The amendment consists of converting 3,000 square feet of auto repair and service use to equipment service and repair shop use that includes retail, 6 Gregory Drive, as depicted on a plan entitled "6 Gregory Drive South Burlington, VT" prepared by Paul Nestork, dated 6/2/94, with a stamped received date of 3/26/01, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plan shall be revised to show the changes below and shall require approval of the Director of Planning & Zoning (hereinafter Director). Three (3) copies of the approved revised plan shall be submitted to the Director prior to permit issuance. a) The plan shall be revised to illustrate all parking paces meeting the standards set forth in the Zoning Regulations (i.e., parallel spaces 22 feet in 1--ngth). 3. Any new exterior lighting shall consists of downcasting fixtures. Any change to approved lights shall require approval of the Director prior to installation. Prior to permit issuance, the applicant shall submit exterior lighting details (cut -sheets) for all proposed and existing lights to remain. 4. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Development Review Board estimates that the change in use will generate 1.98 additional vehicle trip ends during the P.M. Peak hour. 5. Pursuant to Section 25.256(b) of the zoning regulations, the Development Review Board approves a 6 space of 23% waiver for a total of 20 spaces approved. 6. DEVELOPMENT REVIEW BOARD MEMO APRIL 17, 2001 MEETING 5) A + PAGING/LINCOLN COMMUNICATIONS — SIGN DESIGN REVIEW APPLICATION, 205 DORSET STREET Design Review Application #DR-01-01 of A+ Paging/Lincoln Communications to amend a previously approved master signage plan. The amendment consists of legitimizing two (2) existing non -conforming signs: 1) one free standing backlit panel sign totaling 12 square feet in size which employs a white background with dark lettering, 2) one wall mounted backlit panel sign totaling 16 square feet in size which employs a white background with dark lettering, 205 Dorset Street. The City Center Design Review Committee reviewed this proposal at their 4/10/01 meeting. The Design Review Committee recommends that the Board deny the application with the following stipulations: 1. This denial of the proposed sign design is based solely on the application's lack of compliance with the design review criteria contained in Section 19(e) and Section 23 of the South Burlington Sign Ordinance. 2. The plan does not identify all non -conforming signs and include a schedule in which these signs will be brought into conformance with the master signage plan and Sign Ordinance. Ai1 non -conforming signs must be identified and a schedule provided for conformance within two years as per Section 23 (h) of the South Burlington Sign Ordinance. These signs were required to be brought into conformance with the sign regulations by 3/23/01. It is bounded on the west by Gregory Drive, on the south by an auto dealership, on the east by an undeveloped lot, and on the north by an auto accessory business. Access: There are currently two ingress and egress curb cuts on the property from Gregory Drive. The southern most point of access is 23 feet in width and leads to a 19 foot access drive. The northern most access drive is 36 feet in width. This second point of access was previously approved by the Planning Commission. No changes are proposed. Circulation on the site is adequate. Coverage/setbacks: The building coverage is 6.8% (maximum 30%) and the total coverage is 25.36% (70% maximum). All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in lighting shall be approved by the City Planner prior to installation. 3. The applicant shall move all vehicles to the designated parking area as shown on the plan. The plan shall be revised prior to issuance of a zoning/building permit to show the change listed below and shall require approval of the City Planner. Staff recommends that this area be grassed as soon as possible and that a decorative type fence (e.g. split rail) or shrub border be installed around this area to prevent this area from being used for outside storage and parking. --- the restaurant has yet to obtain a Certificate of Occupancy. 7) BRUCE BARRY - DRIVEWAY & PARKING REVISIONS - SITE PLAN This project consists of expanding the parking area and adding a driveway to a property being used for auto repair and service. This site was originally approved on 8/13/85 (minutes enclosed). Staff discovered that site changes had been made without Planning Commission approval and requested the owner to restore the site as originally approved or obtain approval for the changes. This property located at 6 Gregory Drive lies within the I-C District. It is bounded on the north by the RIVCO building, on the east by an auto sales and repair business, on the south by an auto sales and repair business and Muddy Brook and on the west by Gregory Drive. Access/circulation: Access is provided via two (2) 36 foot wide curb cuts. The southerly curb cut and driveway were not part of the 1985 approval. Section 19.103a of the zoning regulations states that "unless specifically approved by the Planning Commission there shall be one driveway per lot". The applicant feels that it is necessary to retain the westerly curb cut due to the steep grade at the location of the easterly curb cut. The grade makes it difficult to tow disabled cars into the property without risking additional damages or repairs to the vehicle in tow. Additionally, the grade of the easterly curb cut is at times impassable in the winter due to snow and ice created from run-off from Gregory Drive. Circulation is adequate. 