The two red maples were planted about the same time the building was completed. They are grown taller than the garage structure and are doing well. 2. We have moved equipment out of the dumpster enclosure and replaced the dumpster within it. 3. The bike rack was moved during the winter months to facilitate plowing. I found the following discrepancies between the approved site plan and the site: 1. The two (2) Red Maple trees that were required to be planted to the west of the garage were not planted. 2. The dumpsters are not located within the dumpster enclosure. 3. The bike rack shown on the approved plan is missing from the site. I am required to act on your request within 30 days, so unless you have brought the property into compliance by May 6, 2015, I will have to deny your application. On the 9' day of April, the Director of Planning & Zoning approved the site plan application of S&N Properties, LLC under Section 26.10(b) of the South Burlington Zoning Regulations, based on the following findings: 1. This project consists of a site plan application to amend site plan #SP-01- 61 to add a 288 f;F garage for storage and two Red Maple trees at the northeast corner of the existing building at 90 Ethan Allen Drive. The plans note the garage will have an overhead door on the south fagade opening into the parking lot. 2. The owner of record is S&N Properties, LLC. 3. This property is located within the IC -Mixed Industrial Commercial District. 4. Access, circulation and parking: No changes to access, parking and ,circulation will result. 5. ;Coverage/setbacks: The proposed garage will add 288 SF of building coverage on the site. This brings the total building coverage to 12.2% (30% allowed) and total site coverage to 37.6% (70% allowed). The east side of the garage is 24 feet from the side yard line, which exceeds the required setback of 15 feet. All setbacks are met. 6. Landscaping. The proposed amendment will add two Red Maple trees between the proposed garage and the stormwater detention pond. By acceptance of the conditions of this permit without appeal, the Permittee confirms and agrees that the conditions of this permit shall run with the land and the land uses herein permitted, and will be binding upon and enforceable against the Permittee and all assigns and successors in interest. 10. The project is approved for the following maximum impacts: 21 - vehicle parking spaces 300 gallons per day of water and wastewater; 85 - vehicle trips per day; 12 - AM peak hour vehicle trips; and 12-- PM peak hour trips. 11. This permit hereby incorporates all of the conditions of the following Agency of Natural Resources Permits: Water Supply and Wastewater Disposal Permit #WW-4-1543 issued on August 13, 2001 by the Wastewater Management Division; and Final Discharge Permit 1-1492 issued on August 29, 2001 by the Wastewater Management Division Any subsequent nonmaterial changes to these permits shall be automatically incorporated herein upon issuance by the Agency of Natural Resources. Subsequent amendments involving material changes to the Act 250 permit shall not be constructed prior to review and approval of the District Coordinator or the District Commission under applicable Environmental Board Rules. Land Use Permit #4C0643-20 Page 3 12. The Permittee shall apply and maintain calcium chloride and/or water on all roadways or disturbed areas within the project during construction and until pavement and/or vegetation is fully established to control dust. 13. Immediately upon initial roadway clearing, a stabilized construction entrance must be installed and maintained as shown on Exhibit 19 (Sheet # 1). This entrance must be constructed and maintained in accordance with the specifications as described in the Vermont Handbookfor Soil Erosion and Sediment Control on Construction Sites (1987). 14. There shall be no floor drains installed at the facility without first acquiring the required Underground Injection Control Permit from the Water Quality Division of the Agency of Natural Resources. 15. The Permittee and all subsequent owners or lessees shall install and maintain only low -flow plumbing fixtures in any buildings. Any failed water conservation measures shall be promptly replaced with products of equal or better performance.. 16. Pursuant to Condition #11 of LUP #4C0643, no construction is permitte beyond the top of bank and during construction, the exisitng fence shall remain in place. 17. The Permittee shall comply with Exhibit 19 and for erosion control. The Permittee shall prevent the transport of any sediment beyond that area necessary for construction approved herein. All erosion control devices shall be periodically cleaned, replaced and maintained until vegetation is permanently established on all slopes and disturbed areas. The Commission reserves the right to schedule hearings and site inspections to review erosion control and to evaluate and impose additional conditions with respect to erosion control as it deems necessary. 