HomeMy WebLinkAboutMinutes - Board of Civil Authority - 10/21/2021BOARD OF CIVIL AUTHORITY PM 21 OCTOBER 2021 The South Burlington Board of Civil Authority held a meeting on Thursday, 21 October 2021, at 6 p.m., in the conference room, City Hall, 180 Market Street. Members Present: C. Shaw, Chair; D. Kinville, P. Mahoney, M. Mahoney, C. Callea, K. Nugent, T. Barritt, C. Santorello, A. Gross, B. Gross, B. Nowak, M. St. Germain, C. Wagner, C. Trombly, Sen. T. Chittenden, M. Emery, M. Cota Also Present: 1. Review evacuation plans in case of an emergency. Ms. Kinville reviewed emergency plans. Mr. Shaw noted that the wearing of masks is encouraged in City Hall. 2. Comments and questions from the public not related to the agenda: No comments or questions were presented. 3. Any change to the order of the agenda: No changes were made to the agenda. 4. Approve Minutes of 14 October and 16 October: Mr. St. Germain noted that in the third paragraph from the bottom of the 14 October minutes, the speaker should by Sen. Sirotkin. Mr. Barritt then moved to approve the Minutes of 14 and 16 October as presented and amended. Mr. Cota seconded. Motion passed with all present voting in favor. 5. Hear Inspection Reports from 7 October, 14 October and 16 October hearings: Mr. Shaw explained the appeals process. October 7 reports: a. James & Ilena Smith 30 Butler Drive Ms. Kinville advised that this appeal was withdrawn. b. Linda Beasimer 1 Oak Creek Road Ms. Nugent reported that this is a single family home in a quiet neighborhood. There are no signs of needed maintenance. The home has 3 bedrooms, 2 baths and an unfinished basement. The team felt the condition was good, not average. BOARD OF CIVIL AUTHORITY 21 OCTOBER 2021 PAGE 2 c. Samuel Hoar & Eve Pratt Hoar 5 Keari Lane Mr. Barritt reported that this is a nice home, well landscaped. It has 4 bedrooms and a partly finished basement. The condition is good, and there were no discrepancies with the lister’s card. d. Joseph & Barbara Greenwald 70 East Terrace Mr. Barritt reported that this is a nice older home with mature landscaping. It has 3 bedrooms and a deck on the back. Vinyl siding is in good condition. An elevator to serve a handicapped member of the family opens to all floors. e. Mary Kirkpatrick 199 Economou Farm Road Mr. Barritt reported that the property is a large condo. There is some wood deterioration in the kitchen. There is a partly finished basement and a deck with a hot tub. There is some ceiling water damage. October 14 reports: f. Lynn Vera 11 Pavilion Drive Mr. Nowak reported the home is at the end of a dead end street. It has been impacted by stormwater flooding. The city installed a stormwater drain down the middle of the driveway which now has an easement. The owner cannot do anything over that easement. The Water District has a well adjacent to the property which restricts the use of the property. The property is well maintained and is in good condition with limited upgrades. g. Thomas & Maureen Rees 20 Keari Lane Mr. Nowak reported this was a “no show” as no body was home at the time of inspection. h. Joseph & Susan Finnigan 85 Upswept Lane Sen. Chittenden reported that the square foot issue was resolved. The house has only 3 bedrooms, not 4 as stated on the lister’s card. BOARD OF CIVIL AUTHORITY 21 OCTOBER 2021 PAGE 3 i. Katarina Khosravi 192 South Pointe Drive Sen. Chittenden reported this is the same footprint as the previous home. There is some disrepair in the siding. It, too, has 3 bedrooms, not 4. October 16 a.m. reports: j. Clare & Sam Wool 51 Van Sicklen Road Ms. Kinville recused herself for this appeal due to a potential conflict of interest. Ms. Emery reported that this is an historic home. Windows and plumbing are not up to modern standards. There is new flooring in the basement but stairs have not been refinished. Windows are not standard. Out buildings are in complete disrepair. The inspection team felt the property should be downgraded from excellent to fair/average. k. Nancy & Bill Jacobus 130 Economou Farm Road Ms. Nugent reported that the property is in good condition throughout. l. Lucille Lacount 201 Economou Farm Road Ms. Nugent reported that the property backs up to the golf course. It has a shared driveway. The team felt the condition was average, not average/good. They noticed some peeling paint. m. Edward Delfoe 161 Economou Farm Road Ms. Emery reported the home is in beautiful condition. There are 4 bedrooms though one is listed as an office. There are 3 full and one half bathrooms and a partly finished basement. n. Mark Patane & Elain Bodette 20 Southview Drive Mr. Nowak reported that this condo is in a set of 3 units. There are no discrepancies with the card. It is well maintained with no upgrades. There is a discrepancy in square footage between the city and a private appraisal. Brett Grabowski 112 Springhouse Road Ms. Nugent recused herself from this appeal due to a potential conflict of interest. Mr. Nowak reported this is a newer home off Spear Street. The land wasn’t built on for a number of years. The home has 6,200 sq. ft. and is very well kept. It has high quality appliances, 3 fireplaces (one of which is indoor/outdoor) and a patio. There are land restrictions as the property is part of a conservation district. The owner cannot subdivide or cut any trees. There is no lake view. The card rates the property condition as average, but the team felt it was excellent. p. Todd Ciardelli 25 Baldwin Avenue Mr. Nowak reported this is a small corner ranch house with 2 bedrooms. There is water damage and the foundation needs repair. There is mold in the basement. There are no upgrades to the kitchen or bath. The lister’s card says the basement is partially finished, but the team could see no evidence of that. The is an inground pool and was covered. The team felt the condition was fair to poor. October 16 p.m. reports: q. Jean Fahrenbach 406 South Beach Road Mr. Nowak reported this is a condo unit on the lake. However, they did not notice any lake access. Repairs have been kept up. The team felt it was in average/good condition with no upgrades. r. Sarah Cummings 407 South Beach Road Mr. Nowak reported this property is next door to the previous one and has the same footprint. It is in very good condition with some upgrades to the kitchen and floors. It is in good repair. There were no discrepancies with the lister’s card. BOARD OF CIVIL AUTHORITY 21 OCTOBER 2021 PAGE 5 s. Peter Smejkal 12 Oak Creek Drive Mr. Trombly reported the property is in good condition. It has good landscaping and an outdoor fire pit. The inside is in good to excellent condition in the home’s addition and average condition in the older part. It has a 6-car garage and an unfinished basement. t. James Rock 100 South Street Mr. Rock submitted a letter withdrawing his appeal as he would not allow the team to inspect the property. u. Pizzagalli 55 Green Mountain Drive The appellant and Ms. Lyons came to an agreement, and this appeal was withdrawn. Mr. Gross then moved to enter deliberative session. Ms. Emery seconded. The motion passed with all present voting in favor. 7 Other Business: No other business was presented. As there was no further business to come before the Board, Mr. Gross moved to adjourn.
