Picard, City Clerk WHEREAS, on December 13, 1983 the City of South Burlington Planning Commission granted final plat approval for a 2 lot subdivision, as depicted on a plat entitled "Property Survey and Subdivision for James and Dorothy Hardy #350-354 White Street, South Burlington, Vermont prepared by Palmer Company Ltd, dated October 31, 1983 last revised December 1, 1983 (the "Plat"), which approval was not appealed and became final; and WHEREAS, said Plat was recorded on December 27, 1983 in Map Volume 197 at Page 15 of the City of South Burlington Land Records; and WHEREAS, said Plat was not stamped and/or otherwise endorsed by the City of South Burlington Planning Commission at or prior to the date of its recording; and WHEREAS, the lot depicted as 350 White Street on said Plat has since been conveyed to William Mitchell and Jennifer Mercier, and White Street, also depicted thereon, has been accepted by the City of South Burlington as a public street; and WHEREAS, Section 508 of the City of South Burlington Subdivision Regulations and 24 V.S.A. §4416 require that an approved plat be endorsed in writing on such plat, and recorded in the office of the City Clerk within 90 days of such approval; and WHEREAS, the current owners of 350 White Street in the above -referenced subdivision have requested that this Commission reapprove the above -described Plat in a legally sufficient manner; and WHEREAS, the City of South Burlington Planning Commission having granted final plat approval relative to said subdivision and the related plat, and the same having been previously recorded in the Land Records of the City of South Burlington, and wishes by the adoption and recording of this notice to reaffirm and confirm said approval. NOW THEREFORE NOTICE IS HEREBY GIVEN that: (I) the Plat as recorded December 27, 1983 shall be deemed to have been stamped and endorsed by the South Burlington Planning Commission as required by and so as to satisfy the requirement of section 508 of the City of South Burlington Subdivision Regulations and 24 V.S.A. §4416, and (ii) the lots depicted as 350-354 White Street on said Plat have been and shall continue to be subject to all of the conditions and restrictions contained in the December ,A! They are proposing to divide an existing 1-acre parcel into two 1/2 acres lots. A proposal was submitted in 2002 under the previous owners name James & Dorothy Hardy with Andre & Gisele Thibault as co -applicants. There was one hearing with the Board for the proposal on December 3ra, 2002 (SD-02-72). Shortly after the hearing, Luke Thibault, one of Andre & Giseles sons, died unexpectedly from a brain hemorrhage. The Thibault's, understandably, were preoccupied with other matters and did not pursue the subdivision. However, later in 2003, the Thibault's purchased the property from the Hardy's. The intent of this proposal is to create two 1/2 acre lots from the existing 1-acre lot. One of these lots will have the existing single-family residence and the second lot will have a new duplex structure. Re: Subdivision of 354 White Street Date: June 2, 2003 At the meeting regarding the preliminary and final approval of plat #SD-03-20 and 21, my husband brought up concerns with a long driveway servicing three households following our property line. We met with the contractors two days later and discussed a cedar hedge (as suggested by the Board and contractors) between two existing stockade fences and a wire fence (to match an existing fence) to delineate the boundary line. The builders told us the cedar hedge would be five feet tall and guaranteed for one year. It would be planted in the fall and the Hardy's would water it. They told us it would have to be planted one foot on our side because of the underground utility lines. We would like to request that it be as close to the boundary line as possible. A snow fence will be in place for at least a year as well. We hope everything goes well with the development, especially the erosion and grading control. We also feel we must express concerns about conditions on a variance for the Hardy plot which were believed to have been accepted by the zoning board years ago and were later considered non -applicable because the property wasn't subdivided. According to Section 9.06(A) of the Land Development Regulations, the maximum allowable residential density for the subject property is 4 units per acre, or 4 units. Three units are proposed. The applicant has provided estimates for building and overall coverage in square feet for lots within the subdivision. However, coverage measurements should be indicated in percentage of lot size. 2. The house on Lot 1 will require a waiver of 1 ft. from the minimum required 30 ft. front setback of the R4 District. Lot 2 will be accessed via an extended 25 ft. wide private right-of-way running along the easterly property line of Lot 1. Pursuant to Section 3.05(B)(2)(iv) of the Land Development Regulations, "the property line that abuts or is closest to the private right-of-way shall be construed as the front lot line and shall determine the front yard." Therefore, the front lot line on Lot 1 is the easterly lot line, and the front lot line on Lot 2 is the southerly lot line. The existing house on Lot 1 is only 29 ft. from the easterly, or front lot. This will require a waiver of 1 ft from the minimum required front setback of the R4 District. 