HomeMy WebLinkAboutSP-17-42 - Decision - 0007 Fayette Road#SP-17-42 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING WOW SOUTH BURLINGTON - 7 FAYETTE ROAD SITE PLAN APPLICATION #SP-17-38 FINDINGS OF FACT AND DECISION WOW South Burlington, hereinafter referred to as the applicant is seeking after -the -fact approval to amend a previously approved plan for a mixed use and multi -building complex. The amendment consists of converting 2,677 sq. ft. of tavern/night club use to a standard restaurant use, 7 Fayette Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking after -the -fact approval to amend a previously approved plan for a mixed use and multi -building complex. The amendment consists of converting 2,677 sq. ft. of tavern/night club use to a standard restaurant use, 7 Fayette Road. 2. The owner of record of the subject property is 7 Fayette, LLC. 3. The subject property is located in the Commercial 1 —Automobile Zoning District. 4. The application was received on June 22, 2017. 5. The restaurant will have 96 seats. 6. The plan submitted is titled, "C.H. Partners, Inc. 7 Fayette Road PUD South Burlington, VT Overall Site Plan", prepared by Lamoureux & Dickinson Consulting Engineers, Inc., dated 3/31/14 and last revised on 5/23/17. DIMENSIONAL REQUIREMENTS 7. No coverage changes proposed. 8. Setback requirements are being met. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. Parking 9. The applicant submitted a shared parking analysis prepared by Lamoreux & Dickinson dated May 23, 2017. Their analysis, inclusive of all existing uses and the use proposed - 1 - #SP-17-42 herein, indicate a peak parking demand of 634 spaces which is a 23% waiver and essentially the same waiver as with the last approval. A total of 490 spaces will be available. Traffic 10. The change in use will result in a reduction in estimated traffic. Bike Rack 11. The applicant will be required to comply with Section 13.14 of the LDRs which requires that the bike rack for the building be the `inverted U style or as shown as acceptable in Appendix G. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-17-42 of WOW South Burlington, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Administrative Officer estimates that the change in use will generate zero (0) additional vehicle trip ends during the P.M. peak hour. 4. Prior to the issuance of the Certificate of Occupancy, the applicant must replace the existing bike rack with one that complies with Section 13.14 of the LDRs to be the `inverted U style or as shown as acceptable in Appendix G. 4. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use of the newly converted space. 6. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
