HomeMy WebLinkAboutSP-97-0000 - Decision - 0034 Commerce AvenueFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of GRD, Inc. to amend a previously approved plan for a 13,600 square foot building for warehouse use. The amendment consists of converting 6,000 square feet of the lower level to airport transient/long term parking and auto service use, 83 Ethan Allen Drive/34 Commerce Avenue. On the 9th day of September, 1997, the South Burlington Planning Commission approved the request of GRD, Inc. for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a plan previously approved on 3/24/94 for a 13,600 square foot building for warehouse use. The amendment consists of converting 6000 square feet of the lower level to airport transient/long term parking and auto service use. The applicant proposes to store approximately 40 long term parkers inside the building and using a van to shuttle the customers to and from the airport. Vehicles stored will be cleaned and washed. 2. This property located at 83 Ethan Allen Drive/34 Commerce Avenue lies within the I-C District. It is bounded on the west and east by industrial buildings, on the north by Ethan Allen Drive and on the south by Commerce Avenue. 3. Access/circulation: Building coverage is 18.4% (maximum allowed is 30%). overall coverage is 55.8% (maximum allowed is 70%). Front yard coverage along both streets is 30% (maximum allowed is 30%). Setback requirements are met. 4. Parking: There is no minimum parking requirement for the proposed airport transient/long term parking use in the zoning regulations. The applicant has 11 spaces available for this use. Staff felt this was adequate. Parking should be prohibited outside the building unless it is in a designated space as shown on the site plan. 5. Landscaping: There is no minimum landscaping requirement, based on building costs, for this project. No additional landscaping recommended. 6. Sewer: No additional sewer allocation needed. 7. Traf f ic: The $1000 contribution for improvements to Ethan Allen Drive required as part of the 6/25/85 subdivision approval was paid in 1986. 8. Lighting: Exterior lighting consists of six (6) 250 watt wall mounted high pressure sodium lamps with cut-off luminaries. No additional lighting proposed. 9. Dumpster: The two (2) dumpsters are screened by a wooden fence. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approve site plan application of GRD, Inc. to amend a previously approved plan for a 13,600 square foot building for warehouse use. The amendment consists of converting 6,000 square feet of the lower level to airport transient/long term parking and auto service use, 83 Ethan Allen Drive/34 Commerce Avenue, as depicted on a plan entitled, "Storage/Distribution Facility Lot 14 - Ethan Allen Dr. So. Burlington Vermont, " prepared by Graphic /Construction Management Services, Inc. , dated 3/23/89, last revised 6/15/89, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Parking of stored vehicles shall be prohibited outside the building unless it is in a designated space as shown on the approved site plan. 3. Any new exterior lighting or changes to existing exterior lighting shall consist of downcasting shielded fixtures. Any change to existing lights shall require approval of the City Planner prior to installation. 4. The parking lot shall be striped as shown on the approved plan prior to issuance of a Certificate of Occupancy/Compliance. 5. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 6. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the lower level for the approved uses. 2 7.