3. The plans need to be revised to indicate the height of the proposed duplex structure. Pursuant to Section 3.07 of the Land Development Regulations no point of any pitched roof structure shall rise more than 40 ft. above the average preconstruction grade without DRB approval. The plans do not indicate the height of the proposed duplex structure on Lot 2. 4. The plans must be revised to show the new location of the existing shed. The new location must comply with Section 3.10 of the Land Development Regulations. The plans show an existing shed that straddles the proposed lot line between Lot 1 and Lot 2. A note on the subdivision plat indicates that the shed is to be moved; however, the plans do not show the new location of the shed. Staff notes that the shed cannot be located within a front yard setback, and must be at least 5 ft. from any side or rear lot line. Review Criteria for Subdivisions Lot Layout Pursuant to Section 15.10 of the Land Development Regulations, lots shall be laid out in such a way that they can be developed in full compliance with the regulations and giving consideration to topography, soils, and drainage conditions. In addition, lots must comply with a minimum width to length ratio of one to five. The proposed lots comply with the minimum width to length ratio. The subject property does not contain hydric soils or steep slopes that would prevent the proposed lots from being developed in compliance with the regulations. Staff notes there is potential for subdivision of adjacent properties to the east of the subject property. The proposed private road along the easterly side of the subject property could be extended to these easterly properties. Staff believes that the proposed street layout is appropriate. Topography The topography of the site is relatively flat, with contours between 198 ft. and 199 ft. Staff concludes that the topography will not cause safety, flooding, or erosion issues resulting from the proposed private street. Private vs. Public Roadways The proposed private roadway will serve three residential dwelling units on two lots. Staff notes that this configuration is appropriately served by a private roadway pursuant to Section 15.12(C) of the regulations. Roadway Construction 5. The plans need to be revised to include a cross sectional road detail. Pursuant to Section 15.12(D), private roadways without parking shall be a minimum width of 20 ft. The proposed private road is 20 ft. wide. The proposed road is to be constructed of gravel. Curbing is not required for private roads and no curbing is shown on the plans. However, the plans should include a cross sectional road detail. Entrances Pursuant to Section 15.12(E), the nearest signalized intersection(s) shall maintain an overall level of service "D" or better including the impact of the development. No new access point is proposed. The project access makes use of an existing private right-of-way with a curb cut on White Street. Two new residences are proposed. Staff does not believe that this will require a signalized intersection or reduce the level of service at the nearest signalized intersections, which occur at Williston Road intersections with White Street and Airport Drive. Emergency Access Pursuant to Section 15.12(F), all streets shall be of sufficient width and shall be located to facilitate fire protection. Fire Chief Doug Brent has reviewed the plans and noted that they conform to his comments dated December 2, 2002, concerning the applicant's sketch plans (See Appendix A). Specifically, the plans have been revised to provide a full circle turnaround at the end of the private road to facilitate circulation of a ladder truck simultaneously with other emergency vehicles. Internal Circulation & Parking Two-way vehicular circulation will occur via the proposed 20 ft. wide gravel road. Parking for the CITY OF SOUTH BURLINGTON 5 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \drb\sub\hardy\prelimfinal srp doc existing house on Lot 1 is provided in a 40' x 17' parking area to the south of the house. Parking for the duplex units on Lot 2 is provided in two one -car garages and one exterior space in front of each garage. Staff concludes that internal circulation and parking provisions are adequate. Street Jogs No new street jogs will result from the proposed development. Cul-de-sac Section 15.12(J) of the Land Development Regulations stipulates that the length of a cul-de-sac shall be subject to review and