11 Memorandum - Planning June 14, 1994 agenda items June 10, 1994 Page 12 Coverage/setback: Building coverage is 6.8% (maximum allowed is 30%). Overall coverage is 37.5% (maximum allowed is 70%). Front yard coverage is 20.3% (maximum allowed is 30%). Setback requirements are met. Landscaping: There is no minimum landscaping requirement, based on building costs, for this project. The site is well landscaped and no additional landscaping recommended. Parking: This project requires a total of 12 parking spaces and the plan shows a total of 57 spaces including two (2) handicapped Z2k spaces. The site has 24 paved spaces and 33 gravel spaces. The parallel spaces should be 22 feet in length. Staff recommends that the applicant move cars to the designated parking area as shown on the plan and that the proposed grass area be seeded within 60 days of approval. Sewer: No additional sewer allocation needed. Traffic: No additional traffic expected to be generated. Lighting: Existing lighting consists of five (5) building mounted 70 watt high pressure sodium lamps with cutoffs. No additional lighting proposed. Hay bale dams shall be installed as depicted on the plans prior to commencement of construction. The permittees shall prevent the transport of any sediment be- yond that area necessary for construction. From October 1 to April 15 of any calendar year, all non -vegetated dis- turbed areas of the construction site shall be mulched until final vegetative cover is established. All erosion control devices shall be periodically cleaned, replaced, and main- tained until vegetation is permanently established on all slopes and disturbed areas. The Commission reserves the right to schedule hearings and site inspections to review erosion control, and to evaluate and impose additional con- ditions with respect to erosion control, as they deem neces- sary. 10. The permittees shall incorporate all erosion controls set forth in Exhibit #8 in the contract documents for site work and shall submit a copy to the District Environmental Commi- ssion prior to commencement of any site work. 11. The permittees shall apply to the District Commission for approval for any change in the manufacturing processes which would cause noxious or unhealthy emissions into the air or injection of toxic wastes into the soils. 12. All outdoor lighting shall be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view substantially beyond the perimeter of the area to be illuminated. 14. The permittees shall supply sign plans to the District Commission for approval prior to installation of any signs, and shall construct the project in accordance with those plans as approved. The Commission may request a hearing to consider said plans. 15. The permittees shall apply and maintain calcium chloride on all roadways within the project during construction and until paved to control dust. 16. Bechtel, City Planner RE: August 13, 1985 Agenda Items DATE: August 9, 1985 2), ALLEN EXCAVATING, BERARD LOT #6 ETHAN ALLEN DRIVE The applicant proposes to construct a 2904 square foot building for the Allen Excavation business. This is a permitted use. Access and Circulation is provided from a 24 foot wide driveway. A gravel parking area is provided on the western and southern side of the building. Parking seven spaces are required. Four are delineated but the gravel area provides sufficient area. Landscaping A bond for $1500. shall be posted prior to permit. The landscaping,iplan shows a row of 2 to 3 foot cedar trees all along the back and side property lines from the building back. The front area is a lawn with no plantings. This could be improved. Other: See Bill Szymanski and Chief Goddette comments. The septic system does not meet the required set backs from the property lines. This will have to be redesigned prior to permit. Lines should be located to provide for a future street connection. 