Associate Planner Cathyann LaRose and Administrative Officer Raymond Belair, referred to herein as Staff, have reviewed the plans and have the following comments: SUBDIVISION CRITERIA Pursuant to Section 15.18 of the South Burlington Land Development Regulations, subdivisions shall comply with the following standards and conditions: Sufficient water supply and wastewater disposal capacity is available to meet the needs of the project. According to Section 15.13 of the South Burlington Land Development Regulations, the existing public water system shall be extended so as to provide the necessary quantity of water, at an acceptable pressure. The units on the proposed lots will be connected to the public water system. The South Burlington Water Department has already reviewed and approved the proposed water lines. According to Section 15.13 of the South Burlington Land Development Regulations, the subdivider or developer shall connect to the public sewer system or provide a community wastewater system approved by the City and the State in any subdivision where off -lot wastewater is proposed. The proposed subdivision does not involve any construction, so this criterion is not applicable. Sufficient grading and erosion controls will be utilized during and after construction to prevent soil erosion and runoff from creating unhealthy or dangerous conditions on the subject property and adjacent properties. The proposed subdivision does not involve any construction, so this criterion is not applicable. The project incorporates access, circulation, and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. The proposed subdivision does not involve any construction, so this criterion is not applicable. The project's design respects and will provide suitable protection to wetlands, streams, wildlife habitat as identified in the Open Space Strategy, and any unique natural features on the site. The City's Official Wetland Map indicates that there are no wetlands on the subject piece. Also, as there is no construction proposed at this time this criterion is not applicable. The project is designed to be visually compatible with the planned development patterns in the area, as specified in the Comprehensive Plan and the purpose of the zoning district(s) in which it is located. The proposed subdivision is compatible with the planned development patterns of the Airport Industrial Zoning District, as outlined in Section 6.03 of the Land Development Regulations. Open space areas on the site have been located in such a way as to maximize opportunities for creating contiguous open spaces between adjoining parcels and/or stream buffer areas. The layout of a subdivision or PUD has been reviewed by the Fire Chief or (designee) to ensure that adequate fire protection can be provided. The proposed subdivision does not warrant review by the South Burlington Fire Chief. Roads, recreation paths, stormwater facilities, sidewalks, landscaping, utility lines and lighting have been designed in a manner that is compatible with the extension of such services and infrastructure to adjacent landowners. Staff feels this requirement is being met. Roads, utilities, sidewalks, recreation paths, and lighting are designed in a manner that is consistent with City utility and roadway plans and maintenance standards. Staff feels this requirement is being met. The project is consistent with the goals and objectives of the Comprehensive Plan for the affected district(s). Staff feels the proposed subdivision is in conformance with the South Burlington Comprehensive Plan. Other 1. For purposes of planning and zoning, the three (3) lots included in this subdivision shall be considered one (1) lot and part of the overall Airport lot. The applicant will be required to record a "Notice of Condition" to this effect which has been approved by the City Attorney prior to recording the final plat plan. The proper party for purposes of submitting applications for approval from time to time under City ordinances and regulations, including the Land Development . Regulations, as they may be amended from time to time, shall be the Owner. The City shall act upon any application submitted by the Owner. It shall be the duty of the Owner to notify all others having an interest in the Property that may be affected by the application proceedings of the commencement of such proceedings. 4. Any action to enforce any City ordinance or regulation, including the Land Development Regulations, as they may be amended from time to time, against the Property, or activities or events occurring on the Property, shall be brought against the Owner. It shall be the duty of the Owner to notify all others having an interest in the Property that might be affected by the enforcement proceedings of the commencement of such proceedings. Any decision in an enforcement proceeding, including a decision granting injunctive relief or penalties, shall be enforceable at the City's sole discretion against the Owner. 5. This Notice of Conditions shall be recorded in the City of South Burlington Land Records and shall be referred to in any deed conveying the Property or an interest in the Property. 