HomeMy WebLinkAboutSD-09-28 - Decision - 0350 Dorset Heights#SD-09-28 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING CHERYL BRAYMAN - 350 DORSET HEIGHTS FINAL PLAT APPLICATION #SD-09-28 FINDINGS OF FACT AND DECISION Cheryl Brayman, hereafter referred to as the applicant, is seeking final plat approval to amend a previously approved plan for a five (5) lot subdivision. The amendment consists of revising condition #16 of #SD-07-25, approved on 6/8/2007 requiring that all new houses be sprinklered such that it will not apply to lot #1, 350 Dorset Heights. The Development Review Board held a public hearing on July 7,2009. Scott Brayman represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking final plat approval to amend a previously approved plan for a five (5) lot subdivision. The amendment consists of revising condition #16 of #SD-07-25, approved on 6/8/2007 requiring that all new houses be sprinklered such that it will not apply to lot #1, 350 Dorset Heights. 2. The owners of record of the subject property are Scott T. Brayman and Cheryl V. Brayman. 3. The application was received on 6/15/2009. 4. The subject property is located in the Neighborhood Residential Zoning District in the Southeast Quadrant. 5. Lot 1 was approved as part of a larger subdivision which included a private road. Per the South Burlington Land Development Regulations and the advice of the South Burlington Fire Chief, all homes accessed via private roads shall be sprinklered. As such, the condition included in the Decision for the subject PUD stated that all lots shall be sprinklered. 6. Lot 1 is actually accessed via a driveway that connects not to the private road, but to the public cul-de-sac. 7. All previous approvals and stipulations shall remain in full effect except as amended herein. 2. This project shall be completed as shown on the plat submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. Condition #16 of subdivision approval #SD-07-25 is hereby amended to not require a sprinkler system for the house at 350 Dorset Heights.
