Ms. Quimby moved to approve Design Review Application #DR-06-07 of Allison Estey subject to the stipulations in the draft motion. Mr. Farley seconded. Motion passed 6-0. Ms. Quimby moved to approve Design Review Applications #DR-07-07 and DR-07-08 subject to the stipulations in the draft motion. Mr. Farley seconded. Motion passed unanimously. 4. Public Hearing: Final Plat Application #SD-07-47 of Century Partners to amend a previously approved planned unit development consisting of 96,197 sq. ft. of general office and shopping center use in four buildings. The amendment consists of showing a 24-foot ingress and egress easement across 4 Market St. in favor of the property at 1117 Williston Road: Mr. Knudsen recused himself during the hearing of this application due to a conflict of interest. Mr. Sperry, representing the applicant, noted that the pass -through was not originally shown on the plan and the applicant wants to highlight the location. Mr. Dinklage asked what "in favor of mean. Mr. Belair said it allows the motel property traffic to flow from the motel across the 4 Market St. property. Mr. Sperry said the plan was recorded recently, and the applicant forgot to show the area around the back of the building and label it as an easement. It is built and is working well. Mr. Dinklage noted he often drives around there, and it looks very good now. Ms. Quimby moved to approve Final Plat Application #SD-07-47 of Century Partners subject to the stipulations in the draft motion. Mr. Farley seconded. Motion passed unanimously. 0 Site Plan Application #SD-07-50 of 3 Baldwin Avenue, LLC, to amend a previously approved plan for a 7965 sq. ft. general office building. The amendment consists of constructing an 8'x12' detached accessory structure, 3 Baldwin Avenue: Mr. Grippin said the addition is to store lawn equipment and garden tools. Mr. Belair said a letter was received from an abutter Lea Kuhn who had no objections. Mr. Belair also noted there is a sizeable tree in the corner of the property, and this should not be removed. Mr. Grippin said the tree is not in the way of the project. Mr. Dinklage suggested the tree be shown on the plan. -2- SOUTH BURLINGTON DEVELOPMENT REVIEW BOARD Minutes SEPTEMBER 4, 2007 Mr. Dinklage reminded the applicant that there can be no outside storage and no lighting on the shed. Condition #9 was added to the draft motion indicating that the tree be shown on the plan. Ms. Quimby moved to approve Site Plan Application #SP-07-50 of 3 Baldwin Avenue subject to the stipulations in the draft motion. 6. Site Plan Application #SP-07-59 of R.E.M. Development Co., LLC, to amend a previously approved plan for a 28,000 sq. ft. general office/manufacturing building. The amendment consists of: 1) converting the entire existing building to general office use, and 2) constructing a 19,500 sq. ft. GFA addition for general office use,19 Gregory Drive: Mr. Miller noted he had had a discussion with staff regarding landscaping. Ms. LaRose noted the presence of a sizeable arborvitae cedar hedge. She showed the location on the plan. Mr. Dinklage noted that the applicant was requesting a one space parking waiver. Ms. LaRose showed photos of an artists' rendering of the building and photos of the existing building. She said no height waiver is being requested. Mr. Dinklage asked Mr. Miller to confirm that they will build essentially what is shown in the rendering. Mr. Miller said they will. Mr. Belair said there is no issue with landscaping. The only concern is complaints from abutting residents about dumpsters being picked up too early. Dumpsters have been moved further away from residences. Ms. Quimby moved to approve Site Plan Application #SP-07-59 of R.E.M. Development Co., LLC, subject to the stipulations in the draft motion. Mr. Farley seconded. Motion passed unanimously. 7. Sketch Plan Application #SD-07-50 of Technology Park Partners to subdivide 177.2 acres into 16 lots ranging in size from 3.98 acres to 29.46 acres, Community Drive: Mr. Plumeau recused himself during this presentation due to a conflict of interest. Mr. Matosky showed the existing Digital Building and the almost completed building on Lot #7. The proposed new building would be on Lot #2. He indicated that they don't anticipate any problems with water or sewer. They also have all erosion control in place. They are constructing the lane on Kimball Avenue. -3- I NON. The amendment consists of constructing an 8' x 12' detached accessory structure, 3 Baldwin Avenue. Associate Planner Cathyann LaRose and Administrative Officer Raymond Belair, referred to herein as Staff, have reviewed the plans and have the following comments: ZONING DISTRICT & DIMENSIONAL