HomeMy WebLinkAboutSP-17-71 - Decision - 0110 Kimball Avenue#SP-17-71 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING JIM FOSTER - 110 KIMBALL AVENUE SITE PLAN APPLICATION #SP-17-71 FINDINGS OF FACT AND DECISION Jim Foster, hereinafter referred to as the applicant, is seeking after -the -fact approval to amend a previously approved plan for a 27,616 sq. ft. building consisting of 25,516 sq. ft. of general office use and 2,100 sq. ft. of medical office use. The amendment consists of: 1) replacing three (3) trees that were removed to construct the new stormwater treatment system, and 2) minor site modifications, 110 Kimball Avenue. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking after -the -fact approval to amend a previously approved plan for a 27,616 sq. ft. building consisting of 19,516 sq. ft. of general office use and 8,100 sq. ft. of medical office use. The amendment consists of: 1) replacing three (3) trees that were removed to construct the new stormwater treatment system, and 2) minor site modifications, 110 Kimball Avenue. 2. The owner of record of the subject property is 110 Kimball, LLC. 3. The subject property is located in the I-C Zoning District. 4. The application was received on October 10, 2017. 5. The plan set consists of a three (3) page set of plans, page one (1) is titled, "110 & 120 Kimball 110 & 120 Kimball Avenue South Burlington, Vermont", prepared by Trudell Consulting Engineers, dated June 30, 2017, and last revised on 8/31/17. DIMENSIONAL REQUIREMENTS 6. No changes to coverages. 7. Setback requirements are being met. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. - 1 - #SP-17-71 Bicycle Parking 8. Section 13.14 of the LDRs required the last site plan application #SP-17-53A to include the new type and location for bicycle racks, to accommodate the minimum requirement of four (4) short-term bicycle parking spaces. Since this is the second application under the new requirements, the plan must be revised to accommodate a total of six (6) bicycles. Landscaping 9. The applicant is proposing to replace trees removed with trees with a value of $5,855. The City Arborist on 10/17/17 indicated in an email that he has no issues with the new plantings. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-17-71 of Jim Foster, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The plans must be revised to show the changes below and will require approval of the Administrative Officer. Three (3) copies of the approved revised plans must be submitted to the Administrative Officer prior to permit issuance. a. The site plan must be revised to add two (2) additional bicycle parking spaces. 4. The applicant must regularly maintain all stormwater treatment and conveyance infrastructure. 5. Prior to permit issuance, the applicant must post a $5,855 landscaping bond. This bond must remain in full effect for three (3) years to assure that the landscaping has taken root and has a good chance of survival. 6. Prior to issuance of a zoning permit for the project, the applicant must submit to the Administrative Officer a final set of project plans as approved in digital (PDF) format. 7. The applicant must obtain a zoning permit from within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 8. All exterior lighting must be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 9. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use of the newly converted space. -2- #SP-17-71 10.
