HomeMy WebLinkAboutSD-99-21 - Decision - 0005 Bartlett Bay Road#SD-99-21 FINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Findings of Fact, application of Full Moon Farm - David Zuckerman to amend a planned unit development consisting of three (3) buildings on two (2) parcels totaling 6.73 acres, 5 Bartlett Bay Road. The amendment consists of operating a seasonal retail farm market limited in number to 125 members in the Magic Hat facility parking lot. On the 27`h day of April, 1999, the South Burlington Planning Commission approved the request of Full Moon Farm - David Zuckerman for revised final plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of amending a planned unit development consisting of three (3) buildings on two (2) parcels totaling 6.73 acres. The amendment consists of operating a seasonal farm market limited in number to 125 members in the Magic Hat parking lot, 5 Bartlett Bay Road. This use would operate on Tuesdays and Fridays between 3:30 P.M. and 7:00 P.M. from early/mid June until mid -October. 2. The owner of record of this particular property is Antonio B. Pomerleau. 3. Access: Access to this lot is provided by a 36 foot curb cut on Bartlett Bay Road. No change 2. proposed. 4. Parking: Parking requirements for retail are based on retail floor area. Since this use will not operate out of a building there is technically no additional spaces required. The applicant is proposing to add 10 spaces for the exclusive use of the vegetable sales. Staff feels this is adequate. 5. Traffic: The applicant estimates that his use will generate 60 P.M. peak hour trip ends for each of the two (2) days per week he operates. These trip ends spread out over an entire year would average 8.3 trip ends during the P.M. peak hour. The applicant was made aware that the road impact fee is zero (0). DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the final plat application of Full Moon Farm - David Zuckerman to amend a planned unit development consisting of three (3) buildings on two (2) parcels totaling 6.73 acres, 5 Bartlett Bay Road. The amendment consists of operating a seasonal farm market limited in number to 125 members in the I Magic Hat facility parking lot, as depicted on a two (2) page set of plans, page one (1) entitled, "Magic Hat Brewing Company Proposed Organic Sales Parking Site Plan," dated February, 1999, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the additional use will generate 8.3 additional vehicle trip ends during the P.M. peak hour. 3) Any change to the final plat plans shall require approval by the South Burlington Planning Commission. 4) The final plat plan (overall site plan) shall be recorded in the land records within 90 days or this approval is null and void.