6. Miscellaneous Application #MS-07-03 of Marcel Beaudin to raze a single family dwelling with a building footprint of 1625 sq. ft. and replace it with a new single family dwelling with a building footprint of 1872 sq. ft. representing a 15.2% footprint increase, 5 Lyons Avenue: Mr. Beaudin explained that they propose to reduce the building to a story -and -a half in order to respect the views of the neighbor. Mr. Behr noted that the sticking point is the front setback. Mr. Belair explained that the proposed retaining wall goes right to the property line, and it has to be 5 feet away. Part of the disagreement regards frontage. Staff feels that this lot has 1-1/2 feet of frontage on Lyons Avenue, so they are treating it as having no frontage. The setback is therefore based on the right-of-way. Mr. Beaudin provided elevations for the Board showing what the house would look like from the lake. He said they would be a good 50 feet from the road and would actually be further from Lyons Avenue than they are presently. Mr. Cassidy, owner of the property, said he traded land with a neighbor who gave them a "use easement." He said they believe the lot has frontage, and that's how the deeds are drawn. Mr. Belair said that unless the City Attorney disagrees with staff and agrees with Mr. Cassidy, he could not issue a zoning permit. The proposal received final plat approval on August 1, 2006 (minutes attached). However, the statutory six month deadline for recording has passed and the applicant is seeking re -approval from the Development Review Board. COMMENTS Associate Planner Cathyann LaRose and Administrative Officer Raymond Belair, referred to herein as Staff, have reviewed the plans and have the following comments: SUBDIVISION CRITERIA Pursuant to Section 15.18 of the South Burlington Land Development Regulations, subdivisions shall comply with the following standards and conditions: Sufficient water supply and wastewater disposal capacity is available to meet the needs of the project. According to Section 15.13 of the South Burlington Land Development Regulations, the existing public water system shall be extended so as to provide the necessary quantity of water, at an acceptable pressure. The units on the proposed lots will be connected to the public water system. The South Burlington Water Department has already reviewed and approved the proposed water lines. According to Section 15.13 of the South Burlington Land Development Regulations, the subdivider or developer shall connect to the public sewer system or provide a community wastewater system approved by the City and the State in any subdivision where off -lot wastewater is proposed. The proposed subdivision does not involve any construction, so this criterion is not applicable. Sufficient grading and erosion controls will be utilized during and after construction to prevent soil erosion and runoff from creating unhealthy or dangerous conditions on the subject property and adjacent properties. The proposed subdivision does not involve any construction, so this criterion is not applicable. The project incorporates access, circulation, and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. The project's design respects and will provide suitable protection to wetlands, streams, wildlife habitat as identified in the Open Space Strategy, and any unique natural features on the site. This criterion is not applicable to the proposed project. The layout of a subdivision or PUD has been reviewed by the Fire Chief or (designee) to ensure that adequate Fre protection can be provided. The proposed subdivision does not warrant review by the South Burlington Fire Chief. Roads, recreation paths, stormwater facilities, sidewalks, landscaping, utility lines and lighting have been designed in a manner that is compatible with the extension of such services and infrastructure to adjacent landowners. Staff feels this requirement is being met. The reading for this was 90+. At the property line, it dropped to 72. Mr. Vock said one advantage of this location for the dumpster is that it is relatively far from the property line. He felt there would be more noise if the trash pickup were underground because the duration of sound would be longer when the truck was backing UP. Mr. Farrell said one other thing they are doing is a boundary line adjustment between lots 1 & 9. Mr. Belair said the approval motion would have to be amended to reflect this. Members did not favor adding the fencing between the two existing fences. The motion was amended to include a description of the boundary line adjustment as part of the request. Ms. Quimby moved to approve Final Plat Application #SD-06-35 of Eric Farrell subject to the stipulations in the draft motion as amended to include the boundary line adjustment noted above. Public hearing: Final Plat Application #SD-06-55 of Pizzagalli Properties, LLC, to amend a previously approved plat for a 28,000 sq. ft. mixed use building consisting of: 1) 18,000 sq. ft. of medical office use, 2) 9,400 sq. ft. of general office use, and 3) 200 sq. ft. of retail food establishment use. The amendment consists of adding a sidewalk to emergency egress exit,118 Tilley Drive: Mr. Bouchard said they have an emergency egress doorway on the south side of the building. There was never a sidewalk put in there, and they are required by the State to keep a pathway clear. They