approval of the Fire Chief. As already noted, the Fire Chief has approved the proposed cul-de-sac configuration. Street Names 6. The plans need to be revised to identify a street name approved by the Planning Commission for the proposed private road. The proposed private road will serve three residential units and will therefore require a name pursuant to E-911 regulations. The approved street name must be identified on the final plat. No street name is indicated on the plans. The applicant will need to submit proposed street names to be approved by the Planning Commission. Street Signs & Numbering The required street sign and post shall be provided and installed by the City at the expense of the applicant pursuant to Section 15.12(L) of the Land Development Regulations. Sidewalks & Recreation Paths Staff does not believe that sidewalks are necessary for the proposed development. Section 15.13 of the Land Development Regulations establishes standards for utility systems within subdivisions and PUDs according to the following categories: Easements 8. The applicant must provide a legal agreement and easement acceptable to the Water Superintendent, City Engineer, and City Attorney concerning the proposed water and sewer lines. Utility easements of appropriate width shall be provided in locations deemed necessary by the City Engineer. In addition, Water Superintendent Jay Nadeau has indicated the need for an agreement between lot owners and the City regarding water service to the 3 units within the proposed development (See Appendix B). Staff has conferred with City Attorney Time Eustace about the type of legal agreement that would be necessary. Mr. Eustace provided a sample agreement, which was modified by Mr. Nadeau, that can be viewed as a model for any necessary agreements concerning the proposed water and sewer lines for this development (See Appendix C). CITY OF SOUTH BURLINGTON 6 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \drb\sub\hardy\prelimfinal srp doc Water Service 9. The applicant must meet the requirements outlined in the Water Superintendent's letter dated April 21, 2003. Pursuant to Section 15.13(B) of the Land Development Regulations the public water system shall be extended to provide the necessary quantity of water at an acceptable pressure to the proposed development. Accordingly, the applicant must meet the requirements outlined in the Water Superintendent's letter dated April 21, 2003 (See Appendix B). Sewer Service 10. The applicant must meet the requirements of the City Engineer regarding the proposed sewer line. Pursuant to Section 15.13(D), the applicant shall provide wastewater treatment for the proposed development acceptable to the City Engineer. The plans show a new sanitary force main that will connect to the municipal sewer line within the White Street right-of-way. The applicant will need to abide by any requirements of the City Engineer regarding the proposed sewer connection. Utility Lines 11. The plans must be revised to include a symbol in the legend for the proposed underground utility line. Pursuant to Section 15.13(E) of the Land Development Regulations, all new utility lines shall be underground. The plans show an existing utility pole and overhead line serving the existing house on Lot 1. In addition, the plans show a new underground utility line extending from the existing utility pole to serve the duplex units on Lot 2. However, the Legend does not include a symbol for this underground utility line. Stormwater Management 12. The typical water trench detail must be revised to show the proposed stormwater force main in addition to the proposed water main. The plans show a new stormwater force main constructed of 2" polyethylene piping connecting to an existing catch basin in the White Street right-of-way. A note on the plans indicates that the new water line and stormwater force main will occur in the same trench; however, the typical water trench detail does not show the stormwater force main. 13. The survey plat should be revised to include meets and bounds information for the proposed private right-of-way. Section 15.14 of the Land Development Regulations establishes standards for required improvements for subdivisions and PLIDs. Pursuant to Section 15.14(B), permanent reference monuments must be set at all lot comers and angle points of the boundaries of the subdivision. The survey plat shows two iron pipes to be set at the new lot comers. No markers are shown to delineate the proposed private right-of-way, and no meets and bounds information is shown for the CITY OF SOUTH BURLINGTON 7 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \drb\sub\hardy\prelimfinal srp doc right-of-way Pursuant to Section 15.17 of the Land Development Regulations, a final plat application must be accompanied by a Certificate of Title approved by the City Attorney showing the ownership of any easements to be dedicated or acquired by