Sketch plan application of Cupola Golf Course, Inc, to subdivide a 24.55 acre parcel into 6 lots ranging in size from 1.5 acres to 8.3 acres, 360 Spear Street: Mr. Lougee showed the individual lots. Lots 3 and 6 were previously onslot and are currently mortgaged to the Lyndonvills Savings Bank. Lot 2 is mortgaged to the Merchants Bank. The other 4 lots are designed based on roads, sewer lines, etc. Mr. Burgess said that when a road is put aeress a lot, it will become 2 lots, regardless of what the bank says. He added that he didn't know how there could be a mortgage on a portion of a property which has not been subdivided. Mr. Lougee said the family has owned the land for a long time and has tried to sell it as a whole but haven't been able to. They feel it can be developed in a reasonable manner. Mr. Weith noted there are three zoning districts involved: R-4, C-1, and R-7. Some of the proposed lots encompass more than one zone. HQ also noted an objection to access to commercial land via a residential parcel. Mr. Teeson said he is all for improving the roadway but felt the applicant was going at it backwards. Mr. Beaudin suggested rezoning the land, making the top half R-4. Mr. Burgess said he would like to see the east -west line (betwssn lots 2 and 6) moved so it falls on the zone line. Mr. Crow said he felt the bank would be accommodating because right now they have a mortgage that is not enforceable. Mr. Weith said there must be discussion about the CO zone. Mr. Lougeesaid they want a chance to discuss this as they feel there are precedents involved. Mr. Burgess didn't feel the layout makes any sense at all. Hs suggested a loop road to serve the area. He said as it is shown now, he couldn't vote for approval because of the road length, cul ds sac and layout of lots. Mr. Crow suggested a zero lot line PUD. Mr -Lougee said they would consider that. Mr. Weith noted that new wording in the Zoing Regs would eliminate developable land on several proposed lots. Mr. Alexander then presented traffic data for the proposed development. He said he used ITE acreage figures. No signals would be required. Levels of service at Spear St. would be "C". 357 p.m. peak hour trips are estimated with 136 of these going into the jughandle. This would result in a 1.2 second average increased delay at the jughandle approach. Mr. Burgess summed up the Commission's concerns: the length of the road, the cul ds sac, and the coordination of lot lines and zoning lines. 7. Request from GBIC: Mr. McKenzie said GBIC is helping with a project at the Airport and need a statement that what is being proposed is legal. Mr. Burgess read the statement that is proposed. Memorandum - June 11, 1996 June 7, 1996 Page 6 Planning agenda items 7) CUPOLA GOLF COURSE, INC. - 6 LOT SUBDIVISION - SKETCH PLAN This project consists of the subdivision of a 24.55 acre parcel into six ( 6 ) lots ranging in size from 1.5 acres to 8.3 acres. The last review of this property was for a boundary line adjustment approved on 9/12/95 (minutes enclosed). This property located at 360 Spear Street lies within the R4, R7, C1 and CO Districts. It is bounded on the north by a shopping center ( Staples Plaza), on the east by I-89, on the south by the Horizon Heights residential development and on the west by residences along East Terrace. Access: Access is provided by a private road (Quarry Hill Road) from Spear Street. This road provides access to a couple of residences, the Horizon Heights development with 77 units and the Quarry Hill Club. A 50 foot r.o.w. to East Terrace also exists. One of the conditions of approval for Horizon Heights required that the Quarry Hill Road "be fully upgraded to city design and construction standards in the event of: a) additional subdivision, or b) substantial further development". Another condition of this project was "that further development of the 28 acres zoned commercial shall not have access through the residential neighborhood". The Commission has stated at previous meetings that this condition refers to the East Terrace neighborhood. The applicant is proposing to upgrade Quarry Hill Road to City standards and extend the street to serve the proposed lots. This will result in a cul-de-sac with a length of approximately 2300 feet. Section 401.1(g) of the subdivision regulations states that "cul-de-sac streets are recommended only in residential districts." Approximately 450 feet of the cul-de-sac will lie within the C1 District. This section also limits the length of a cul-de-sac to 1200 feet. Lot size/frontage: The largest minimum lot size requirement for the R4, R7 and Cl Districts is 40,000 square feet which is being met. The largest minimum frontage requirement for the R4, R7 and Cl Districts is 120 feet which is being met. C.1 Memorandum - Planning June 11, 1996 agenda items June 7, 1996 Page 7 C.O. District: The plan does not correctly depict the C.O. District as interpreted by staff and as shown on the zoning map. The C.O. District is 150 feet wide to the point where the ramp extends beyond the 150 feet. At that point the C.O. District transitions to 50 feet along the ramp (see enclosed sketch). The Planning Commission has discussed amending the zoning regulations to clarify this interpretation. Lot configuration: Staff recommends that the applicant consider reconfiguring the lots to coincide more closely with the zoning boundaries. Traffic: A traffic impact analysis should be submitted with the preliminary plat submittal. Recreation path: The recreation path easements required as part of the 9/12/95 approval are shown on the plan. Other: --- the two (2) boundary lines of the 3.2 acre parcel which were dissolved as part of the boundary line adjustment should be removed. --- the plan should be revised to include acreages