HomeMy WebLinkAboutSP-95-0000 - Decision - 0015 Commerce AvenueFINDINGS OF FACT & DECISION STATE OF VERMONT CX) COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Laurie & David Cota to construct a 3200 square foot warehouse, 15 Commerce Avenue. On the 10th day of October, 1995, the South Burlington Planning Commission approved the request of Laurie & David Cota for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of the construction of a 3200 square foot warehouse. A 3150 square foot office building was approved on this site on 3/29/94 which was never built. 2. This property located at 15 Commerce Avenue (lot #33) lies within the IC District. It is bounded on the north by Commerce Avenue, on the west by an auto repair business, and on the east and south by vacant lots. 3. Access /circulation: Access will be provided by a 20 foot curb cut on Commerce Avenue. Circulation is adequate. 4. Coverage/ setbacks: Building coverage is 8.0% (maximum allowed is 30%) . Overall coverage is 41.5% (maximum allowed is 70%). Front yard coverage is 16.9% (maximum allowed is 30%). Setback requirements will be met. 5. Parking: This project requires a total of five (5) parking spaces and six (6) spaces including one (1) handicapped space will be provided. The plan provides a bike rack as required under Section 26.253(b) of the zoning regulations. 6. Landscaping: The minimum landscaping requirement, based on building costs, is $1920 which is being met. Plantings will include Honey Locust, Sugar Maple, Birch and Juniper. 7. Traffic: The applicant will be required to contribute $880 for improvements to the Ethan Allen Drive/Shamrock Road intersection. This was a requirement of the subdivision approval. 8. Sidewalk: The subdivision approval required that the applicant either contribute $15 per linear frontage foot or construct the sidewalk. The Planning Commission as part of the previous 3/29/94 approval required that the applicant pay the $15 per linear foot of frontage sidewalk fee prior to permit issuance. 9. Sewer: The sewer allocation needed is 160 gpd. The applicant will be required to pay the per gallon fee prior to permit issuance. 10. Lighting: Exterior lighting will consist of: --- one (1) 175 watt high pressure sodium building mounted light with a downcasting and shielded fixture. --- three (3) 70 watt high pressure sodium building mounted lights with downcasting and shielded fixtures. 11. Dumpster: No dumpster proposed. Outside storage: An area south of the gravel parking area behind the building is aesignated for outside storage of equipment. This storage area is not screened from the street. 13. Other: --- site plan and landscaping plan should be revised to include the property's street address. --- the landscaping plan should be revised to include a north arrow. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Laurie & David Cota to construct a 3200 square foot warehouse, 15 Commerce Avenue, as depicted on a nine (9) page set of plans, page two (2) entitled "Cota Trucking Company, Lot 33, Ethan Allen Farms Industrial Park, Commerce Avenue South Burlington, Vermont", prepared by Krebs & Lansing Consulting Engineers, Inc. dated 9/13/95, last revised 10/5/95, with the following stipulations: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) The plan shall be revised prior to issuance of a zoning permit to show the changes listed below and shall require approval of the City Planner. Three (3) copies of the approved revised plan shall be submitted to the City Planner prior to permit issuance. a) The landscaping plan shall be revised to include a north arrow. b) The site plan and landscaping plan shall be revised to include the property's street address. c) The landscaping plan shall be revised to show additional or relocated landscaping and/or stockade fencing to screen the outside storage area from the street. d) The site plan shall be revised to show a curb stop for the water service at the street line. 3) A sewer allocation of 160 gpd is approved. The applicant shall pay the per gallon fee prior to permit. 4) Prior to issuance of a zoning permit, the applicant shall contribute $880 for roadway improvements as stipulated in the original subdivision approval. 5) Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in lighting shall be approved by the City Planner prior to installation. 6) Prior to issuance of a zoning permit, the applicant shall pay the $15 per linear foot of frontage sidewalk fee which was required as a condition of subdivision approval. 7) The applicant shall post a landscape bond in the amount of $1920 for the new landscaping. This bond shall be posted prior to issuance of a zoning/building permit. The bond shall remain in effect for three (3) years to assure that the landscaping has taken root and has a good chance of surviving. 8) The applicant shall obtain a zoning permit within six (6) months or this approval is null and void. 9) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative officer prior to use of the warehouse building. 10) Any change of the site plan shall require approval by the South Burlington Planning Commission.
