Re: Findings of Fact, final plat application #5D-02-82 of Magic Hat Brewing Company to
amend a planned unit development consisting of three (3) buildings on two (2) parcels
totaling 6.73 acres. The amendment consists of adding a 25' x 8' x 8.5' tank, 5
Bartlett Bay Road.
On the 41" day of February 2003, the 5outh Burlington Development Review Board
approved the request of Magic Hat Brewing Company for final plat approval under
Section 204 of the 5outh Burlington Subdivision Regulations, based on the following
findings:
1. This project consists of amending a planned unit development consisting of three
(3) buildings on two (2) parcels totaling 6.73 acres. Lot #1 is developed with a
light manufacturing building (Magic Hat Brewery) and lot #2 is developed with
two (2) mixed use buildings (Jiffy Lube and the vacant Audio/Video Authority).
The amendment consists of adding a 25' x 8' x 8.5' outdoor tank to Lot #1. The
sketch plan was reviewed at the 9/17/02 meeting.
2. The owner of record of this property is Antonio B. & Rita M. I'omerleau
Foundation.
3. This property at 5 Bartlett Bay Road is located within the Commercial 2 District.
The property is bounded on the north by Goss Dodge, on the south by Bartlett
Bay Road, on the west by the railroad tracks, and on the east by 5helburne Road.
4. The only issues affecting this application are coverage and setbacks.
5. CcverWl5etb�o: Entire FUD: Building coverage is 19% (maximum allowed is
30%). Overall coverage is 60.3% (maximum allowed is 70%). Front yard coverage
along Bartlett Bay Road is 32% and along 5helburne Road is 52% (maximum
allowed is 30%). Front yard coverages are existing and will not be made worse
with this application.
6. The proposed tank meets the setback requirements.

Based on the above Findings of Fact, the South Burlington Development Review Board
approves final plat application #5D-02-50 of Magic Hat Brewing Co. to amend a planned
unit development consisting of three (5) buildings on two (2) parcels totaling 6.73
acres. Lot #1 is developed with a light manufacturing building (Magic Hat Brewery) and
lot #2 is developed with two (2) mixed use buildings (Jiffy Lube and the vacant
AudiolVideo Authority). The amendment consists of adding a 25' x 8' x 8.5' outdoor
tank to Lot #1, as depicted on a plan entitled "5ite flan Modifications Bartlett Bay
Road South Burlington Vermont", prepared by Civil Engineering Associates, Inc., dated
December 2002, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. Any change to the final plat plan shall require approval by the 5outh Burlington
Development Review Board.
3. The final plat plan shall be recorded in the land records within 90 days or this
approval is null and void. The plan shall be signed by the Board Chair or Clerk prior
to recording.

Court, pursuant to 24 V5A 4471 and VRCf 76 in writing, within 30 days of the date this
decision is issued. The fee is $150.00. If you fail to appeal this decision, your right to
challenge this decision at some future time may be lost because you waited too long.
You will be bound by the decision, pursuant to 24 V5A 4472 (d) (exclusivity of remedy,
finality).
