BRIEF NARRATIVE:
On April 8th, 2018 at approximately 3:16 am, South Burlington PD assisted the Vermont State Police with locating and checking on the welfare of a vehicle that was reported to be stopped on the shoulder of Interstate
89. A South Burlington PD officer located the vehicle which was observed to be stopped on the shoulder of the interstate with the engine running but with no lights on or hazard signals. The officer checked on the vehicle and observed the operator of the vehicle to be slouched over and sleeping in the front seat. The operator of the vehicle was identified as Andrew Gutierrez 31 y/o of Johnson, VT. The officer could smell an odor of intoxicants from Gutierrez and observed that his speech was confused and slurred. The officer conducted a series of field sobriety tests on Gutierrez and concluded at the end of them that Gutierrez was under the influence of intoxicants and was unable to operate a motor vehicle. Gutierrez refused to submit a sample of his breath on the PBT and was subsequently arrested for Driving under the Influence. Gutierrez refused to submit a sample of his breath on the DataMaster while at South Burlington PD. Gutierrez was processed for
DUI and was later detoxed at the Chittenden Regional Correctional Facility with a citation to appear at
Chittenden Superior Court Criminal Division on 04/26/2018 at 0830 hours to answer for the charge.
