HomeMy WebLinkAboutCU-97-0000 - Decision - 0005 Bartlett Bay RoadSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT C bl — �/7, r Aq��' On the 13th Day of January 1997, the South Burlington Zoning Board of Adjustment heard testimony regarding a conditional use application of Alan Newman & Pomerleau Real Estate, 5 Bartlett Bay Road, this meeting was also attended by Brian Waxler, David Marshall. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findinas of Fact 1) The area is zoned C-2 District. 2) The proposed use is conditional under Section 13.205 and 13.218 of the zoning by-laws. 3) The proposed use light manufacturing, wholesale/ retail establishment will occupy the former Grossman building (37,027 square feet) - 4) The parcel is part of a Planned Unit Development of three buildings to include Jiffy Lube and Audio Video Authority. 5) Planning Commission granted P.U.D. approval on December 18, 1996. 6) Grossman's lot contains 4.6 acres with 407 feet of Bartlett Bay Road frontage. Conclusion 1) Planning Commission approved a sewer allocation of 21,500 g. p. d. with 143,520 available at this time. Remaining 6,980 gpd will be placed on a waiting list. Production is not expected to increase for 5 years at which time remaining allocation should be available. 2) Traffic impacts should decrease from prior use. V. T. E. projected 103 peak hour trips for Grossman's and 24 trips for the proposed use. 3) Without any additions applicant projects a rate of growth of four times that of it's present facility, maximum production of 100,000 barrels. 4) Hours of operation 6: 00 A. M. to 6: 00 P. M. . At full capacity two shifts covering 18 hour days. 5) Retail sales (900 square feet) operate from 10:00 A.M. to 6:00 P.M. k 6) Heavy truck traffic estimated at three (3) per week. 7) No neighborhood concerns, meetings held with 60 plus neighbors from Bartlett Bay Road (neighbors toured the Flynn Avenue location). Based upon the findings and conclusion set -forth above, the Zoning Board of Adjustment hereby grants the applicants request to operate a brewery (wholesale/ retail sales) at therfQrmer Grossman's building, 5 Bartlett Bay Road.
