HomeMy WebLinkAboutSP-16-00 - Decision - 0165 Dorset Street#SP-16-00 FINDINGS OF FACT STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Bettina Laidley to convert 175 square feet of a 1200 square foot building from medical office to a general office, 165 Dorset Street. On the 4th day of April, 2000 the South Burlington Director of Planning & Zoning approved the request of Bettina Laidley for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of converting 175 square feet of a 1200 square foot building from medical office use to general office use. 2. The owner of record is Theresa Paquette. 3. This property located at 165 Dorset Street lies within the C 1 District. It is bounded on the north, south and west by U-Mall parking and on the east by Dorset Street. 4. Access/circulation: Access is provided by a curb cut on Dorset Street and a rear access to the U- Mall parking area. Circulation on the site is acceptable. 5. Coverage/setbacks: Building coverage is 12.5% (maximum allowed is 30%). Overall coverage is 58% (maximum allowed is 70%). Front yard coverage is 19.5% (maximum allowed is 30%). 6. The existing building does not meet the front and side yard setback requirements. Improvements to the building are subject to the limitations in Section 26.002 of the zoning regulations. 7. Parking: A total of eight (8) spaces are required and eight (8) spaces are provided including one (1) handicapped space and a bike rack. Landscaping_ The minimum landscaping requirement, based on building costs, is zero (0). 9. Traffic: ITE estimates that the existing use generates .68 vehicle trip ends (vte's) during the P.M. peak hour and the proposed use to generate .26 vte's. This represents a .51 vte decrease. The applicant was made aware that the road impact fee is zero (0). 10. Sewer: No additional sewer allocation needed. 11. Dumpster: No dumpster will be used. 12. Lighting_ No additional exterior lights proposed. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Director of Planning & Zoning approves the site plan application of Bettina Laidley to convert 175 square feet of a 1200 square foot building from medical office use to general office use, 165 Dorset Street, as depicted on a plan entitled, "165 Dorset Street South Burlington," prepared by Mark Thibeault, dated 2/2/98, revised 4/ 15/98 with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Director of Planning & Zoning estimates that the change in use will generate zero (0) additional vehicle trip ends during the P.M. peak hour. 3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 4. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the new medical office. 5.