the City. All proposed legal documents purporting to convey property or easements to the City must also accompany the final plat application. As noted already, the applicant must provide a legal agreement and easement acceptable to the Water Superintendent, City Engineer, and City Attorney concerning the proposed water and sewer lines. Pursuant to Section 15.18 of the Land Development Regulations, the DRB shall consider the following in its review of subdivision and Planned Unit Development (PUD) applications: (a) Sufficient water supply and wastewater disposal capacity is available meet the needs of the project in conformance with applicable State and City requirements, as evidenced by a City water allocation, City wastewater allocation, and/or Vermont Water and Wastewater Permit from the Department of Environmental Conservation. 14. The applicant must obtain water and wastewater allocation approval for the proposed new u n its. The applicant will need to obtain wastewater allocation approval from the Director of Planning and Zoning. As noted by Water Superintendent Jay Nadeau, the applicant must obtain final water allocation approval as soon as possible (See Appendix A). As noted above, Mr. Nadeau has also noted that the applicant must provide city access to curb stops located outside of the public right-of- way. (b) Sufficient grading and erosion controls will be utilized during construction and after construction to prevent soil erosion and runoff from creating unhealthy or dangerous conditions on the subject property and adjacent properties. In making this finding, the DRB may rely on evidence that the project will be covered under the General Permit for Construction issued by the Vermont Department of Environmental Conservation. 15. The plans need to be revised to provide details of erosion control and grading plans that comply with Article 16 of the Land Development Regulations. The plans do not show details of erosion control measures to be used during and after construction. Erosion control and grading plans must comply with Article 16 of the Land Development Regulations. (c) The project incorporates access, circulation and traffic management strategies sufficient to prevent unreasonable congestion of adjacent roads. In making this finding the DRB may rely on the findings of a traffic study submitted by the applicant, and the findings of any technical review by City staff or consultants. 16. Staff notes that the applicant will need to pay the appropriate traffic impact fees upon submission of zoning permit application for the duplex on Lot 2. CITY OF SOUTH BURLINGTON 8 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \drb\sub\hardy\prelimfinal srp doc (d) The project's design respects and will provide suitable protection to wetlands, streams, wildlife habitat as identified in the Open Space Strategy, and any unique natural features on the site. In making this finding the DRB shall utilize the provisions of Article 12 of these Regulations related to wetlands and stream buffers, and may seek comment from the Natural Resources Committee with respect to the project's impact on natural resources. No stream buffers, wetlands, or significant wildlife habitat coincide with the subject property. No open space lands are contiguous to the proposed development. (e) The project is designed to be visually compatible with the planned development patterns in the area, as specified in the Comprehensive Plan and the purpose of the zoning district(s) in which it is located. Staff believes the proposed residential subdivision is in keeping with the surrounding residential development. (f) Open space areas on the site have been located in such a way as to maximize opportunities for creating contiguous open spaces between adjoining parcels and/or stream buffer areas. Again, the subject property does not contain any streams, stream buffers, or contiguous open space. (g) The layout of a subdivision or PUD has been reviewed by the Fire Chief or his designee to insure that adequate fire protection can be provided, with the standards for approval including, but not be limited to, minimum distance between structures, street width, vehicular access from two directions where possible, looping of water lines, water flow and pressure, and number and location of hydrants. All aspects of fire protection systems shall be designed and installed in accordance with applicable codes in all areas served by municipal water. The Fire Chief has indicated to Staff his approval of the revised plans (h) Roads, recreation paths, stormwater facilities, sidewalks, landscaping, utility lines and lighting have been designed in a manner that is compatible with the extension of such services and infrastructure to adjacent properties. 