18. All mulch, hay bales, siltation dams, water bars and other temporary devices shall be installed immediately upon grading and shall be maintained until all roads are permanently surfaced and all permanent vegetation is established on all slopes and disturbed areas. Hay bales shall be incorporated four inches into the soil and equipped with filter fence on the upstream side, butted together and all joints filled with loose hay. Topsoil stockpiles shall have the exposed earth completely mulched and have siltation checks around the base. 19. Grading shall be phased so that all exposed earth is mulched and water bars are in place at the end of each construction day. 20. All disturbed areas of the site shall be stabilized, seeded and mulched immediately upon completion of final grading. All disturbed areas not involved in winter construction shall be mulched and seeded before October 1. Between the periods of October 1 to April 15, all earth disturbing work shall conform with the "Winter Construction" standards and specifications of the Vermont Handbook for Soil Erosion and Sediment Control on Construction Sites (1987). 21. Prior to construction of the approved work, the Permittee shall complete the following: a) construction limits shall be clearly delineated with flagging or snowfencing; b) diversion ditches shall be placed on the uphill limits of the construction area; and c) temporary siltation controls shall be placed on the downhill limits of the construction. Immediately following the above, the Land Use Permit #4C0643-20 Page 4 permanent drainage system and/or roads shall be installed after which normal construction can begin. 22. A copy of the approved erosion control plan shall be on the site at all times during construction. 23. In addition to conformance with all erosion control conditions, the Permittee shall not cause, permit or allow the discharge of waste material into any surface waters. Compliance with the requirements of this condition does not absolve the permittee from compliance with 10 V.S.A. §§ 1250-1284, Vermont's Water Pollution Control Law. 24. The Permittee and all assigns and successors in interest shall continually maintain the landscaping as approved in Exhibit #19 by replacing any dead or diseased plantings within the season or as soon as possible after the ground thaws, whichever is sooner. 25. The installation of exterior light fixtures is limited to those approved in Exhibit #11, and shall be mounted no higher than (20) feet above grade level. All exterior lighting shall be installed or shielded in such a manner as to conceal light sources and reflector surfaces*from view beyond the perimeter of the area to be illuminated. 26. The Permittee shall not erect exterior signage without first obtaining approval from the District Commission. Signage includes banners, flags, and other advertising displays, excepting temporary real estate marketing signs. 27. There shall be no floor drains installed at the facility without first acquiring the required Underground Injection Control Permit from the Water Quality Division of the Agency of Natural Resources. 28. The project shall conform with the Vermont Consolidated Act 250 Energy Guidelines for Typical Commercial and Industrial Buildings promulgated by the Vermont Department of Public Service. In addition to meeting the above referenced guidelines, the Permittee shall incorporate any additional energy efficiency measures that are determined by custom analysis to be cost effective for the project. 29. The installation and/or use of electric resistance space heat is specifically prohibited without the prior written approval of the District Environmental Commission. 30. Should the town at any time agree to accept any private utilities being then operated by the Permittee and/or assigns and successors in interest, the Permittee and/or assigns and successors in interest shall be responsible to improve the same to Town specifications and shall deed all lands involved with said improvements to the Town. Such improvements may require a land use permit amendment. 31. At the completion of the project, and prior to the occupancy of the building, the Permittee shall certify by affidavit that the site improvements have been constructed in accordance with this permit pursuant to Environmental Board Rule 32(A). 32. No further subdivision, alteration, and/or development of any parcel of land approved herein shall be permitted without the written approval of the District Commission. Land Use Permit #4C0643-20 Page 5 33. The Permittee shall reference the requirements and conditions imposed by Land Use Permit #4C0643-20 in all deeds of conveyance and leases. 34. Pursuant to 10 V.S.A. § 6090(b) this permit amendment is hereby issued for an indefinite term, as long as there is compliance with the conditions herein. Notwithstanding any other provision herein, this permit shall expire two years from the date of issuance if the Permittee has not commenced construction and made substantial progress toward completion within the two-year period in accordance with 10 V.S.A. § 6091(b). 35. Mrs. Maher seconded the motion and it carried unanimously. of industrial subdivision with new Mr. Belter removed himself from the discussion due to a conflict of interest. Mr. Spitz said everything was the same except that the soil tests had been done and had turned out very well. It was noted that the land dedication question had been worked out with the City Manager, itilr. Belter said he hoped that when and if they ever came back for more lots he hoped the issue would not come up again. He felt he had made his contribution to fixing the road. Mrs. Hurd pointed out that whenever a developer comes before the Commission, they always try to get as much as they can. Mr. Belter said he would like to pay for the improvements to the road on a per lot basis and the Commission agreed, if it were paid after the first 3 or 4 lots. 5 was agreed to. Mr. Dooley had a motion. He moved that the South Burlington Planning Commission approve the final plat application of John Belter for the 13 lot industrial subdivision as depicted on a plan entitled "Ethan Allen Farm, Industrial Subdivision Lots 9-21" as prepared by Warren A. Robenstien, dated May 1985, with the following stipulations: 1. The drainage easement along the eastern part of the subdivision shall be extended to the drainage ditch along the back line of the lots;. 