Re: Findings of Fact, application of Pomerleau Real Estate to amend a plat for a previously approved
planned unit development consisting of three (3) buildings on a 6.73 acre parcel, Shelburne Road and
Bartlett Bay Road. The amendment consists of subdividing the 6.73 acre parcel into two (2) lots of
4.73 acres (lot #1) and 2.0 acres (lot#2).
On the I' day of September, 1998, the South Burlington Planning Commission approved the request
of Pomerleau Real Estate for revised final plat approval under Section 204 of the South Burlington
Subdivision Regulations based on the following findings:
1) This project consists of amending a plat for a previously approved planned unit development
consisting of three (3) buildings on a 6.73 acre parcel. The amendment consists of subdividing the
6.73 acre parcel into two (2) lots of 4.73 acres (lot #1) and 2.0 acres (lot #2). Lot #1 is developed
with a light manufacturing building (Magic Hat brewery) and lot #2 is developed with two (2) mixed
use buildings (Jiffy Lube and Audio/Video Authority). The sketch plan was reviewed on 5/26/98.
2) Access: Access to lot #1 is by a 36 foot curb cut on Bartlett Bay Road. Access to #2 is by a 45
foot curb cut on Bartlett Bay Road and a 30 foot ingress only curb cut on Shelburne Road. No
changes proposed.
3) Lot size/frontage: The minimum lot size requirement of 40,000 square feet will be met by both
lots.
The minimum frontage requirement of 200 feet along Shelburne Road and 120 feet along Bartlett Bay
Road will be met.
4) Coverage/setbacks: Lot #2: Building coverage is 20.8% (maximum allowed is 30%). Overall
coverage is 64.2% (maximum allowed is 70%). Front yard coverage along Shelburne Road is 57.8%
and along Bartlett Bay Road is 46.9% (maximum allowed is 30%). These are existing coverages
which will not be made worse by this application.
5) Lot #1: Building coverage is 21.6% (maximum allowed is 30%). Overall coverage is 58.9%
(maximum allowed is 70%). Front yard coverage is 46.4% (maximum allowed is 30%). This is an
existing situation which will not be made worse by this application.
Setback requirements will be met from the new property line.
6) Parking: The parking requirement for each use will be satisfied on its respective lot.
7) Legal document: Staff recommended that prior to recording the final plat plan a legal document
be recorded which states that this entire development is a PUD and that for zoning and subdivision
purposes both lots are to be treated as one (1) lot (e.g., coverage calculation).
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission approves the final
plat application of Pomerleau Real Estate to amend a plat for a previously approved planned unit
development consisting of three (3) buildings on a 6.73 acre parcel, Shelburne Road and Bartlett Bay
Road. The amendment consists of subdividing the 6.73 acre parcel into two (2) lots of 4.73 acres
(lot #1) and 2.0 acres (lot #2), as depicted on a two (2) page set of plans, page one (1) entitled,
"Boundary Plan Pomerleau Real Estate Shelburne Road South Burlington, Vermont," prepared by
Pinkharn Engineering Associates, Inc., dated 11/12/86, last revised on 6/24/98, with the following
stipulations:
1) All previous approvals and stipulations which are not superseded by this approval shall remain in
effect.
2) Prior to recording the final plat plan, the applicant shall record a legal document approved by the
City Attorney which states that this entire development is a PUD and that for zoning and subdivision
purposes both lots are to be treated as one (1) lot (e.g., coverage requirements).
3) Any change to the final plat plan shall require approval by the South Burlington Planning
Commission.
4) The final plat plan shall be recorded in the land records within 90 days or this approval is null and
void. The plan shall be signed by the Planning Commission Chair or Clerk prior to recording. Prior
to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format.
The format of the digital information shall require approval of the City Planner.