17. The plans need to be revised to include a landscaping plan for Lot 2 that includes at least 2 trees of 2 '/2 inch caliper. The extension and connection of roads and utility facilities has already been discussed. Recreation paths and sidewalks are not necessary within the proposed development. Mature landscaping is existing on Lot 1 and will be retained. No landscaping is shown for Lot 2. The plans need to be revised to show a minimum of 2 street trees per residential lot pursuant to Section 13.06(F) of the Land Development Regulations. In lieu of street trees along the proposed private road, staff believes that the existing landscaping on Lot 1 and a minimum of 2 trees of 2 '/2 inch caliper planted on Lot 2 would meet the intent of the landscaping standards CITY OF SOUTH BURLINGTON 9 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \drb\sub\hardy\prelimfinal srp doc set forth in the regulations. (i) Roads, utilities, sidewalks, recreation paths, and lighting are designed in a manner that is consistent with City utility and roadway plans and maintenance standards, absent a specific agreement with the applicant related to maintenance that has been approved by the City Council. The proposed infrastructure has been reviewed by the City Engineer and Water Superintendent, each of whom has offered comments that need to be addressed by the applicant. No exterior lighting is shown on the plans. Staff notes that one -family and two-family uses are not subject to the exterior lighting standards set forth in the regulations. (l) The project is consistent with the goals and objectives of the Comprehensive Plan for the affected district(s). The Comprehensive Plan encourages infill residential development to address housing needs. Staff believes that the proposed development is consistent with this goal. RECOMMENDATION Staff recommends that the Development Review Board approve preliminary plat application #SP- 03-20 and final plat application #SD-03-21, conditional upon the numbered items in the "Comments" Section of this report being addressed to the satisfaction of Staff prior to endorsement of the final mylar subdivision plat. 'Therefore, I would recommend a residential sprinkler system be installed in these residences. 2. I am concerned about the width of the road (right of way) and about the turning area at the end. We would have extreme difficulty turning around and maneuvering our fire apparatus. Our ladder truck would be the 2nd or 3rd vehicle to arrive for an emergency and I am afraid that parking and positioning could be an issue. If the amounts so assessed are not paid in full within ninety (90) days from the date of the assessment, such amounts shall then be assessed as a lien on a proportional basis. 6. I have also made a site visit to try to envision the siting of this project. Though the plans are very preliminary they seem to be OK and I have the following recommendations: It appears to me that the access to this lot will be by private road. As the City of South Burlington would have no control over winter road maintenance access could be compromised. Therefore, I would recommend a residential sprinkler system be installed in these residences. 2. I am concerned about the width of the road (right of way) and about the turning area at the end. We would have extreme difficulty turning around and maneuvering our fire apparatus. Our ladder truck would be the 2nd or 3`d vehicle to arrive for an emergency and I am afraid that parking and positioning could be an issue. This property located at 354 White Street lies within the R4 District. It is surrounded by single family residences. Access: The proposed access to lot 42 is via a 25 foot right of way off White Street . This right of way also serves lot 41. The paved width of the private drive is 20 feet, and narrows to 15 feet through lot 41 until you get to lot #2 where it widens out to a 24 foot wide drive. Lot size/frontage: The proposed lots exceed the minimum lot size requirement of 12,000 sq. ft. Lots #1 and #2 do not have public road frontage. The Board may approve a lot without frontage provided the following conditions are met: a) Any application to create a new lot with no road frontage shall be subject to the requirements and major subdivision criteria of the South Burlington subdivision regulations. b) The Board shall limit the. number of lots on a private right-of-way to three after which a public street shall be required. The board shall require a public street if the number of units is greater than three. The Board may also limit the length of a right-of-way, and may place other conditions that may be necessary to assure adequate emergency access to all lots and dwelling units. The r.o.w. serves two (2) lots and three (3) units. c) The Board may require a right of way wider than twenty feet to serve more than one lot. The proposed r.o.w. is 25 feet wide. d) The Board may impose conditions to insure the maintenance and permanency of private right-of-way and to insure that a right-of-way will not place a burden on municipal services. No burden expected on the municipal services. Coverage/setbacks: The proposed building coverage for lot #1 is 6.8%., and for lot #2 it is 11% (maximum allowed is 20%). The proposed overall coverage for lot #1 is 26.7%, and for lot #2 it is 22.7% (maximum allowed is 40%). Density: The allowable density on a 1 acre lot in the R4 district is four (4). Members Present: Bill Burgess, Chair; Gayle Quimby, Dan O'Rourke, Marcel Beaudin, Roger Farley Also Present: Joe Weith, Director of Planning and Zoning; William Mitchell, Greg Rabideau, John Larkin, Jennifer Mercier, Gary Bourne, John Illick, Julian Goodrich 1. Other Business: No issues were raised. 