The amendment consists of: 1) constructing a 64 square foot building to house telecommunications equipment, and 2) relocating the dumpster storage location, 30 Joy Drive. On the day of November, 1997, the South Burlington City Planner approved the request of Nextel Communications, Inc. to amend a previously approved site plan under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1) This project consist of amending a previously approved site plan for a 13,090 square foot general office (television studio). The amendment consists of: 1) constructing a 64 square foot building to house telecommunications equipment, and 2) relocating the dumpster storage area. The only issues affected by this amendment are landscaping, setbacks and coverage. 2) This property at 30 Joy Drive is located in the C2 and C.O. Districts. It is bounded on the north by Joy Drive, the west by a health club and office building, and on the east by an office building, and on the south by I-189. 3) Coverage/setbacks: Building coverage is 9.9% (maximum allowed is 30%). Overall coverage is 34.9% (maximum allowed us 70%). Front yard coverage is 10.9% (maximum allowed is 30%). 4) Setback requirements are met for the proposed equipment building. The existing office building and garage are noncomplying structures subject of the limitations of Section 26.002 of the zoning regulations because both buildings are partially located in the C.O. District. 5) Landscaping-: The minimum landscaping requirement, based on building costs, is $600 which is being met. Proposed plantings include White Pine which must be a minimum of 5' -6' in height. Sheet SP-1 should be revised to show the relocated dumpster area including the proposed trees. Sheets SP-1 and C2 should show additional White Pines to effectively screen the dumpster storage area from the street. 6) Lighting_ No exterior lights proposed. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington City Planner approves the site plan application of Nextel Communications, Inc., to amend a previously approved site plan for a 13,090 square foot general office (television studio). The amendment consists of: 1) constructing a 64 square foot building to house telecommunications equipment, and 2) relocating the dumpster storage area, 30 Joy Drive, as depicted on a five (5) page set of plans, page one (1) entitled, "WCAX Parking Lot Expansion Joy Drive South Burlington, VT, "prepared by Freemen French Freeman, Architects, last revised 10/20/97, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. For the purpose of calculating road impact fees under South Burlington Impact Fee Ordinance, the City Planner estimates that the equipment building will generate zero (0) additional vehicle trip ends during the P.M. peak hour. 3. Any new exterior lighting or changes to existing lighting shall consist of downcasting shielded fixtures. Any change to existing lights shall require approval of the City Planner prior to installation. 4. Prior to issuance of a zoning permit, the applicant shall post a $600 landscape bond. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 5. The plans shall be revised to show the changes below and shall require approval of the City Planner. Three (3) copies of the approved revised plans shall be submitted to the City Planner prior to permit issuance. a) Sheet SP-1 shall be revised to show the relocated dumpster storage area, the proposed White Pine trees, and show additional White Pine trees to effectively screen the dumpster storage area from the street. b) Sheet C2 shall be revised to show additional White Pine trees to effectively screen the dumpster storage area from the street. c) Sheets SP-1 and C2 shall be revised to note that the White Pine trees shall have a minimum height of 5'-6'. 6. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 7. The applicant shall obtain a Certificate of Occupancy/ Compliance from the Administrative Officer prior to the use of the equipment building. 8.