REQUIREMENTS The applicant is proposing an increase in building coverage from 26.3% to 26.8% overall coverage from 61.6% to 62.1 %. This remains below the limitations for the C1 District. The applicant is proposing to locate an accessory structure within a commercial district, but five feet from the boundary of a residential district. Pursuant to Section 3.06(I) of the South Burlington Land Development Regulations (SBLDRs), where an existing non-residential use, structure or parking area that is adjacent to or within fifty (50) feet of the boundary of a residential district is proposed to be expanded, altered or enlarged, the required side or rear setback shall be increased to sixty-five (65) feet. A strip not less than fifteen (15) feet wide shall be landscaped..". The Development Review Board may permit new structures within said buffer if it finds that existing or proposed landscaping or fencing will provide equivalent screening of the noise, light, and visual impacts of the new use. The applicant has submitted photographs taken from the adjacent residence and a letter from an adjacent property owner (see enclosed). A fence, miscellaneous trees and shrubbery currently exist between the properties. SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following general review standards for all site plan applications: (a) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. (b) Parking shall be located to the rear or sides of buildings to the greatest extent practicable. (c) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. (e) The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. (f) Proposed structures shall be related harmoniously to themselves, the terrain, and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. There are no changes to the above criteria in relation to this application. Site plan applications shall meet the following specific standards as set forth in Section 14.07 of the South Burlington Land Development Regulations: (a) The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. Staff does not feel it is necessary to create access to the properties that abut the subject property. (b) Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). (d) Landscaping and Screening Requirements No additional landscaping shall be required as a result of this proposal. However, staff recommends conditioning the application to state that no trees may be removed from the property to accommodate the new structure. 1. No trees, shrubs, or existing fencing shall be removed from the property without explicit Development Review Board consent. Lighting The applicant has not proposed any lighting of the accessory structure. RECOMMENDATION Staff recommends that the Development Review Board approve Site Plan application #SP-07-50, conditional upon the applicant addressing the numbered items in the "Comments" section of this document. PUBLIC HEARING: Application of Derick & Kathy Pepin seeking a variance from Section 25.00, Area, Density and Dimensional Requirements of the South Burlington Zoning Regulations. Request is for permission to allow a 10'xl2' deck to project 10 feet into the required 30 foot front yard setback requirement, 2 Sherry Road: Ms. Pepin explained that they had been told on site by Dick Ward, former Zoning Administrator, that as long as they had 30 feet of frontage, the deck was OK. They now want to sell the house and were told they had needed a variance for the deck. Mr. Shepard said that if the city had put the road where they said they were going to put it, there would have been no problem. Mr. Dinklage said that is not the case, as the setback is measured from the edge of the right-of-way, not the road. d Ms. Barton, the potential purchaser,,og who would Ms. Pepin have gone to for a decision at the time they were considering the deck. Mr. Dinlage said Dick Ward. Ms. Barton noted that after the deck was built, there was a permit issued to put a roof over it, and nothing was mentioned about a problem when that was issued. Mr. Belair said those permits are routinely issued because they do not encroach further into the setback. He said that when he issued the permit for the roof, he was not aware that the deck was there illegally. Mr. Dinklage said he would like to have staff and the City Attorney review this issue in light of the additional information about the roof which has made the issue more complicated than originally thought. Mr. Farley moved to table the request until 7 September in order to get a further opinion from the City Attorney. Mr. Roth seconded. Motion passed unanimously. 