Members Present Robert Martineau, Chairman; Frederick Fayette, Everett Reed, Norman Campbell Members Absent Richard Myette, Paul Graves, Howard Perkett Others Present Richard Ward., Zoning Administrator; Ray, Jim, and Jerry Couillard, Robert Perry, Homer Theriault, Robert Bannister, Robert Rea Minutes of June 19, 1978 It was moved by Mr. Campbell and seconded by Mr. Reed to approve the minutes of June 19, 1978. The motion passed unanimously. No. 1 Appeal of Homer Theriault and Raymond Conchieri Appeal of Homer Theriault and Raymond Conchieri seeking a variance from Section 7.00, Permitted Uses and Section 13.40 off-street parking of ! the South Burlington Zoning Regulations. Request is for permission to construct five (5) buildings containing a total of 51,000 square feat for purposes of operating mini -warehousing, with a resident manager, also requesting to set-off a minimum number of off-street parking in conjunction with the proposed use, at 85 Swift Street. Mr. Ward stated that the area was zoned BR and was adjacent to Farrell Park. The proposed use is prohibited in the BR district (mini -warehousing), and storage buildings are conditional in the BPD district and permitted in the Industrial district. Mr. Ward felt that if the uses were mixed a variance from'Section 11.15, Multiple use, would be needed. Section 13.40 requires 1 parking space for each 100 square feet of floor area, which would mean 510 spaces for this proposal. The lot has 378' of frontage and is 4.2 acres in size. Right now, he said, there is a single family dwelling on the lot and he added that if they leased space for offices they would need a variance. The Board felt that the number of parking spaces required by the ordinance was excessive in this case. Mr. Ward said the proposal did not include parking spaces as such, but the area around the buildings was all blacktopped and people could park as they chose. The rear portion of the lot will be fenced and used for open storage of boats, campers, etc. Mr. Robert Perry represented one of the appellants and gp.ve the Board an overview of the project. He said that the buildings would be rented for a month, 6 months, a year, however long the people wanted to rent for and they would be available to individuals or businesses. The compartments will be of different sizes. He noted that the proposal to have a resident manager had been dropped and the manager will be there only during open hours, 8-6. No trucks will be parked overnight, he said, and if that begins to happen, the area will be closed with agate. Mr. Perry said that a similar operation inCthntwere notwith p60,eak hours.�square feet generated about 30-45 care p y itre He said one advantage of this location was that it was close to the interstate and Shelburne Road so that access was easy. Mr. Perry informed the Board that the uses in the area were varied - there are residential uses, a telephone co. warehouse and service center, the correctional center, Booska-truddng, and Vt. Gas. He felt that the surrounding uses were basically storage and warehouse uses and thus this would fit in. Mr. Perry told the Board that Mr. Theriault had tried to sell the parcel of land in the past and had been unable to sell it in one piece. It is too large to be saleable in one piece and the surrounding uses, he felt, do not make it suitable for a retail use, as it is zoned. He said that the house,, presently. on the Ignd would be removed, although not for at least a year. Mr. Martineau said there were 200-250 partitions and was told that was correct. Mr. Perry said. that in the'Conneetiont operation Saturdays sometimes saw 40-70 cars come in. Looking at the amount of blacktop and using the standard size of a parking space, the Board determined that they could fit 200 spaces between the buildings. Of course, the smaller the compartments the more cars, and the larger the compartments, the larger the trucks will tend to be. Mr. Fayette asked why this operation could not be located elsewhere in the city and was told that there was no zone for the warehousing and that ,( if they put it iii the industrial zone, where storage is permitted, they ;could have individual traffic in that area, which he was not sure the city wanted. Mr. Perry said the zone was BR but there were no BR uses along the street. Mr. Fayette felt that perhaps it was the landowner, not the builder who had the hardship and he asked if they had looked at other places in the city to build this. Mr. Perry reiterated that Mr. Theriault had not been able to sell the land in one piece yet and added that the house on the land now is non -conforming. He said that Messrs. Theriault and Conchieri might work together on the project. Mr. Martineau informed For. Perry that the Board takes use variances very seriously but he felt they should look at -whether the character of the area has been established already contrary to what the zone calls for and whether that has caused Mr. Theriault a hardship. Mr. Perry did nct `eel a retailer would want to locate in this area. Mr. Couillard, an adjoining landowner, told the Board that he had been trying to buy apart of�tAe land and that Mr. Theriault had not been willing to sell it to him. He also said that the Board had limited the number of cars he could put in his parking area to 5 and he did not feel it was fair to allow Mr. Theriault to park a lot of them. Mr. Reed responded that Mr. -Couil:lard's vehicles were parked for repairs and these will be in working order and only there for short periods of time.