stormwater management features. The alteration of grade is associated with construction on
adjacent lots, 1840 Spear Street.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT & CONCLUSIONS OF LAW
1. The applicant, South Village Communities, LLC, seeks miscellaneous approval to alter the
existing grade on an existing 5.6 acre lot developed with an existing recreation path and
stormwater management features. The alteration of grade is associated with construction
on adjacent lots, 1840 Spear Street.
2. The owner of record of the subject property is South Village Communities LLC.
3. The application was received on April 21, 2020.
4. The subject property is located in the Southeast Quadrant – Natural Resource Protection
and Neighborhood Residential zoning sub‐districts.
5. The Master Plan application (#MP‐05‐02) for this project was approved by the Board on
February 10, 2006 and last amended (#MP‐14‐01) on May 23, 2014. #MP‐14‐01 represents
a very slight amendment to the approved review process. #MP‐05‐02 includes the bulk of
the conditions applicable to the development. The Phase 2 plan application (#SD‐13‐44) for
this project was approved by the Board on March 10, 2014, and the Phase 3 final plat
application (#SD‐17‐18) on February 22, 2018.
6. The plans submitted consist of a fourteen (14) page set of plans, page C1.0 entitled, “South
Village Communities, LLC Existing Conditions Site Plan”, prepared by Civil Engineering
Associates, Inc., dated 3/16/2020.
7. Only the standards below are affected by this application. All other standards will continue
to be met:
Section 3.12, Alteration of Existing Grade
A. Permit required
DRB approval is needed for the placing or removing of fill on land when the amount is equal
to or greater than 20 cubic yards except when incidental to or in connection with the
construction of a structure on the same lot. Based on the provided plans, the applicant is
proposing grading to construct buildings on the adjacent lots 4A and 4B. Quantity estimates

are not available at this time but based on submitted plans, it appears that greater than 20
cubic yards of material will be placed. Provided site plans show the existing grade and the
proposed grade created by removal or addition of material. The Board finds this criterion to
be met.
B. Standards and Conditions for Approval.
(1) The Development Review Board shall review a request under this Section for
compliance with the standards contained in this sub‐Section 3.12(B). and Section 3.07,
Height of Structures of these regulations. An application under Section 3.12(A) above shall
include the submittal of a site plan, planned unit development or subdivision plat
application showing the area to be filled or removed, and the existing grade and proposed
grade created by removal or addition of material.
A discussion of heights of the structures necessitating this fill are included in the findings for
SP‐20‐020 and SP‐20‐021. No structures are proposed on this lot. The Board finds this
criterion met.
(2) The Development Review Board, in granting approval may impose any conditions it
deems necessary, including, but not limited to, the following:
(a) Duration or phasing of the permit for any length of time.
The applicant has estimated this work will be complete in June 2021. The Board finds
this timeline acceptable, and allows extension of such timeline in accordance with the
procedures in 17.04 of the LDR.
(b) Submission of an acceptable plan for the rehabilitation of the site at the conclusion
of the operations, including grading, seeding and planting, fencing, drainage, and
other appropriate measures.
An erosion prevention and sediment control plan has been included. The Board finds
this plan meets this criterion.
(c) Provision of a suitable bond or other security in accordance with Section 15.15
adequate to assure compliance with the provisions of these Regulations.
The applicant estimates the cost of these improvements to be $2,500. The Board finds
no bond is needed.
(d) Determination of what shall constitute pre‐construction grade under Section 3.07,
Height of Structures
The Board finds the grade which existed prior to this approval shall continue to
constitute preconstruction grade for the purposes of calculating heights of buildings on
the adjacent lots 4A and 4B.
DECISION
Based on the above Findings of Fact, the Board herby approves Miscellaneous application #MS‐
20‐03 of South Village Communities LLC, subject to the following conditions.
1. All previous approvals and stipulations which are not changed by this decision, will
remain in full effect.

2. This project must be completed as shown on the plans submitted by the applicant, and
on file in the South Burlington Department of Planning and Zoning.
3. Any change to the plan will require approval by the South Burlington Development
Review Board or Administrative Officer.
4. The applicant must obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