5. Site Plan application of Grippin, Donlan & Roche, PLC, to amend a previously approved plan for a 7965 sq. ft. building with 5800 sq. ft. of general office use and 2165 sq. ft. of warehouse use. The amendment consists of converting 2165 sq. ft. of warehouse use to general office use, 3 Baldwin Avenue: Mr. Bombardier said they will expand the number of parking spaces for a total of 30. They are requesting a 2 space waiver. Four existing trees will have to be relocated for the additional parking. He indicated on the plan where they will be put. The will also install a bike rack. Mr. Bombardier showed photos of the site from various approaches. 2 DEVELOPMENT REVIEW BOARD 17 AUGUST 1999 They will not change the existing grading, and the drainage pattern will remain the same. Mr. Grippin indicated they are an accounting firm with 12 employees. They expect to expand to 16 employees by the end of the year. He said there are not a lot of people visiting the office on a daily basis. Mr. Dinklage noted the police report recommended thinning out trees and branches. Mr. Bombardier noted these are on the border of the residential district and that would mean trimming a buffer between the two districts. He also noted there is a conflicting statement in the police report which addresses lighting that may cause a problem for neighbors. Thinning the trees and branches would only increase light getting through to neighbors. Mr. Belair suggested working with the neighbors on this to see if they want the screening trimmed. Mr. Belair noted the landscaping requirement is not being met, but the site is well landscaped and staff does not recommend additional plantings. Ms Quimby moved the Development Review Board approve the site plan application of Grippin, Donlan & Roche PLC to amend a previously approved plan for a 7965 sq ft building with 5800 sq ft of general office use and 2165 sq. ft. of warehouse use. The amendment consists of converting 2165 sq. ft. of warehouse use to general office use. 3 Baldwin Avenue as depicted on a two page set of plans page one entitled "3 Baldwin Avenue LLC Site Plan 3 Baldwin Ave. So. Burlington, Vermont." prepared by Champlain Consulting Engineers, dated 7/28/99, last revised on 8/10/99, with the following stipulations: 1 All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2 For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance. the Development Review Board estimates that the change in use will generate 0.86 fewer vehicle trip ends during the P.M. peak hour. 3. PUBLIC HEARING: Final plat application of Nile & Julie Duppstadt and John & Deborah Alden to terminate the protective covenants of the Paul K. French, M.D. subdivision approved on 1/15/80 for 7 lots, Hinesburg Rd. & Van Sicklen Road: Mr. Lisman reviewed the history of this request. Memorandum - Development Review Board August 17, 1999 agenda items August 13, 1999 CRITERIA REVIEW 1) There are no unique physical circumstances or conditions peculiar to this particular property. The lot is not irregular in shape as can be seen on the drawing provided. The lot is not narrow or shallow. It has 70 feet of frontage on Sherry Road and 120 feet of frontage on Brookwood Drive. All the lots along the east side of Sherry Road have these same dimensions. The lot is not smaller than many of the lots in the neighborhood. The unnecessary hardship is due to the provisions of the zoning regulations and not to any unique physical circumstance or condition. The fact that the house location results in the need for the variance is not a physical condition unique to that particular property. 2) Since there are no physical circumstances or conditions, there is a possibility that the property can be developed in strict conformity with the provisions of the zoning regulations. The property is currently developed with a single family dwelling which is a reasonable use of the property. The authorization of a variance is therefore not necessary to enable the reasonable use of the property. 3) The applicant is creating the hardship by proposing to construct a deck that does not meet the zoning regulations. 4) The authorization of a variance would not alter the essential character of the neighborhood, nor would it impair the appropriate use or development of adjacent property, nor be detrimental to the public welfare. 