MEMORANDUM
TO: South Burlington City Council

RE: Settlement of Claims for Kevin Beaupre v. Jack O’Conner and Edward Soycheck Docket
No. 2:14-cv-00256.
Background
Kevin Beaupre, pro se, filed a lawsuit a number of years ago regarding allegations that
the South Burlington Police Department sold impounded evidence without his consent. On the
City’s behalf, VLTC-PACIF hired Kaveh Shahi, Esq. who filed various dispositive motions until
this went to pre-trial mediation in late February. During mediation, the parties finalized a
settlement agreement that will be provided in your materials confidentially for your
consideration. The costs of litigation above our deductible amount and the consideration
referenced in the settlement agreement have all been covered through our insurer.
Recommendation
VLCT-PACIF and I recommend the City Council accept this settlement agreement for
the sole purpose of avoiding further costs of litigation. If any questions arise during your review,
feel free to contact me any time prior to the regular meeting.
