HomeMy WebLinkAboutDR-05-06 - Decision - 0359 Dorset StreetCITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING & ZONING DEVELOPMENT REVIEW BOARD DESIGN REVIEW APPLICATION #DR-05-06 NEIL & BARBARA SHEPARD- 359 DORSET STREET FINDINGS OF FACT AND DECISION Neil and Barbara Shepard, hereafter referred to as the applicant, are seeking design review approval for a master sign permit for a freestanding sign for the property located at 359 Dorset Street in the Dorset Street/ City Center Sign District. The master signage permit would also establish the design scheme for future tenants. The Design Review Committee voted to support this application with conditions at their meeting on October 24, 2005. The Development Review Board held a public meeting on November 1, 2005. Neil and Barbara Shepard represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking master sign approval for the property located at 359 Dorset Street. 2. The property is located in the Central District 2 (CD2) zoning district. 3. The owners of record of the subject property are Neil and Barbara Shepard. 4. The applicant has submitted renderings of the sign. Design plans for properties within Design District 2 shall comply with the following design criteria as outlined in Section 11.01(F) of the South Burlington Land Development Regulations (SBLDR): (a) Consistent Design The design of a sign must be compatible and harmonious with the design of buildings on the subject property and nearby. The design of all signs on a property shall promote consistency in terms of color, graphic style, lighting, location, material and proportions. The Development Review Board finds that the proposed signs are compatible with the existing building and the surrounding buildings. The freestanding signs will be constructed of aluminum. The signs shall be no greater than 32" in width and 40" in height. The proposed sign is harmonious with other signs in the district and is consistent with the color of the building. The applicant has proposed shielded and downcast lighting for the freestanding signs. The proposed lighting is in accordance with acceptable lighting as defined in the South Burlington Land Development Regulations. The location of the sign is appropriately proposed to be outside of the city right-of-way and within the 16 foot sign corridor as established in the SBLDR. (b) Promotion of City Center Goals Signs within the DS/CC Sign District should be of high aesthetic quality and pedestrian oriented. The proposed signage is in compliance with this requirement. Graphics appear to be legible and aesthetically pleasing. (c) Color & Texture The color of the background of the sign shall be a shade of off-white or tan. The lettering shall be a shade of brown and shall be darker than the background. White lettering shall be allowed for the street number only. The logos or graphics used shall be limited to shades of blue, red, and yellow. The standard in Section 6(b)(3) states that, "The use of a maximum of three (3) predominant colors is encouraged to provide consistent foreground, text, and background color schemes." While the applicant has proposed a combination of four colors, the predominant colors will be limited to shades of brown. The color of the background of the sign shall be a shade of off-white or tan. The lettering shall be a shade of brown and shall be darker than the background. White lettering shall be allowed for the street number only. The predominant colors used for logos or graphics shall be limited to shades of blue, red, and yellow. Graphics depicting the American Flag, war flags or ribbons, or other such flags shall be exempt from color restrictions. Any graphics used shall be smaller in size than the name of the business. (d) Materials Used Pursuant to Section 20 of the Sign Ordinance, all signs shall be of substantial and sturdy construction, kept in good repair, and painted or cleaned as necessary to maintain a clean, safe, and orderly appearance. The Development Review Board finds that the proposed signs are compatible with the existing building and the surrounding buildings. The freestanding signs will be constructed of aluminum. (e) Wall Mounted Signs Section 10 of the Sign Ordinance governs the size and location of wall -mounted signs. No wall mounted signs are proposed as part of this application. (0 Freestanding Signs Section 9(h) states that free-standing signs along Dorset Street are to be located in a sign corridor that begins adjacent to the road Right -of -Way and runs sixteen (16) feet from the edge of the Right of Way toward the building face. In those instances where dimensions do not provide for a two (2) foot setback from the Right -of -Way before a sign support post can be located, it is permitted to erect a centered single pole mounted sign of which the road side edge of the sign is directly outside the R.O.W. line. The proposed signs are in compliance with this requirement Section 9(h) states that free-standing signs in the Dorset Street/City Center District may not exceed thirty-two (32) square feet in overall dimensions and may be no higher than twelve (12) feet, measured from the average finished grade at the base of the sign to the highest point of any part of the sign structure. The proposed signs are in compliance with this requirement. The proposed signs are less than (twelve) 12 square feet and stand at a height of (ten) 10 feet. This project shall be completed as shown on the plans submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. Individual sign permits shall be in compliance with the Master Signage Permit. 4. The colors of the free standing signs shall be limited to backgrounds of off-white or tan. The lettering shall be limited to shades of brown; graphics shall be limited to shades of blue, red, and yellow and shall be smaller in size than the name of the business. Graphics depicting the American Flag, war flags or ribbons, or other such flags shall be exempt from color restrictions. All signs shall be kept in good repair; landscaping surrounding the freestanding signs shall be kept trimmed and neat and shall not obscure the text of the signs.