5) The authorization of a variance would not represent the minimum variance that would afford relief and would not represent the least modification possible of the zoning regulations and of the plan. It is bounded on the east by single family residences, on the north by Baldwin Avenue, on the west by a restaurant, and on the south by an auto service station. Access/circulation: Access is provided via a 20 foot curb cut on Baldwin Avenue. No changes proposed. Circulation on the site is adequate. Coverage/setbacks: Building coverage is 26.3% (maximum allowed is 30%). Overall coverage is 61.4% (maximum allowed is 70%). Front yard coverage is 29.7% (maximum allowed is 30%). The building does not meet the front, side and rear setback requirements nor does it meet the 65 foot setback requirement from a residential district. This building is a noncomplying structure subject to the limitations of Section 26.002 of the zoning regulations. Parking: A total of 32 spaces are required and 30 spaces including two (2) handicapped spaces and a bike rack are being provided. This represents a two (2) space or a 6.25% shortfall. The applicant should be prepared to justify this shortfall. Traffic: This property is located in Traffic Overlay Zone 4 which allows this property to generate a maximum of 22.85 vehicle trip ends (vte's) during the P.M. peak hour. The new ITE Manual estimates that the existing use generates 12.73 vte's and the proposed uses will generate 11.87 vte's or 0.86 vte's fewer than currently generated. This property is approved for 24.4 vte's. The applicant should be aware that the road impact fee is zero (0). He said he intends to condominiumize the residential units but will keep the commercial units. Mrs. Maher asked about the landscaping that should have been done previously. Mr. Bensen said 4 red maples have been replaced by Clausens: They are 1/2" less in caliper than the ones that died. Mrs. Maher asked about the cedar hedge. This main is inadequate to supply the planned development with the necessary water for fire protection. Flow test must be taken. 2. Streets should be 30 feet in width with at least a 4 foot grassed strip between the curb and sidewalk. The water main should be within this grassed area. The grassed strip serves as a snow storage area. City experience in Valley Ridge shows that 24 feet streets are inadequate. 3. The island should be eliminated. S. dollars, on demand, but in any event in time to reach the place of payment by mail not later than one business day prior to maturity, the equivalent thereof at your then selling rate for the currency in which the acceptance is payable, or at your option pay on demand the equivalent of the acceptance in U. S. dollars at your then selling rate for cable transfers to the place of payment in such currency. If for any cause there exists at the time in question no rate of exchange generally current in Philadelphia for effective cable transfers of the sort provided for, we will pay you on demand an amount in U. S. dollars equivalent to the actual cost to you of settlement of your obligation to the payor of the draft or acceptance or any holder thereof, as the case may be, however and whenever such settlement is made by you. 3. Our commitment to you as specified in Paragraphs 1 and 2 will be evidenced by a promissory note ("Note") payable to your order for the amount, in United States Dollars, which you may be obligated to pay pursuant to the Letter of Credit you have opened on our behalf. In those instances where a Letter of Credit is issued in a currency other than U. S. dollars, the promissory note shall reflect the conversion of the currency to U. S. dollars as discussed in paragraph 2 above. Notwithstanding the foregoing, the amount owed on the Note shall be the amount actually advanced by the Provident National Bank ("Bank") in U. S. dollars plus any fees, commissions or other costs incurred by the Bank. 4. We will pay you on demand: (a) a commission of ($ ) or ( percent per annum); plus (b) interest where chargeable at the Prime Rate of the Bank plus percent per annum; and (c) all charges and expenses, including reasonable Counsel fees, incurred by you in protecting or enforcing your rights under this Agreement, or in any equity action in which we are a stakeholder involving the Credit, or otherwise arising from, as a result of, or in connection with, the credit issued pursuant hereto. In addition, if you should, as a result of (i) any requirement of law, regulation or interpretive ruling, or any change therein or in the interpretation or application; or (ii) your compliance with any request or directive (whether or not having the force of law) from any central Bank or other governmental agency, suffer any increased cost or have any amount received by you hereunder reduced as a result of a) any reserve requirement on deposits being applied to this credit, or b) a tax on, or change in the basis of taxation of, payments hereunder; or c) any other condition affecting your net income under this Agreement, then you, upon becoming aware of same, notify us thereof, and we agree to pay you, within thirty (30) days of your notice to us, such additional amounts as will compensate you for such increased costs or reduced revenues. 