This project, consisting of subdividing a 162 acre parcel into Lot #1 being 30 acres of undeveloped land and Lot #2 being 132 acres with an five bedroom duplex served by on -site drilled well and wastewater disposal systems located off Hinesburg Road in the City of South Burlington, Vermont, is hereby approved under the requirements of the regulations named above subject to the following conditions. GENERAL 1. This permit does not relieve the permittee from obtaining all other approvals and permits as may be required from local officials prior to proceeding with this project. 2. The project shall be completed as shown on the following plans which have been stamped "approved" by the Wastewater Management Division: Project 2005080, Sheet 1 of 1 "Wastewater Replacement Area" dated 3/15/06 prepared by Llewellyn -Howley, Inc. and Job #SOUB0107, Plan Sheet 1 of 1 "Subdivision Plat" dated 10/07/05 last revised 1/19/06 prepared by Button Professional Land Surveyors, PC. The project shall not deviate from the approved plans in a manner that would change or affect the exterior water supply or wastewater disposal system, building location or the approved use of the building without prior written approval from the Wastewater Management Division. 3. The conditions of this permit shall run with the land and will be binding upon and enforceable against the permittee and all assigns and successors in interest. The permittee shall be responsible for the recording of this permit in the South Burlington Land Records within thirty, (30) days of issuance of this permit and prior to the conveyance of any lot subject to the jurisdiction of this permit. 4. Each prospective purchaser of Lot #2 shall be shown copies of the Wastewater System And Potable Water Supply Permit and the approved plans prior to conveyance of the lot. Wastewater System and Potable Water Supply Permit WW-4-2605 Ernest Auclair Page 2 5. This project has been reviewed and approved for the pre- existing five bedroom duplex on Lot #2. The permittee shall not construct any other type of structure requiring plumbing, including public buildings, duplexes, condominium units, or commercial buildings, without prior review and approval by the Wastewater Management laws and regulations.Such approvals will not be granted unless the proposal conforms to the applicable 6. The Wastewater Management Division now reviews the water supply and wastewater disposal systems for all buildings under 10 V.S.A., Chapter 64 — Potable Water Supply and Wastewater System Permit. 7. This permit shall in no way relieve you of the obligations of Title 10, Chapter 48, Subchapter 4, for the protection of groundwater. 8. A copy of the approved plans and this permit shall remain on the project during all phases of construction and, upon request, shall be made available for inspection by State or local personnel. 9. Lot #1 depicted on the plans and not specifically referenced as being approved for a use requiring a potable water supply and wastewater disposal system shall comply with the Wastewater System and Potable Water Supply Rules for the creation of unimproved lots. WATER SUPPLY & WASTEWATER DISPOSAL 10. The project is authorized to utilize the existing on -site water supply system provided the water is sampled and meets or exceeds potable water standards set forth by the Chapter 21, Water Supply Rules. The Wastewater Management Division shall allow no other means or location of obtaining potable water without prior review and approval. The landowner shall immediately notify the Division if the water supply system fails to function properly and becomes a "failed supply". 11. The well location shall meet all minimum separation distances required by the Environmental Protection Rules, Chapter 21, Water Supply Rule, Appendix A, Part 11— Small Scale Water Systems, Section 11.4. The well shall be constructed in accordance with the Appendix A, Part 12. 12. Lot #2 is authorized to utilize the existing on -site wastewater disposal system provided it is operated at all times in a manner that will not discharge wastewater/effluent onto the ground surface or into the waters of the State. The Wastewater Management Division shall allow no other means or location for the disposal of wastewater without prior review and approval. The Division is to be immediately notified if at any time the wastewater disposal system fails to function properly and/or creates a health hazard. A complying replacement area has been identified on the plans based on a performance based mound system. A permit amendment is required for the final wastewater system design and approval prior to construction of a replacement system. The future wastewater disposal "replacement area" designated on the approved plans shall beheld in reserve for the eventual construction of a replacement wastewater disposal system in the event of the failure of the primary wastewater disposal system. No buildings, roads, water lines, earthwork, re -grading, excavation or other construction that might interfere with the installation or operation of the wastewater disposal systems are allowed on or near the site -specific wastewater disposal system or replacement area depicted on the approved plans. All isolation distances, which are set forth in the Wastewater System and Potable Water Supply Rules, will be incorporated into the construction and installation of the wastewater disposal field. The amendment consists of installing two five-foot high antenna masts on the building, 72 San Remo Drive: Mr. Flanagan said he had no issue with staff comments. Mr. Belair noted that the applicant has asked to be exempt from the bike rack regulations; however, the regulations say "shall," so the Board does not appear to have the right to grant the exemption. Mr. Dinklage said this should be taken up with the Planning Commission. Mr. Belair also noted the 33-foot height includes the antenna and is within the height limit. Continued Public Hearing: Final Plat Application #SP-05-85 of Pizzagalli Properties, LLC, to amend a previously approved 28,000 sq. ft. building with 18,400 sq. ft. of medical office use, 9400 sq. ft. of general office use, and 200 sq. ft. of retail food establishment use. The amendment consists of adding utility cabinets with landscaping,118 Tilley Drive: Mr. Belair noted he had just received the landscaping plan this afternoon. On the second page, they show that the utility cabinets are not screened on 3 sides. He suggested a stipulation that all utility cabinets be screened on 3 sides. Mr. Bouchard said he had no problem with this. Condition #5 was added to the motion as follows: The final plat plan shall be revised to show additional plantings to screen the utility cabinets on three sides and 3 copies of the revised plan shall be submitted prior to recording. Public Hearing: Final Plat application #SD-05-85 of Dorset Street Associates for a two -lot subdivision, 1650 Hinesburg Road: Mr. Belair said staff has no issues. -2- 1. 