2. Review Minutes of 8 June and 15 June 1999: Ms. Quimby moved to approve the Minutes of 8 June as written. Mr. O'Rourke seconded. Motion passed unanimously. Sketch plan request of William Mitchell & Jennifer Mercier for reapproval of a two (2) lot subdivision originally approved on December 13, 1983, 350 and 354 White Street: It was explained that the plat had never been signed by the appropriate Planning Commission member. PLANNING COMMISSION 29 JUNE 1999 Mr. Wcith indicated that the request would go straight to final plat. The Planning Commission will have to sign the plat, and there will have to be a document explaining this action. 5. Public Hearing: Final plat application of John Larkin, Inc., to amend a planned unit development consisting of a 200 room hotel, 60 room hotel, and restaurant, 1720 Shelburne Road. The amendment consists of adding a three unit residential structure: Mr. Rabideau said they had been told that a single family residence was not allowed and that they couldn't have it as an "accessory use." The only alternative was a multi -family building. The will raise the building a half story and have two (2) lower level units and one upper level. The only complication is that the Agency of Natural Resources has asked that the house be moved twenty (20) more feet from the edge of the bank. This would result in reducing a small parking lot by eight (8) spaces. There are remaining spaces in an adjacent lot, and they can build the six (6) needed for the multi- family house_ Mr. O'Rourke suggested building the six (6) spaces only if they prove to be needed. Other members agreed. Ms. Quimby reminded the applicant that the house cannot be occupied until there is capacity at the sewage plant. Mr. O'Rourke moved the Planning Commission approve the final plat application of John Larkin Inc. to amend aplanned unit development consisting of a 200 room hotel 60 room hotel, and restaurant, 1720 Shelburne Road The amendment consists of adding a three unit residential structure, as depicted on a nine (9) page set of plans page one entitled "Landscaping Plan Staybridge Suites 1720 Shelburne Road South Burlington Vermont," prepared by Rabideau Architects Inc. dated 3/26/99, last revised on 3/29/99, with the following stipulations: 1 All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2 The plan shall be revised to show the changes below and shall require approval of the Director of Planning and Zoning (hereinafter Director) Four (4) copies of the revised plan shall be submitted to the Director prior to recording. a) The final plat plan (sheet L-1) shall be revised to show$750 worth of landscaping around the multi -family dwelling. b) Sheets L-1 C I C2 and C3 shall be revised to show the three (3) unit building shifted to the south and a three (3 )space parking lot. 3 For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the multi -family dwelling will generate 1.86 additional vehicle trip 2 PLANNING COMMISSION 29 JUNE 1999 ends during the P.M. peak hour. 4. All exterior lighting shall consist of downeasting shielded fixtures. Any change to approved lights shall require approval of the Director prior to installation. Details of any building mounted lights shall be submitted to the Director for approval prior to permit issuance. 5._ Prior to issuance of a zoning permit, the applicant shall post a $750 landscape bond. The bond shall remain m effect for three (3) years to assure that landscaping takes root and has a good chance of surviving. 6. The Planning Commission approves an additional sewer allocation of 480 gpd (includes 20% reduction allowed by State). The applicant shall pay the per gallon fee prior to permit issuance. There is currently no sewer allocation available at the Bartlett Bay Wastewater Treatment Facility. The allocation granted shall be placed on a waiting list until such time as the allocation is available. No Certificate of Occupancy/Compliance will be issued and the building cannot be occupied until such time as sewer capacity is available. 7. The building shall be sprinklered. 8. Pursuant to Section 26.256(b) of the zoning regulations, the Planning Commission approves a total of 321 parking spaces (includes 24 "future" parking spaces) which represents a twenty two (22) space of 6.4% shortfall. 