3). BARRY'S TRANSMISSION, LOT #5 GREGORY INDUSTRIAL PARK The applicant proposes to construct a 6000 square foot building for Barry's Transmission on Lot-K of Gregory and Daughters. The lot is 1.94 acreas (1.89 in South Burlington) and is traversed by a 100 foot power line easement. The remainder of this lot is not a separate building lot. The lot is quite sloped towards Muddy Brook. Access and Circulation; Access is provided through a 20 foot driveway from Gregory Drive. This should be widened and the radii increased. See Goddette and Szymanski comments. Circulation is on three sides of the building. Parking: Sixteen parking spaces are shown. This meets the requirements. The aisles should be increased to 22 feet as required. (They do not scale 22 feet as labelled). Landscaping: The plan meets our requirements; a bond for $2550 must be posted. The plan includes sugar maple and white pine along the front of the lot, and white pine in the back of the building. Yews and euonymus are shown along the building. The parking lot is paved right up to the building -and 100 foot easement on one side. It is not clear if this is a drive-in entrance similar to the northern end. Other: The balance of the lot is not a building lot as stipulated at the subdivision approved. The original subdivision approval allowed 125 trips per peak hour out of this sub- division. To date 64 trips have been projected with 14 at Reprographics, 10 for Rivco, and 40 for Park and Fly.. Ten additional are projected for this lot. The final sub- division approval (April 8, 1980) also stipulated that the traffic conditions be evaluated after the development of the 5th lot and if the conditions are not acceptable after 4 lots are developed, lots 5 and 6 can be withheld until conditions are brought up to par. It was noted that this may involve a significant expense to the City or Mr. Gregory. At this point it is difficult to judge the impact of these lots since they are being developed simultaneously. While the uses project under the maximum, the maximum may be too high for todays Williston Road traffic conditions. 4. MARINE COLLECTIONS, 2073 WILL_ISTON ROAD The applicant proposes to construct a 16,000 square foot boat storage building on the P.J. Auto lot. The Zoning Board granted a multiple use permit for this building, the fourth on this lot. Access and Circulation: Access is proved through the existing paved areas, (including the shared driveway with Brown) to the new boat storage facility. Parking : Parking spaces will not change. Landscaping: A $3750 landscaping bond is required. The proposed plan consists of white pine and juniper but additional landscaping is needed to meet the requirement. Since so much of the property if paved, the few landscaped areas could be enhanced. Others: See Szymanski's and Goddette comments. 5. ONE TWIN OAKS TERRACE The applicant proposes to construct two office buildings with a total of 18,000 square feet on two floors. This received a conditional use permit from the Zoning Board. It is Zoned R7. Circulation and Access: Access is through a 30 foot wide driveway from Twin Oaks Drive. There is circulation on three sides of the buildings. (See Bill Szymanski's comments regarding the driveway). Parkin : This shows 72 spaces as required. Landscaping: A 415,000 landscaping bond is required prior to permit. The plan is sufficient. Other: See Goddette's comments. The 100 foot set back from Potash Brook is maintained as required. This plan will require a sewer allocation of approximately 1200 gallons per day. 6. MILOT, PRE -SKETCH PLAN DISCIJSSION Jerry Milot would like to discuss his commerical development plan for the Fayette Property on Shelburne Road. The major concerns are: 1. PLANNING COMMISSION APRIL 8, 1980 The South Burlington Planning Commission held a meeting on Tuesday, April 8, 1980 at 7:30 pm in the Conference Room, City Hall, 1175 Williston Road Memb rs Present Sidney Poger, Chairman; George Mona, Peter Jacob, Robert Walsh, Kirk Woolery, James Ewing Member Absent Ernest Levesque Others Present David Spitz, Planner; Robert Krebs, Meg Lukens, Dave Nicholson, C.W. Gregory Minutes of April 1, 1980 Mr. Mona noted that at the last meeting, he had wanted the words "and noted on the plan of record" added to the second stipulation of the University Mall approval. Although the same phrase was not at that time added also to the first stipulation, Mr. Mona felt it had been the intent of the Commission that the phrase apply.also to the City Planner in stipulation 1. The Commission agreed that that had been their intent, and the words %nd noted on the plan of record" should be added after "City Planner" in stipulation 1 on page 2. Mr. Woolery moved to improve the April 1, 1980 minutes as amended, Mr. Jacob seconded, and all voted aye. Final plat application of Gregory and Daughters for a 6-lot industrial subdivision on a new street to be called Gregory Drive off Williston Road Mr. Robert Krebs said the plan was relatively unchanged from the last meeting. City Manager Szymanski's requests have been incorporated into the plan. Water and sewer will be provided for all 6 lots and a new right turn lane will be added on Williston Road. The state has reviewed the plan, as has Traffic Engineering Associates (see attached copy of that report. The maximum amount of traffic anticipated at this intersection