HomeMy WebLinkAboutSD-00-71 - Decision - 0001 0003 0005 Dorset Street#SD-00-71 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY CHITTENDEN CITY OF SOUTH BURLINGTON Re: Final plat application #SD-00-71 of John Larkin to amend a planned unit development consisting of: 1) an 89 room hotel building, 2) a 71 room hotel building, and 3) a 275 seat restaurant. The amendment consists of: 1) landscape modifications, and 2) designating 15 parking spaces for future expansion, 1 Dorset Street. On the 16t' day of January, 2001, the South Burlington Development Review Board approved the final plat application of John Larkin under Section 204 of the Subdivision Regulations based on the following findings: 1. This project consists of amending a planned unit development consisting of: 1) an 89 room hotel building, 2) a 71 room hotel building, and 3) a 275 seat restaurant. The amendment consists of: 1) landscaping modifications, and 2) designating 15 parking spaces for future expansion, 1 Dorset Street. 2. The applicant was required to remove the cedar hedge in question and construct the 15 spaces as part of the latest approval. The applicant chose to modify the site plan without DRB approval and not construct the 15 space. The applicant is coming before the Board with an "as -built" plan seeking approval. 3. The owner of record is John Larkin. 4. Coverage/setbacks: Phase 1: Building coverage will be 21.8% (maximum allowed is 30%). Overall coverage is slightly less than previously approved (64.6%) at 63.8% (maximum allowed is 70%. Front yard coverage on Dorset Street is unchanged at 55.4% (the applicant previously reduced the front yard coverage from 67.4% to 55.4% which is still above the maximum allowed 30%). The Williston Road front yard coverage will also remain unchanged at 89% (30% maximum) and will not be made worse by this request. The plan notes should be revised to include coverages for Phase Two. 5. Landscaping: The applicant proposed retaining an existing hedge along the University Mall boundary. A previous approval for this property allowed the applicant to remove the hedge and construct 15 parking spaces if a similar 8 foot to 10 foot high r evergreen hedge along the property boundary was constructed provide screening between the two properties. The applicant wishes to retain these 15 parking spaces as future parking spaces. Staff recommended that the same requirements be used so that if the hedge is removed and the spaces are constructed a similar 8 foot to 10 foot high evergreen hedge is constructed along the property boundary to screen the two properties. The site plan should be revised to show these 15 spaces and a note be added that they are to be constructed in the future if deemed necessary. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Review Board approves final plat application #SD-00-71 of John Larkin to amend a planned unit development consisting of: 1) an 89 room hotel building, 2) a 71 room hotel building, and 3) a 275 seat restaurant. The amendment consists of: 1) landscaping modifications, and 2) designating 15 parking spaces for future expansion, 1 Dorset Street, as depicted on a two (2) page set of plans, page one (1) entitled, "'Howard Johnson's South Burlington Vermont," prepared by Llewellyn - Howley, Inc., dated 7/13/99, last revised on 12/8/00, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plat plans shall be revised to show the changes listed below and shall require approval of the Director of Planning & Zoning (hereinafter Director). Three (3) copies of the approved revised site plans shall be submitted to the Director prior to permit issuance. a) The plans shall be revised to show the 15 parking spaces and a note added that they are to be constructed in the future if necessary. 3. Any change to the final plat plans shall require approval by the South Burlington Development Review Board. 4. The final plat plan (sheet 2 of 7) shall be recorded within 90 days or this approval is null and void.
