SITE PLAN APPLICATION #SP-17-39
FINDINGS OF FACT ANU DECISION
North American Breweries, hereinafter referred to as the applicant, is seeking after -the -fact
approval to amend a previously approved plan for a 57,137 sq. ft. light manufacturing facility
(brewery). The amendment consist of converting the existing beer tasting facility into a 48 seat
restaurant, 5 Bartlett Bay Road.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking approval to amend a previously approved plan for a 57,137 sq. ft.
light manufacturing facility (brewery). The amendment consist of replacement of
converting the existing beer tasting facility into a 48 seat restaurant, 5 Bartlett Bay Road.
2. The owner of record of the subject property is Antonio B. & Rita M. Pomerleau Foundation.
3. The subject property is located in the Commercial 2 Zoning District.
4. The application was received on June 9, 2017.
5. The plans submitted consist of a plan entitled "Restaurant & Parking Plan 5 Bartlett Bay
Road South Burlington Vermont" ' prepared by Civil Engineering Associates, Inc., dated
June 2016, and last revised on 7/15/16.
6. This application is to reapprove site plan approval #SP-16-39 which expired due to the
applicant not obtaining a zoning permit within six (6) months of that approval.
DIMENSIONAL REQUIREMENTS
7. Coverages remain unchanged.
8. Setback requirements are being met.

Only the standards below are affected by this application. All other standards will continue to be

9. The change from the tasting facility to a restaurant will require five (5) additional spaces
for a total of 67 spaces. The site currently has 62 spaces and with the five (5) additional
spaces, the minimum requirement will be met. A total of three (3) handicapped spaces will
be provided.
10. Pursuant to Section 13.01(G) (5) of the Land Development Regulations, bicycle parking
shall be provided on the subject property. A bicycle rack is shown on the plan.

11. The applicant submitted a traffic generation study dated 7/14/15 which concludes that the
conversion of 3,811 sq. ft. beer tasting facility with 15 seats to a sh�r't-order restaurant
with 48 seats will result in a PM peak hour vehicle trip end (vtes) increase of 17.8 vtes.
(c) Parking shall be located to the rear or sides of buildings
12. Parking is located on the front, sides and rear of the building. The five (5) additional spaces
are located in the rear.
13. As noted above, a bicycle rack location is noted on the plan.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-17-39 of North American Breweries, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval will
remain in effect.
2. This project must be completed as shown on the plan and will be on file in the South
Burlington Department of Planning and Zoning.
3. For the purpose of calculating road impact fees under the South Burlington Impact Fee
Ordinance, the Administrative Officer estimates that the change in use will generate 17.8
additional vehicle trip ends during the p.m. peak hour.
4. The applicant must obtain final wastewater allocation prior to permit issuance.
5. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04
of the Land Development Regulations or this approval is null and void.
6. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior
to use of the newly converted space.
7. Any change to the site plan shall require approval by the South Burlington Development
Review Board or the Administrative Officer.

PLEASE NOTE: Pursuant to 24 VSA §4465, an interested person may appeal this decision by filing
a Notice of Appeal with the secretary of the Development Review Board. This Notice of Appeal
must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
