FINAL PLAT #SD-03-45
FINDINGS of FACT AND DECISION
Magic Hat Brewing Company, hereafter referred to as the applicant, is requesting final
plat approval of a Planned Unit Development amendment consisting of the addition of
16' x 32' concrete pad and two (2) 10' x' 30' grain storage silos at 5 Bartlett Bay Road.
The subject property contains approximately 6.8 acres and is located in the Commercial 2
(C2) District. The South Burlington Development Review Board (DRB) held a public
hearing on July 29, 2003. Bill Russ represented the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the DRB finds,
concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is requesting final plat approval of a Planned Unit Development
amendment consisting of the addition of 16' x 32' concrete pad and two (2) 10' x' 30'
grain storage silos at 5 Bartlett Bay Road
2. The owner of record is the Pomerleau Foundation.
3. The subject property contains approximately 6.8 acres and is located in the
Commercial 2 (C2) District.
4. The plans consist of one (1) sheet entitled "Overall P.U.D. Plan", prepared by Civil
Engineering Associates, dated May, 2003.
Access/Circulation: Pedestrian and vehicular access to the site will remain unchanged.
Traffic circulation will also remain unchanged.
Coverage/Setbacks: The existing building coverage for the entire PUD is l 8.6% and for
the Magic Hat lot is 15.9% (maximum allowed is 30%). The overall coverage for the
PUD is currently 60.3% and for the Magic Hat lot is 54.2% (maximum allowed is 70%).
The proposal will increase the building coverage by 512 square feet, bringing the total
building coverage to 18.8%. The overall coverage of the PUD will remain unchanged.
Front yard coverage along Bartlett Bay Road is 31.9% and along Shelburne Road is
51.9% (maximum allowed is 30%). Front yard coverages will not change through this
proposal. The proposed structures meet the setback requirements.
Parking: The PUD currently provides 65 parking spaces, which meets all parking
requirements. Parking on this site will remain unchanged through this proposal.
Landscaping: There are no additional landscaping requirements resulting from this
proposal.
Wetlands: The proposed additions will not encroach into any wetlands or wetland buffer
areas.
Lighting: No additional lighting is proposed.
Dumpster: The dumpster requirements are not relevant to this proposal
Traffic: There are no changes in the average daily traffic, A.M. peak hour traffic, or
P.M. peak hour traffic, resulting from this proposal.
Other: The proposed structures will be 30' tall, which meets the "maximum height"
regulations described in Section 3.07 of the South Burlington Land Development
Regulations. The proposed structures, as they are depicted on the "Overall P.U.D Plan"
rest on a drainage line. According to the City Engineer, the concrete silo pad shall have
steel reinforcing.
DECISION

to approve Final Plat Application #S-03-45, subject to the following conditions:
1. All previous approvals and stipulations shall remain in full effect, except as amended
herein.
2. This project shall be completed as shown on the plans submitted by the applicant, as
amended by this decision, and on file in the South Burlington Department of Planning &
Zoning
3. The applicant shall comply with the City Engineer's request to equip the concrete silo
pad with steel reinforcing.
4. Any changes to the final plat plan shall require approval of the South Burlington
Development Review Board.

5. The final plat plan shall be recorded in the land records within 90 days or this approval
is null and void. The plan shall be signed by the Board Chair or Clerk prior to recording.