5. The users of the Credit shall be deemed our Agents and we assume all risks of their acts or omissions. You shall not be respon- sible for the validity, sufficiency, correctness or genuineness of documents, even if such documents should in fact prove to be in any or all respects incorrect, defective, invalid, insufficient, fraudulent or forged; for any breach of contract or disputes between the party or parties in whose favor the Credit is drawn and ourselves; for failure of any draft to bear reference or adequate reference to the Credit; for errors, omissions, interruptions or delays in transmission or delivery of any messages by mail or otherwise; or for any consequences arising from causes beyond your control; and none of the above shall affect, impair or prevent the fixing of any of your rights or powers hereunder. Any provision with respect to any of the foregoing matters which is contained in the Credit itself may be waived by you. We will hold you harmless from all loss or damage in respect of any of the foregoing matters, and from any and all damage and loss what- soever suffered by you by reason of any and all action taken by you in good faith. 6. Each of the following events or actions by or affecting each of us shall constitute an Event of Default: default in the performance of any undertaking to you under this Agreement, or under any other obligation; insolvency, or the filing by or against any of us any peti- tion under the Bankruptcy Code or any similiar Federal or State statute; the filing of a petition for the appointment of a receiver; or the making of an assignment for the benefit of creditors. Any demands, tenders, call or notices to us shall be deemed duly made or given as of the time left at our last known address, or mailed, telegraphed, telephoned or otherwise sent to such address. Any failure by you to act hereunder shall be neither construed as a waiver of your right to proceed in the future, nor as a waiver to proceed without first taking other action. 7. The receipt by you at any time of other collateral shall not be deemed a waiver of any of your rights or powers relating to any collateral which you may hold at the time of such receipt, nor as a waiver of the Bank's right of setoff as to this or any other obligation. 8. No failure or omission on our part to carry out any of the provisions hereof, and no act or omission by you shall be deemed a waiver by you of any of your rights or remedies hereunder, unless such waiver shall be in writing, and signed by you. 9. This Agreement shall continue in force notwithstanding any change in the composition of firm or firms parties hereto, or drawers of drafts hereunder or in the incorporation of any such firm. 10. We authorize you, without reference to or approval by us to set forth the terms of this Agreement in the Letter of Credit in such language as you may deem appropriate, with such variations from such terms as you may in your discretion determine (which deter- mination shall be conclusive and binding upon us) are necessary and are not materially inconsistent with this Agreement. 11. All rights under the Credit and this Agreement shall be determined by the Uniform Customs and Practice for Commercial Documentary Credits of the International Chamber of Commerce in effect from time to time (International Chamber of Commerce Publication No. 400 as amended or the most recent revision or successor thereto which shall be in effect from time to time and the Uniform Commercial Code, Article 5), the terms of which are known to us and which are incorporated by reference herein, and all rights under the Credit and the Agreement shall be construed in accordance with the laws of the Commonwealth of Pennsylvania. 12. I researched the problem of noise that you had expressed at the Zoning Meeting on November 10th. I spoke to neighbors of Carousel Child Care center which is roughly the same size as the center we have proposed. I spoke to the adjoining neighbor, a neighbor whose backyard backs up to the play -yard, and the neighbor across the street. They stated noise and traffic are not problems. They all signed letters to this effect. You also stated you did not want to hear children for eight hours a day. Lam enclosing a daily schedule that is in my parent handbook which states that the children would be outside for an hour in the morning and one hour in the late afternoon. This schedule is to remain flexible but we are going to be an educational center and most of our learning will be done ju j& We are going to plan to attend the next Zoning Meeting for November 24th.