is 9% of its total capacity, Mr. Krebs told the commission. A sign prohibiting left turns out of the development will be posted. Mr. Mona felt that would be totally unenforceable. It was noted that a large truck could go straight into the street opposite this development in case of an emergency (a car coming over the hill while the truck blocked several lanes. It was felt that No Left Turn signs would be ignored. The possibility of a traffic light at the intersection was discussed. Mr. Krebs stated that if a truck did try to go left up the hill and another car came down the hill, that car could go into the new right turn lane to avoid the truck. It was noted that more vehicles would go toward Burlington than Williston. It was suggested that, at a later time, if there appeared to be a problem here, a light could be studied. Noting that it might be dangerous to have a light on this hill, the commission suggested cutting down the hill, or putting the light at the top of the hill and having it tripped by exiting trucks. Mr. Krebs noted that there would be a flashing light 750' before the intersection, and Kr. Gregory added that someday there would be a road for trucks to exit from the development to the rear to Shunpike Road, Kimball Avenue, and then to Kennedy Drive. PLANNING COMMISSIGN `--�' L APRIL 8, 1980 The commission liked that idea. Mr. Poger found Traffic Engineering Associates' report confusing. It stated there might be 3,25 vehicles for this development at the peak hour, and Mr. Poger felt that was a very high figure. He also wanted to know what the Associates would say about the intersection given the possibility that cars would come over the hill, not at the posted 40 mph speed, but at 45 or 50mph. He wanted to know how fast a car could come over the hill and still have good sight -distance. Air. Poger suggested reviewing traffic again after a few of these lots had been developed. Mr. Gregory said Green Mountain Power had given permission to move its poles if he needs more room to build on lot 4. PLANNING COPMISSION APRIL 8, 1980 8. Bonding for all public improvements shall be arranged prior to the_ issuance of the first building permit for the subdivision The statement "easements and roads to be dedicated as required" on page 1 of 4 shall be deleted. 9- The final plat shall be recorded within 90 days 10. The City Planner shall review the traffic resulting from this industrial park after the development of 4 lots and report his findings to the Planning Commission. -- Mir. Ewing seconded the motion. The Commission requested that the stop line for exiting traffic from the development be moved closer to the road so exiting cars could see if traffic was coming down the hill. It was noted that, if the Commission did not find the traffic conditions"14 acceptable after 4 lots are developed, at the site reviews of lots 5 and 6 approval could be withheld until the conditions are brought up to par. That may involve some expense to the city or Mr. Gregory. The motion carried without dissent. Since neither the applicant, nor the neighbors, who had been told that there would be a postponement of the hearing , were present, Mr. Spitz did not feel the Commission should have a lengthy discussion of the item. He told the board that the two questions raised at previous meetings had been answered by the City Attorney, in his 2/7 memo. The Commission noted that the letter stated that the entire PUD should be reviewed anew if the alterations would have a significant adverse effect on the character of the PUD, and if the Commission could articulate the ways in which it would do this. Discussion centered on the meaning of the word "character" in this case. The residents of the area feel that the alteration would profoundly affect the character of the area. Mr. Mona felt the concern of the residents was for what the new units would do to those already there. Mr. Walsh felt that the Commission should review the plan with a view to conserving the value of the existing buildings, because he felt that was the intent of the statutes (Vermont Planning and Development Act). Mr. Jacob felt that if the residents had complaints, their recourse was to the courts, particularly if what had been represented to them was being violated. The Commission discussed whether the proposed change was drastic or not. Mr. Woolery had some concerns about allowing units in phase 2 to be constructed before phase 1 was completed. The Commission, if it approved the.change for phase 2, did not want to have units in phase 1 altered. Ns. Mona did not want to approve any change unless he had a clear picture of what would happen to the units other than in cluster J, in both phase 1 and 2. Mr. Spitz felt this discussion should continue when the applicant and neighbors were present, but Xr. Mona felt that no decision would be made tonight and Messrs. Jacob and Ewing felt this discussion was to help them straighten things out in their own minds.