2. On -site sewage disposal systems for each lot shall be installed in the front yards so that connection to a future sewer main in Ethan Allen Drive is possible. 3. A 5.25 foot strip of land on either side of Ethan Allen Drive shall be dedicated to the City for future street widening. 4. PLANNING COMMISSION JUNE 25, 1985 4. The land at the intersection of Shamrock Road and Airport Parkway shall be d6dicated to the City for intersection straightening. 5. The sum of $1000 shall be paid prior to each of the first 5 building permits for the improvements to Ethan Allen Drive. 6. Final plat application of LTH, Inc.. for the Planned Commercial development for a200 unit hotel and existing restaurant located on the Benes Inn lot and lot #10 of the LTH properties, at 1710 Shelburne Road Mr. Belter rejoined the Commission. Ms. Bechtel noted that this plan would provide for better fire protection. It was noted that the hydrological study had just been received tonight. Ms. Bechtel said she could summarize it. Data put through the computer model showed that a retention pond was needed, and a 44,000 gallon size had been recommended. It was also found that this area is close to the drainageway, so the peak runoff time for its drainage will come before the peak runoff from the Spear Street area gets to this part of the drainage ditch. Mr. Krebs said Mr. Larkin had agreed to put in a pond, even though they do not feel it is needed. Mr. Dooley wondered whether, if the drainage in this area were slowed through the retention pond, it would then be released when the peak upstream drainage passed by, thus increasing the problem. Ms. Bechtel said she would ask the consultants. Mr. Krebs said they would install a series of catch -basins and would plan on flooding the parking lots as a way to slow drainage discharge. They are not planning on one large pond. Mr. Belter asked whether the study covered just the area planned for development, or the whole area. Mr. Dooley said he did not want to see 200 units with access only to Shelburne Road. He noted that this plan did not show lot 10, through which the secondary access will pass. Mr. Larkin said they would build that road. Mrs. Hurd noted that the Fire Chief had told the Commission that he could not guarantee protection to something this large this far from the station. :4r. Jacob noted that the city had mutual protection and aid with .helburne, and he said that the Council was looking into land for a station on Shelburne Road. Ys. Bechtel said revised landscaping plans were needed. Mr. Scott Tower of 4 Seasons went over the landscaping plans. Mrs. Maher wanted the Planner to carefully review the landscaping plans. Ms. Bechtel said this was the first she had seen of it but she would verify the worth. Mr. Reg Boucher said he was the president of the Bartletts Bay Association and he asked about the drainage report. He asked for a copy and said he would like to review it before final approval was given. The Commission said they might like to talk to the consultants about the report and Mr. Jacob wanted the City Engineer's comments on it. It would be a multi -tenant facility. The plan complies with setback and parking regulations and with landscaping requirements. They had hoped to extend the building beyond the edge of the bank, but Act 250 will not allow this. Mr. Goodrich showed the location of dumpsters. Mr. Weith expressed concern with lighting over the doors as they are not fully shielded fixtures. Mr. PLANNING COMMISSION 29 JUNE 1999 Goodrich said they arc partly shielded, and there is no place for light to go that would affect anyone. Mr. Weith said they are at capacity for sewer allocation and if the applicant loses this, the capacity would go to Mr. Larkin's extended stay hotel. Members had no problem with this. Mr. O'Rourke moved the Planning Commission approve the final plat application of L&M Partnership t amend a condition of approval granted on 10/13/98 for a planned residential development consisting of 80 single family lots, Pinnacle A Spear, Spear Street. The amendment is to extend, by two years, the date by which the roadways serving the development must be completed, which will in turn extend, by two years, the approved reserved sewer allocation for the development. This approval is based on the following stipulation: Condition #6 of the 10/13/98 approval shall be revised to read as follows: "The Commission approves a total sewer allocation of 50,576 ayd for this development. The length of time that this sewer allocation approval shall remain in effect shall be tied to roadway construction. The sewer allocation for any lots served by roadways which are not completed by 12/21/00 shall be lost unless reapproved by the Planning Commission. Ms. Barone seconded. Motion passed unanimously. 6.
