HomeMy WebLinkAboutSP-98-0000 - Decision - 0049 Commerce AvenueFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDE.N CITY OF SOUTH BURLINGTON Re: Findings of Fact, site plan application of Ken Smith to amend a previously approved site plan for a 35,000 square foot building for a multiple of commercial and industrial uses. The amendment consists of reducing the amount of landscaping required, 49 Commerce Avenue. On the 9thday of June, 1998, the South Burlington Planning Commission approved the request of Ken Smith for site plan review under Section 26. 10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a site plan previously approved on 6/13/95 and amended on 10/22/96 and 12/17/96 for a 35,000 square foot building for a multiple of commercial and industrial uses. The amendment consists of reducing the amount of landscaping required. The only issue affected by this application is landscaping. 2. This property located at 49 Commerce Avenue lies within the IC and CO Districts. It is bounded on the east and south by undeveloped property, on the west by a warehouse, and on the north by Commerce Avenue. 3. Landscaping: The minimum landscaping requirement, based on building costs, is $15,000. The site plan approved showed proposed landscaping to meet this request. This landscaping has yet to be planted. The applicant is requested a credit of $7225 for site improvements other than tree plantings as provided for under Section 26.105(a) of the zoning regulations. The site improvements proposed includes a patio and patio retaining wall, a dry creek for water runoff and a walkway. DECISION & CONDITIONS Based on the above Findings of Fact, The South Burlington Planning Commission approves the site plan application of Ken Smith to amend a previously approved site plan for a 35,000 square foot building for a multiple of commercial and industrial uses. The amendment consists of reducing the amount of landscaping required, 49 Commerce Avenue, as depicted on a plan entitled, "Kenneth P Smith (owner) Lot 25/26 49 Commerce Ave So Burlington, VT.," prepared by K.P. Smith General Contractors, dated 6/30/97, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Pursuant to Section 26.105(a) of the zoning regulations, the Planning Commission grants a landscaping credit for the patio and rock wall. The remaining shortfall in required landscaping shall be met by increasing sizes of proposed landscaping. The plan shall be revised accordingly. 3.
