HomeMy WebLinkAboutSP-90-0000 - Decision - 0001 0003 0005 Dorset StreetFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN 5 p_ go_ 0000 CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Merlin Associates for construction of a 362 square feet addition to the lobby/check-out area and enclosure of a court yard to create 587 square feet of new office space, Howard Johnson's Dorset Street. On the 7th of August 1990, the South Burlington Planning Commis- sion approved the above referenced site plan under Section 19.10 of the South Burlington Zoning Regulations based upon the follow- ing findings: 1. This project involves removing an existing nonconforming canopy and addition of 362 square feet of lobby space. The project also involves the closing of court yard space for office use (587 square feet). This addition will be one floor with a 10' maximum height. The property is zoned Commercial 1. 2. The court yard space to be enclosed will be used for enlarg- ing existing office and staff meeting space. 3. Access/Circulation: Access will remain via one 40' and one 30' curb cut. Circulation is not affected by this project. 4. Setbacks/Coverage: The front yard setback along the planned Dorset Street right of way is currently not met. Total coverage allowed is 70%, the plan shows 52% coverage. The existing front yard coverage is 58% while maximum allowed is 30`/0. 5. Parking: This project would add 7 new spaces although no new parking spaces are required. The proposed spaces will remove some existing mature trees. The City bases its requirement of parking spaces on number of rooms and number of employees. There will be no increase in the number of rooms or employees associat- ed with this addition. 6. Traffic: The ITE trip generation for hotels is based on the number of rooms. Since there are no new rooms to be added there will be no new trips generated by these additions. 7. Landscaping: According to the plans all landscaping to be affected by this project will be relocated. New landscaping worth $6,690 is required (3% of $223,000). Proposed landscaping is valued at $650. The landscaping associated with the Howard Johnson's Restaurant expansion (9/26/89) has not been completed. The juniper that were to have been relocated are not. planted. The new plantings (2 red bayberry) have not been put in either. 8. Building Height: The addition would be a maximum of 10'. l 9. The applicant expressed that they no longer plan to enclose the courtyard, therefore, they no longer request approval for the courtyard enclosure. DECISION AND CONDITIONS Based upon the above findings the Planning Commission approved the Site Plan application of Merlin Associates for construction of a 362 square foot addition to the lobby/check-in area as shown on a 5-page set of plans, page one entitled "Howard Johnson's Gate Lodge renovations, South Burlington, Vermont," prepared by CS Architecture and Construction and dated 5/20/90 (page 2) with the following stipulations: 1. A 3-year landscaping bond in an amount to be determined by the City Planner not to exceed $5000 shall be posted prior to permit. A revised plan showing a pine screen along the inter- state ramp shall be submitted and approved by the Planner. 2. Based on the express representation of the applicant, lighting shall be located so long as the source is not visible beyond the property lines. 3. The plan shall be revised prior to permit to show the pro- posed 7 space parking expansion omitted in order to preserve the mature pine trees in that area. The revised plan shall be sub- mitted to the City Planner for approval. 4. The building permit shall be obtained within 6 months or this approval is null and void. 5. The plan shall be revised to no longer indicate enclosure of the courtyard. 6. The landscaping shown on the plan from the previous approval of the Howard Johnson's Restaurant expansion (9/26/89) shall be installed before issuance of a building permit.
