HomeMy WebLinkAboutSP-19-50 - Supplemental - 1068 Williston Road (56) Memorandum of Understanding between Champlain School Apartments Partnership, LLC (“Applicant”) and City of South Burlington, Vermont (“City”) In re: Hampton Inn/ Holiday Inn, 1068 Williston Road ----------------------------- Purpose & Background The following is an outline of key terms to be later formalized into a definitive agreement to obtain compliance with the requirements of the City's Land Development Regulations (“LDR”) as they relate to traffic for Site Plan application #SP-19-50 50 of Champlain School Apartments Partnership, 1068 Williston Road. Through Site Plan application #SP-19-50, the Applicant proposes to construct a 101 -room hotel, renovate an existing hotel, construct related site improvements, and construct approximately 250 feet of a future public street at 1068 Williston Road (the “Project”). Relevant sections of the LDR addressed under this outline include: Section 15.12(F)(1) Standards for Roadways, Parking and Circulation: Entrances Section 10.02(G) Traffic Overlay District The mitigation initiatives documented in this outline are for the purpose of reducing traffic impacts of the proposed project in order to allow the Administrative Officer to grant traffic generation credits as required by the traffic overlay district and traffic standards in the LDR. A number of these initiatives are identified in the November 2017 Williston Road Network Study (Phase II), which include specific recommendations for roadway enhancements in the vicinity of Williston Road and Dorset Street. Improvements include: General traffic mitigation elements to be completed by the City: Re-assignment of travel and turn lanes along Williston Road (westbound) Upgrade of pedestrian crossing signals and markings Establish the preferred westbound travel lanes and streetscape for Williston Road Obligations of the Applicant: Prepare required documentation for review authorities (City of South Burlington, State of Vermont, and Federal Highway Administration) as necessary for removal of the existing Project driveway and construction of the Future City Street. Complete the following transportation demand management elements upon occupancy of the completed project for each building: Post bus schedules in employee spaces (near time clocks and required postings) Maintain copies of local bus schedules at front desks for guests Provide information on the Applicant’s websites regarding getting to the site without a personal automobile Provide shuttle service to local destinations (may be shared between the two hotels) Host Bikeshare Stations Provide employees showers and changing facilities in both hotels Explore membership in the Campus Area Transportation Management Association in coordination with staff of the City’s Department of Planning & Zoning Construct a new roadway to public road standards, including all curbing, sidewalk and streetscape elements, a paved road surface varying from 22 to 44 feet in width for a length of approximately 250 feet, designed as a Support Street as defined in the Land Development Regulations, and shown as “Proposed Future City Street” on plan sheets C2.01 Proposed Site Plan, and L2.00 Landscape Layout and Materials, both by VHB, dated January 17, 2020. Provide Irrevocable offer of dedication and any other legal documents as necessary for public segment(s) of the new roadway. Provide stormwater treatment for the Future City Street in accordance with the stormwater permitting requirements of the Vermont Department of Environmental Conservation Stormwater Program and the City’s Land Development Regulations. Agree to not impede construction of the improvements depicted on plan sheet TS1.01 Intersection and Signal Plan by VHB , dated August 2, 2019, and described in the Traffic Impact Study by VHB dated October 1, 2019 (“Intersection Improvements”) . Agree to donate required rights-of-way and/or easements as deemed necessary by reviewing regulatory agencies for the City to construct the Intersection Improvements. Pay the City for the estimated costs of the Intersection Improvements (see Appendix A for project estimate) and for preparation of required documentation & engineering design for Intersection Improvements as defined under “Obligations of the City” below. Obligations of the City Prepare required documentation for review authorities (City of South Burlington, State of Vermont, and Federal Highway Administration) as necessary for implementation of the “Intersection Improvements.” Prepare final engineering design for the Intersection Improvements. Work in good faith to obtain all necessary permits for the Intersection Improvements. Construct the Intersection improvements within two years of issuance of all necessary State & Federal Approvals. Consider the Obligations of the Applicant contained in this Memorandum of Understanding to meet all requirements for traffic mitigation required by the Applicant's submissions for site plan approvals for the property, up to a total of 274 on site rooms (or equivalent traffic generating uses). Provide applicant with a credit against Highway Impact Fees incurred for intersection improvements and the new roadway segment, up the amounts permitted in the Impact Fee Ordinance. Prior to issuance of a zoning permit, Applicant shall provide: Financial surety for the Intersection improvements for an amount mutually agreed upon between the City and the Applicant. All necessary legal documents required under the Obligations of the Applicant. Execution of a definitive agreement between the City and Applicant formalizing the key elements of this Memorandum of Understanding. Accounting of trips: Traffic budget for subject property is current 55 PM peak hour trips, per the current LDRs. LDR Section 10.02.H.1 allows for additional trips where improvements are made to improve traffic flow to and from the property and at adjacent intersections Proposed improvements would result in the following: A total intersection capacity increase of 144 vehicle trips which is higher than the anticipated site trip generation after redevelopment. The improvements were tested with an additional 58 rooms beyond the proposed total of 216, for a total of 274 rooms on the site and found to continue to operate at LOS D or better (in the event that the Holiday Inn does not reduce its room count upon renovation or additional rooms are considered on site). Applicability of agreement: This Memorandum of Understanding is made effective by issuance of Site Plan Approval #SP-19-50 and shall be incorporated therein by reference.
