Call to order, emergency procedure, agenda review, comments from guests 2. Review and approval of minutes of 09/10/2019 committee meeting 3. Chair’s comments: Reminder of All Committees Symposium 9/26/19 4. Discuss outcome of meeting with Regina, Paul and CHT re unresolved IZ issues and possibly recommend amendments to draft presented to Planning Commission 5. Discuss Paula’s email and power point and assign follow-up 6. Update on housing land priority identification project and task force 7. Review 2020 Work Plan to schedule Committee work 8. Reports and updates by committee members 9. Adjourn 1. Call to order, emergency procedure, agenda review, comments from guests: John called the meeting to order at 10:03 a.m. He reviewed the exit procedures. There were no public comments. 2. Review and approval of minutes of 09/10/19 committee meeting: Tom moved and Mike seconded motion to table consideration of the September 10, 2019, meeting minutes until next meeting. Motion passed (7-0-0). Pause: Kevin Dorn and unknown photographer arrived, photographer took photo of committee, and both exited. 3. Chair’s comments: John will attend the September 26th All Committees Symposium and encouraged committee members to attend. He has been asked to provide statement identifying committee’s most important project and share fun aspect of committee’s work. Regarding former, John asked for waiver of deadline should Planning Commission vote that evening to warn public hearing on committee’s LDR proposal; regarding the latter, committee members drew a blank on fun aspect of committee work. 4. Discuss outcome of meeting with Regina, Paul and CHT re unresolved IZ issues and possibly recommend amendments to draft presented to Planning Commission: Cindy raised two questions: (1) why is the price maximum for rentals 80% AMI instead of 60% AMI? (2) why are we not proposing that these rules apply city-wide? John replied re (1) that these regulations are intended to require and enable private for-profit developers to include Inclusionary units in their developments. These developments will not have the public funding needed to enable developers to build housing whose costs are at or below 60% AMI; and re (2) that the plan is to make Inclusionary Zoning city-wide once Interim Zoning has ended. Monica added that TDR issue needs to be resolved before implementation of Inclusionary Zoning city-wide. John gave a brief summary of meeting with Mike Monte, Rob Leuchs, and Jaclyn Marcotte of CHT. Regina then led those present through the changes that, based on discussion following the meeting with CHT, John and Sandy proposed that the members approve. Paul Conner, who along with John, Regina, and Sandy attended the meeting with CHT, provided many helpful contributions to this discussion. ● Re Inclusionary home ownership (2.02 Specific Definitions): Tom moved and Mike seconded motion to approve change to set maximum price for Inclusionary homeownership units at 70% AMI and maximum household income for purchase of Inclusionary homeownership units at 100% AMI. Discussion focused on September 24, 2019, SoBu Affordable Housing Committee Minutes- APPROVED Page 2 need to make purchase price low enough to attract purchasers willing to accept restrictions applicable to Inclusionary homeownership and need to provide an income range above the purchase price maximum AMI to increase the number of households eligible to purchase the Inclusionary unit. Motion passed 7-0-0. ● Re For covered development and Offsets for required Inclusionary units and Bonuses for voluntary Inclusionary units (18.01 C.(1), F(1), and G. (20), and H.(2)): Tom moved and Sandy seconded that the percentage of Inclusionary homeownership units required in a development be changed from 15% to 10%, the number of Offset and Bonus units provided for each required or voluntary Inclusionary homeownership unit be changed from one (1) to (2), and the total number of Offset and Bonus units be limited so that the base density for the parcel does not increase more than 50%. These changes are intended to counter balance the new requirement that the purchase price maximum be 70% AMI and limit the density increase that can be achieved by voluntarily increasing the number of Inclusionary units built. Discussion focused primarily on how voluntary Inclusionary units and bonus units provided for them would be calculated. Motion passed (7-0-0). ● Re Inclusionary units required under this section shall be: (18.01 C,(2)(b)(iii) and (v)): The proposal was to delete the language following “amenities” in (iii), delete the example in (v), and add a second sentence in (v) to replace the sentence containing the example. The new sentence would require, as an alternative calculation, that the Inclusionary units have an average number of bedrooms that is no less than the average number of bedrooms in the Market units. Much discussion followed. Members present were unwilling to support deletion of the previously approved language in (iii) while they supported the proposed changes to (v). Todd moved and Sandy seconded that the language following “amenities” in (iii) be retained and the proposed changes in (v) be approved. Motion passed (7-0-0). ● Re Affordable housing and Affordable housing development (2.0 Specific Definitions): Paul explained how this change might increase the likelihood that affordable housing units would be built in an already-permitted development in the SEQ. The proposal re “Affordable housing” was, in (A), to change “eighty” to “one-hundred” and “(80%)” to “(100%)”; the proposal re “Affordable housing development” was to add language relating to the pricing of affordable housing units in Affordable housing developments that would make the maximums 80% of AMI for rentals and 100% of AMI for homeownership units. Discussion followed. Members supported 80% AMI for rentals but concluded that the price maximum for homeownership units should also be 80% AMI. Sandy moved and Mike seconded that the 100% change be made to (A) and that the price maximum for both rental and homeownership units be 80% of AMI. Motion passed (7-0-0). ● Re Continued Affordability (18.01 D.(5)): The proposal was to change the covenant requirements for continued affordability to be that the resale price of an Inclusionary homeownership unit be no greater than the higher of the price the homeowner paid for the unit or the price that is targeted to 70% AMI at time of sale, or a price determined by a covenant provided by a nonprofit affordable housing agency and is approved by the City. CHT has used this “higher of the price the homeowner paid for the unit or the price that is targeted to (agreed upon) % AMI” with Inclusionary units built by private for-profit developers. This change is a substitute for the shared-equity requirement. Tom moved and Sandy seconded that the proposed changes be approved. Discussion followed with Todd indicating that he could not support this change due to concerns about its effect on the homeowner. Motion passed (6-0-1 with Todd abstaining). Members than asked Regina to make any additional changes to the proposed LDRs needed to make the package consistent with the changes approved above. Discussion then returned to how the number of voluntary Inclusionary units and bonus units provided for them would be calculated. Monica requested further clarification and that the policy change include an example showing the calculation. Members supported Monica’s request. 5. (Quoted from January 23, 2018, meeting minutes) “John asked Mike to prepare a work plan for the committee to collaborate with Coralee to enhance its effectiveness in communicating with residents via the City’s website and via other means. The plan should include specific assignments to be carried out by identified committee members. Mike accepted this assignment.” Homework (not yet reported on): All bike rack tasks should include date of assignment and date for task completion.