- -Mr. Martineau told him boats and campers might be -harked in open storage. Mr. Couillard also brought up the question of what would happen if the warehousing did not work out - would those buildings be remodeled into housing? He said that John Aruzza, another property owner, had not liked / the idea either but had been unable to get to the meeting tonight. `t Mr. Perry stated that if the Board did not like the outdoor storage idea that could be eliminated. JULY 3. 1978 Mr. Martineau asked why Mi. ,Theriault,had not wanted to sell pests of the land and was told he did not want to have to live next to a building he did not like. Mr. Reed felt it was unrealistic to expect a BR use to go on the lot. Mr. Fayette suggested the Board ask the.City Planner about the area and the uses already there and about this use going in. lie also felt Mr. Couillard should look at the uses permitted in the BR zone and suggested that pel�haps Mr. Perry should talk to Mr. Couillard. ` Mr. Martineau -asked Mr:.. Ward- to talk to the Planner- and he asked ;Kr-. Perry for more traffic information, perhaps from 2 or 3 other locations with similar projects. He asked for something in writing and said it would ;be helpful to have something to the effect that the character of the area has caused a hardship to,Xr. Theriault. Mr.''Theriault said he had not made "'a real effort to sell the land until now, when he has a health problem and can no longer take care of it properly. Ward told the- Boexd-_tb'& -area was zoned Airport Industrial and l� that the proposed use, a motorcycle accessory shop, considered a retail use, - was -mot al-lowed.--Tbe_-roofing contractor business is -existing, he said. The steel building is 40' x 80' and the lot contains 33,000 square feet. He said he had received letters from Mr. Rea explaining the business (on file with the Zoning Administrator). _lie said South Burlington has no_ provision in the ordinance for a roofing business although there is one for motorcycle accessories. Mr. Rea said that technically he would be an ewpl9yee of Mr. Bannister and that he liked the location because the area .i4_a1reC(IX noisy,, and S,s ,,__, far from residential uses. They propose to use 1%4 `of =:the existing building, which will cut down on cost, which is important to a new business. There is plenty of parking available. Mr. Martineau asked if -he would accept a time -lock on the use and was told that while Mr. Rea would feel more comfortable with 2 years, he would accept a 1 year lock. He stated that he did not intend to sell or repair motorcycles and he did not think the busines8_would attract dirty, noisy people. JULY 17, 1978 Appeal of Homer Theriault and Rynmond Conchieri (tabled July 3. 1978) Mr. Robert Perry, representing the appeal, gave the Board a document about the appeal (copy on file with Zgining Administrator). He said that Mr. Burns of Burns Real Estate told them that the area was not suitable for a retail use because it lacks appeal and the necessary traffic. He also had a memo dated July 12 from City Planner Stephen Page concerning the site (copy on file also). This memo showed a possible connection from Lindenwood Drive to Swift Street and Ns. Perry was asked if the layout of the project was compatible with that. Mr. Perry felt it was. He said they would start this fall and build two warehouses and then the rest would be built next year. Kr. Fayette said that gave the city a ye8r to think about possible purchase of a right of way for that proposed road or another way to work it out. Mr. Martineau felt that would be fair for both the city and the appellant. He reminded them that any use of the building would have to be strictly for storage space as they had described it and nothing else unless the Board gave them another variance. He said the document submitted by Mr. Conchieri showed a minimal traffic impact based on studies done on other similar projects in other areas. Mr. Fayette praised the outline submitted by the appellant and said it should be used as an example to others. Mr. Perry said the hardship came in the fact that the parcel was 4 acres in size, which was too large for a retail use. The surrounding uses are not retail either, so the land cannot realistically be asked to house a retail use. He felt the appellant had not created the hardship and that this was the minimum variance possible. He said it would not affect the character of the area. The appeal was granted unanimously. The meeting was adjourned at 8:11 pm. r Clerk To: South Burlington Zoning Board of Adjustment Subject: Traffic Volume & Severity for Planned Minni Warehouse. From: Raymond E. Conchieri Ref: Zoning Board Meeting, 3 July 1978 Date: 17 July, 1978 The Minni Warehouse under review by the zoning board has been patterned after associate rent a spare ware houses located in South Wincbor and Groton Conn. Supplementary traffic information as requested in reference meeting was obtained by contacting Mr. Joseph Henderson who is presently Manager of the South Windsor Rent a Space Warehouse. The following comments were obtained relative to traffic volume and severity at that operation. Exact traffic flow is not available as records of this type are not kept, however the following estimates were provided. Traffic Volumn: Weekdays: o Approximately 15 to 20 vehicles stop at managers office daily to either rent a space or conduct some form of business. o Another 20 to 30 vehicles use the facilities daily without stopping at the managers office. Total vehicles daily range from 35 to 50. Saturdays: o Approximately 20 to 25 vehicles stop at managers office to rent a space or conduct some form of business. o Another 40 to 50 vehicles use the facilities without stopping at the managers office. Total vehicles on Saturday range from 55 to 80. Traffic Severity: Vehicles using the facility are fairly uniformally distributed throughout the day. No peak traffic patterns occur.