4* AVELOPMENT REVIEW BOARD r 20 DECEMBER 2005 Mr. Dinklage made it clear that lot #1 is being carved out and has no access. Mr. Belair said there is a condition that the applicant show an access so it is not a landlocked lot. This was shown on the sketch plan but does not appear on the approval plan. Mr. Dinklage noted that the intent is that the piece be connected to the Chittenden property. Mr. Jewett asked to see where the access to the Chittenden property will be. Mr. Belair showed the general area and said the exact location will be determined when the development plan is presented. Mr. Scott commented that this is a beautiful piece of wetland. Mr. Dinklage said it will probably not be developed but will increase the development potential on the rest of the Chittenden property. Ms. Quimby moved to approve Final Plat Plan SD-p05-85 of Dorset Street Associates subject to the stipulations in the draft motion. Mr. Farley seconded. Motion passed unanimously. 8. Sketch plan Application #SD-05-92 of South Village Communities, LLC, to amend a planned unit development master plan consisting of: 1) a 334-unit residential unit traditional neighborhood design to include single-family, two-family and multi -family dwelling units, 2) a 100-student educational facility, and 3) a 35-acre community supported farm. The amendment consists of: 1) eliminating two streets, 2) relocating a street to reduce wetland impacts, and 3) revising the lot layout resulting from the street modifications, 1840 Spear Street: Mr. Marshall reviewed the history of the project and basic project layout. He noted that therehad been 2 crossings of the wetland planned. The Board had spent a lot of time discussing the Midland Avenue crossing, but at the state level (Agency of Natural Resources) there was not much issue with this. They were concerned with the northern- most crossing because of "open water" issues. The applicant was told to have only one crossing. Mr. Marshall said this has resulted in the relocation of some units. In the new plan, two small wetlands will be impacted, but these have not been identified as "critical." Mr. Dinklage asked why this impact can't be avoided. Mr. Marshall said it seemed to be the best way to maintain the design theme. Mr. Rozendaal asked for an explanation of the view restrictions and was told that some houses had been deeded scenic easement and thus, no buildings could be constructed in those restricted areas. Mr. Wessel brought up the question of the scenic turn -out and Mr. Bensen said that Mrs. Nowland did not want it right in front of her house but that there was plenty of room further down the property. Mr. Wessel their asked why the other land was not going to be tubdivided and was told that the reason that some of the land was Ming sold was to give the abuttors a chance to preserve their views. He said that lots 3 & 4 are for this purpose - the intent is not to use them now. At this point, Mr. Paul Southerland, an attorney representing the University of Vermont, asked for more information on the sewage disposal of these lots. He said that the tilt of the land is such that water runs to the UVM Dort Farm and that the soil does not absorb well. He wanted to be sure that sewage disposal on these lots would not effect the growing conditions on the farm. Mr. Bensen replied that in order to build one needed a building permit and that to get one, he needed percolation tests. Discussion on Parkland/Equivalent Fee Policy Mr. Wessel mentioned , the taxing authority, as opposed to the police power, as a basis for requiring new development to "pay its own way". Letters from Dick Spokes and Bruce O'Neill, relating to the policy, were distributed and read. A lengthy discussion followed on the type of recreation lands or facilities that should be sought, a desirable and justifiable ratio of parkland/people, and how and where funds collected under this policy might be spent so as to directly benefit the residents of the new subdivision. With regard to restrictions on the use of fees, Mike Flaherty suggested that a developer might be asked to, sign a waiver on these restrictions, in the event that the fee collected could not be spent for park purposes in the immediate vicinity of .the subdivision. Mr. Page submitted a revised procedure for the Recreation Land/Fee Policy. He was directed to research the amount of "usable" parkland, come up with a ratio of such land/1000 population and to make appro- priate connections to items 1,2, and 4 of the procedure draft dated 3/14/77. As you have been informed, you are in violation of the city zoning ordinances by maintaining a business in a residentially zoned area. You may be able to rectify the situation by applying for a variance. I hope you will make such an application as Section 13.110 of the zoning ordinances provides that anyone who refuses to comply with the provisions of the ordin- ance could pay to the City of South Burlington a fine of up to $10.00 per day for each day of the violation. Mr. Ward informed you of the violation both in March and May of this year. You have had plenty of time to do something about it. As final evidence of the city's patience, I am asking you to apply for a variance by August 1, 1973.