9. Any changes to the site plan shall require approval by the South Burlington Planning Commission. 10. The final plat plans (Sheets L-1, C 1 and C2) shall be recorded in the land records within 90 days or this approval is null and void. The plans shall be signed by the Planning Commission Chair or Clerk prior to recording. Ms. Quimby seconded. Motion passed unanimously. The Zoning Board has approved reduced setbacks to allow for this structure. He noted that there is a fair amount of pedestrian traffic between the two facilities. Now he wants to create a lot line which will give the front lot the minimum required area and leave the back lot with over an acre of land. Mr. Hardy had proposed to create a 20' right of way to the back line, but the Commission felt 25' would be better. Mr. Jacob came in at this point. It was noted that the land was zoned R4 and that Mr. Hardy would have a 1 acre piece, so further subdivision of the land in the rear would be possible, although access would be an issue. It was noted that the Commission usually allows 3 lots to be served from a private right of way. The 25' right of way was preferred, especially in light of the possibility of future houses back there. Site plan review, Offset House, Mr. John McGrath, 1205 Airport Parkway, construction of a 10,000 sq. ft. addition Mr. Ward noted that the applicants had a double lot. They will double the size of the present building with this addition. Sewage will go to the Airport Parkway plant through the applicants' system. The existing on -site system will be abandoned. There is enough capacity for the use. There is an existing curb cut on Berard Drive and the applicants will use that for truck and employee access. They would like to retain the present Airport Parkway access for customers, since their office area is oriented that way. Mr. Walt Adams, representing the Offset House, said there was good sight -distance for,both access points and that this new access will make it easier for large trucks to get to the loading docks. He said there would be a drive all the way around the building which would connect the two parking lots, J 3. PLANNING COMMISSION NOVEMBER 8, 1983 Attorney for wording on this, since the Commission liked the idea. Review revised final plat application of 'Minding Brook, Kennedy Rive, Mr. Robert Marcellino Mr. Marcellino said they would like to amend the plan slightly. They would like to have a mix of townhouse and flat units in the buildings, so they would like to make them 114' long instead of the original 104'. The total number of units will remain the same. Parking has also been moved so it will not be right in front of the buildings, but the number of spaces remains the same. Mr. Marcellino was asked if the Fire Chief had seen the plan and he said he had not. He was told to discuss it with him. Mr. :4arcellino said they were anxious to get started on the project. He was concerned about the $28,000 bond for landscaping, noting that the original plan had been to strip the site and replant. They now want to save as many trees as possible. They hope to return to the Commission to change the land- scaping plans later, but they were ho ing to have the City Attorney's approval of the condominium documents andnttTe�andscaping bond prior to sale of the first unit instead of before issuance of a building permit. Mr. Ward opposed that, saying the city had been burned too many times before to allow that. As to the Attorney's approval of the documents, he felt they would probably be pretty standard. Mr. Poger did not want to reduce or postpone the landscaping bond. Mr. Ward noted that once a building permit was issued, developers usually lost track of everything else, so it was best to have the Attorney's approval and to have the bond posted before issuance�of the permit. Mr. Marcellino was not sure the Attorney would have time to approve the documents before November 24, but Mr. Mona suggested that the developers get the documents to the Attorney before the end of this week. If they do that and the Attorney cannot get to them before November 24, the Commission would consider extending that date. Mrs. Maher moved that, conditioned on approval of the Fire Chief, that the Planning Commission grant approval for the Winding Brook condominium development as shown on the amended site plan dated November 1, 1983. Mr. Belter seconded the motion and all voted for it. Nx . Hausner asked if a letter of credit would be all right instead of a bond and was told it would. Lot 2 (354 White Street) contains 1 acre served by a 20 foot right-of-way. In July 1972 a variance was granted by Zoning Board of Adjustment to set-off the lot with a twenty-five (25) foot right-of-way. Section 19-20 of zoning regulations provides that the Planning Commission may approve subdivision of lots with no frontage as long as access to such lot is over a permanent easement or right-of-way of at least 20 feet in width. No problems related to this proposal.