decided that a sidewalk would be the best way to do this. Miscellaneous Application #MS-06-05 of Mark Judge to construct a 10'x12' deck to project 13 feet into the front setback, 49 Barrett Street: Ms. Quimby stepped down due to a conflict of interest. Mr. Judge said the existing concrete slab is deteriorating. When they made the deck a little bigger than the slab, they ran into a setback problem. Mr. Dinklage suggested they could turn the stairs to come off the side of the porch. He noted there is a 30-foot setback, and this plan would violate that. Mr. Judge felt it just looks better this way and would enhance the value of the house. There would be no screened in porch. There is only one neighbor who hasn't complained. Mr. Dinklage noted that staff recommends denial as the property is usable as currently built. The slab could be rebuilt to its existing dimensions. Mr. Judge noted that the house is already located in the setback. Mr. Belair said the setback is 55 ft. from the center of the street. The house is now 46 ft., and what is proposed would be 42 ft. Associate Planner Cathyann LaRose and Administrative Officer Raymond Belair, referred to herein as Staff, have reviewed the plans and have the following comments: SUBDIVISION CRITERIA Pursuant to Section 15.18 of the South Burlington Land Development Regulations, subdivisions shall comply with the following standards and conditions: Sufficient water supply and wastewater disposal capacity is available to meet the needs of the project. According to Section 15.13 of the South Burlington Land Development Regulations, the existing public water system shall be extended so as to provide the necessary quantity of water, at an acceptable pressure. The units on the proposed lots will be connected to the public water system. The South Burlington Water Department has already reviewed and approved the proposed water lines. According to Section 15.13 of the South Burlington Land Development Regulations, the subdivider or developer shall connect to the public sewer system or provide a community wastewater system approved by the City and the State in any subdivision where off -lot wastewater is proposed. The proposed subdivision does not involve any construction, so this criterion is not applicable. Sufficient grading and erosion controls will be utilized during and after construction to prevent soil erosion and runoff from creating unhealthy or dangerous conditions on the subject property and adjacent properties. The project incorporates access, circulation, and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. According to Section 15.13 of the South Burlington Land Development Regulations, the existing public water system shall be extended so as to provide the necessary quantity of water, at an acceptable pressure. The units on the proposed lots will be connected to the public water system. The South Burlington Water Department has already reviewed and approved the proposed water lines. According to Section 15.13 of the South Burlington Land Development Regulations, the subdivider or developer shall connect to the public sewer system or provide a community wastewater system approved by the City and the State in any subdivision where off -lot wastewater is proposed. The proposed subdivision does not involve any construction, so this criterion is not applicable. Sufficient grading and erosion controls will be utilized during and after construction to prevent soil erosion and runoff from creating unhealthy or dangerous conditions on the subject property and adjacent properties. The proposed subdivision does not involve any construction, so this criterion is not applicable. The project incorporates access, circulation, and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. The proposed subdivision does not involve any construction, so this criterion is not applicable. The project's design respects and will provide suitable protection to wetlands, streams, wildlife habitat as identified in the Open Space Strategy, and any unique natural features on the site. The City's Official Wetland Map indicates that there are no wetlands on the subject piece. Also, as there is no construction proposed at this time this criterion is not applicable. The project is designed to be visually compatible with the planned development patterns in the area, as specified in the Comprehensive Plan and the purpose of the zoning district(s) in which it is located. The proposed subdivision is compatible with the planned development patterns of the Airport Industrial Zoning District, as outlined in Section 6.03 of the Land Development Regulations. Open space areas on the site have been located in such a way as to maximize opportunities for creating contiguous open spaces between adjoining parcels andlor stream buffer areas. This criterion is not applicable to the proposed project. The layout of a subdivision or PUD has been reviewed by the Fire Chief or (designee) to ensure that adequate fire protection can be provided. Roads, recreation paths, stormwater facilities, sidewalks, landscaping, utility lines and lighting have been designed in a manner that is compatible with the extension of such services and infrastructure to adjacent landowners. Staff feels this requirement is being met.
