HomeMy WebLinkAboutSP-09-46 - Decision - 0000 Dorset Street#SP-09-46 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING CCTA - 401 DORSET STREET SITE PLAN APPLICATION #SP-09-46 FINDINGS OF FACT AND DECISION The Chittenden County Transportation Authority, herein referred to as the applicant, is requesting Site Plan approval to construct a 32 sq. ft. bus passenger shelter with an 84 square foot slab bus shelter adjacent to 401 Dorset Street. The Development Review Board held a public hearing on June 16, 2009. Tom Peterson represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant, is requesting Site Plan approval to construct a 32 sq. ft. bus passenger shelter with an 84 square foot slab bus shelter adjacent to 401 Dorset Street 2. The application was received on May 28, 2009. 3. The owner of record of the subject property is the City of South Burlington. 4. The plans submitted consist of a four (4) page set of plans, page one (1) entitled, "CCTA Proposed Shelter Site Overview 401 Dorset St.," dated 5/28/2009. General Review Standards (Section 14.06) Relationship to the South Burlington Comprehensive Plan: This application adheres to the goals of the South Burlington Comprehensive Plan, which promote bus service through the CCTA. The proposed bus shelter is in an intensively used compact area, where the Comprehensive Plan states bus services should be rendered. Relationship of Proposed Structure to the Site: The proposed structure is a CCTA bus shelter, measuring 32 square feet. The proposed shelter is within the city's greenbelt area, but the Board feels the structure accomplishes a desirable transition from structure to site, provides for adequate planting, and provides for safe pedestrian movement. Relationship of Structures and Site to Adjoining Area: Section 14.06(C)(1) of the South Burlington Land Development Regulations states that the Development Review Board (DRB) shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens, and visual interruptions to create attractive transitions between buildings of different architectural styles. 1 I:\Development Review Boa rd\Findings_Decisions\2009\CCTA_SP0946 ffd.doc 1 #SP-09-46 As this is a bus shelter, the proposed materials and architectural characteristics are suitable. The proposed shelter is composed of timber with a copper roof and mounted on a concrete slab. Landscaping, buffers, screens, and visual interruption are not applicable to the proposed project. Specific Requirements for Bus Shelters (Section 13.09) A. Shelters may be constructed adjacent to or within street rights -of -way in any zoning district after approval of a site plan by the Development Review Board. The proposed bus shelter is located adjacent to Dorset Street. B. The shelter shall be located to permit ample room for a bus to conveniently leave the traveled roadway to pick up or discharge passengers. The proposed shelter is along Dorset Street, a sufficient distance away from any major intersections. C. The design shall be harmonious with adjacent properties. The proposed design is a standard CCTA bus shelter. This structure is harmonious with adjacent properties. D. The structure shall not have more than one (1) sign. This sign shall not exceed two (2) square feet in area. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plans submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the bus shelter. 5.
