FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Final plat application #SD-02-09 of VAOT to amend a planned unit development
consisting of three (3) commercial and industrial buildings on two (2) parcels totaling
6.73 acres. The amendment consists of modifying the landscape plan for the existing
temporary transportation service building (train station) on the adjacent State-owned
property to the west, 5 Bartlett Bay Road.
On the 5 h of March 2002, the South Burlington Development Review Board approved
the request of VAOT seeking final plat approval under Section 204 of the South
Burlington Subdivision Regulations based on the following findings:
1) This property at 5 Bartlett Bay Road lies within the Commercial 2 District. It is
bounded on the north by Goss Dodge, on the east by Town and Country Furniture,
Audio/ Video Authority and Jiffy Lube, on the south by Shearer Chevrolet, and
on the west by railroad tracks. The project site is on the Magic Hat Brewery and
VAOT property.
2) The owner of record is the Pomerleau Foundation.
3) The only issue effected by this application is landscaping.
4) Landscaping_ The landscape plan exhibits a landscape expenditure of $2,275.
Required is $2,250. The plantings include juniper, red twig dogwood, American
viburnum and sumac. Staff requested that the landscape plan be revised to list the
correct scientific name for American vibumum.
DECISION AND CONDITIONS
Based on the above Findings of Fac,t the South Burlington Development Review Board
approves final plat application #SD-02-09 of Vermont Agency of Transportation to
amend a planned unit development consisting of three (3) commercial and industrial
buildings on two (2) parcels totaling 6.73 acres. The amendment consists of modifying
the landscape plan for the existing temporary transportation service building (train
station) on the adjacent State-owned property to the west, as depicted on a three (3) page
set of plans, page two (2) entitled "South Burlington Temporary Station at Pomerleau
Planned Unit Development Final Plat Review", prepared by Systra Consulting, Inc., with
a revised date of 11/04/01, with the following stipulations:
1) All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2) The final plat plan shall be revised prior to issuance of a zoning permit to show the
changes listed below and shall require approval by the Director of Planning and
Zoning (hereinafter Director). Three copies of the revised plat plan shall be
submitted to the Director prior to recording.
a) The plat plan shall be revised to show the correct scientific name of American
viburnum.
3) Any change to the final plat plan shall require approval by the South Burlington
Development Review Board.
4) The final plat plan shall be recorded in the land records within 90 days or this approval
is null and void. The plan shall be signed by the Board Chair or Clerk prior to
recording.

24 V S.A. § 4471 and V.RC.P. 76, in writing, within 30 days of the date this decision is issued. The fee is
$150.00. If you fail to appeal this decision, your right to challenge this decision at some future time may be
lost because you waited too long. You will be bound by the decision, pursuant to 24 V.S.A. § 4472(d)
(exclusivity of remedy; finality).
