HomeMy WebLinkAboutSP-12-12 - Decision - 0000 Shelburne Road#SP-12-12 { CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING & ZONING CCTA — SHELBURNE ROAD & LINDENWOOD DRIVE SITE PLAN APPLICATION #SP-12-12 FINDINGS OF FACT AND DECISION Chittenden County Transportation Authority, hereinafter referred to as the applicant, is seeking site plan approval to amend a previously approved plan for a bus shelter. The amendment consists of adding a bike rack on a new 50 sq. ft. concrete pad, Shelburne Road & Lindenwood Drive. Based on the findings below, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking site plan approval to amend a previously approved plan for a bus shelter. The amendment consists of adding a bike rack on a new 50 sq. ft. concrete pad, Shelburne Road & Lindenwood Drive. 2. The owner of record of the subject property is the State of Vermont. 3. The application was received on March 22, 2012. 4. The plan submitted is entitled, "Lindenwood Dr Site Plan" prepared by Tom Peterson, and is not dated. BUS SHELTERS Section 13.09 (8) of the Land Development Regulations reads in part as follows. - Specific Requirements. Such shelters may be constructed adjacent to or within street rights -of -way in any zoning district after approval of a site plan by the Development Review Board. The shelter shall be located to permit ample room for the bus to conveniently leave the traveled roadway to pick up or discharge passengers. The design shall be harmonious with adjacent properties. 5. The existing shelter was previously approved by the Development Review Board. 6. The addition of a 50 sq. ft. concrete pad and a bike rack on the pad will not reduce the space needed to pick up or discharge passengers as the pad and bike rack will be constructed adjacent and to the north of the shelter. 7. The design of the bike rack will be harmonious with the adjacent properties. -1- #SP-12-12 { DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves Site Plan #SP-12-12 to amend a previously approved site plan for a bus shelter. The amendment consists of adding a bike rack on a new 50 sq. ft. concrete pad, Shelburne Road & Lindenwood Drive, based on the following conditions: 1) All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2) The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 3) The Applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the new bike rack. 4) Any change to the site plan shall require approval by the South Burlington Administrative Officer or the Development Review Board. �1 f Signed on this day of 2012 by N 7- 'v� Ray and J.