for lots 3A, 3B and 4. --- lots 3A and 3B should be numbered as separate lots since a public road will divide this land into two (2) separate lots. Public Hearing: Final Plat Application of Cupola Golf Course, Inc, dba Quarry Hill Club, for a boundary line adjustment of 25.7 acres and 6.6 acres, thereby creating 2 reconfigured lots of 22.7 acres and 9.8 acres, Quarry Hill Club & Staples Plaza: Mr.. Austin stepped down during this discussion due to a conflict of interest. The applicant said there have been no substantive changes. Mr. Burgess said they need to resolve the boundaries of the CO District and also the issue of the Rec Path. Mr. Lougee said they will show a 20 ft. easement along the I-89 boundary for. the Rec Path. It will be shown on the final plat. They will talk further about the Rec Path at a later. date. Mr.. Burgess said there had been a question of whether the road had to be upgraded but since the application has been changed to a boundary line adjustment, that is now a non -issue. Mr. Lougee said they want to argue on the CO District boundary. Mr. Burgess noted the issue is how boundaries adjoining an Inter- state are'� defined. At one time the Commission inadvertantly approved sgmething showing CO District boundaries differently. Mr. Weith',read from the Zoning Regulations. Mr.. Lougee noted the U Mall setbacks are not 100 ft. and other buildings are no more than 50 ft. from the ramp. Mr. Sheahan said there is a question of whether. the Commission is being unfair to this applicant. But he was not comfortable with 50 ft. Other members felt a precedent had been established but that in the future it would be interpreted as in the Zoning Regulations. The aplicant was uncomfortable with this. Mr. Beaudin suggested getting legal advice. Mr.. Weith suggested taking it off the plat for now and resolving it with the City Attorney. Members agreed. This letter responds point by point to comments in your memorandum to the Planning Commission dated May 16, 1996. I have incorporated many of your suggestions into the revised Plat Plan which I shall send by next Wednesday. However, my client believes your memorandum contains several inaccuracies which affect its interest in its property and requested that I respond to them. 1. Boundary Line Adjustment. The boundary lines from the boundary line adjustment have been removed. 2. CO Zoning Districts. The second issue concerns the location of CO District and its impact on the Cupola Golf Course property. Your memorandum to the Planning Commission stated that "The CO Zoning District boundary line is not shown as interpreted by staff and shown on the Zoning Map." As you may recall from the last time we discussed this issue at the boundary line adjustment, Cupola Golf Course, Inc. maintains that the CO zone as represented on the Sketch Plan accurately reflects the plain meaning of the City of South Burlington Zoning Regulations, past interpretation of the Planning Commission and past practice of the Planning Commission as it has applied the regulation to nearly every other property adjacent to interstate ramps in South Burlington. Accordingly, Cupola Golf Course, Inc. respectfully requests that staff reinterpret its finding to acknowledge the location of the CO District in the area of the Ramp as it is represented on Cupola Golf Course, Inc.'s Sketch Plan. Article III, Section 3.10, subsection 3.101 governs the boundaries of the CO District in the vicinity of I-89 and I-189 and the interstate ramps. It states the boundaries of the CO District shall include: a. All land within 150 feet horizontal distance of Interstate 89 and Interstate 189 rights of way and within 50 horizontal distance of the Interstate ramps right-of-way, both existing and planned. South Burlington Zoning Regulations at Page 7. (Emphasis added). The plain meaning of the subsection 3.101(a) quoted above establishes two separate boundaries for the CO Zoning District. One from the ramps of 50 feet and one from the highway of 150 feet. I have asked Mr. DesLauriers to provide you with a map from the highway department of where the Interstate ramp right of way begins in the area of Cupola Golf Course Property. Cupola Golf Course, Inc.'s sketch plan reflects a 50 foot set back from that location. Mr. DesLauriers has also supplied you with minutes of a Planning Commission Meeting in 1988 interpreting the boundaries of the CO District to be as represented on Cupola's sketch plan. Moreover, precedent in the areas of the other ramps clearly establishes the Planning Commission has held the setback from the ramp to be 50 feet. The University Mall's new parking addition across the street from Cupola Golf Course, Inc.'s property and the storage sheds on Swift Street serve as two primary examples of this interpretation. Accordingly, Cupola Golf Course, Inc. respectfully requests that the Planning Commission interpret Article III, section 3.10, subsection 3.101(a) within its plain meaning and in accordance with past precedent. Cupola Golf Course, Inc. further requests that the Planning Commission approve the Zoning District as represented on Cupola Golf Course, Inc.'s sketch plan. 3. Acreage and Lot Numbers. The sketch plan has been revised to show the acreage of lots and the lots have been renumbered so lot 3A will be lot 3 and lot 3B will be lot 6. 4. Lots and Zoning. We will discuss this at sketch plan. 5. Traffic Plan. We plan to submit a traffic plan prior to this meeting. 6. Access. You correctly note that access is currently provided by the privately owned Quarry Hill Road. However, my client is concerned that you have quoted language pertaining to use of the 50' right of way to East Terrace (an existing quiet residential neighborhood) and applied it out of context to the Quarry Hill Road. The Quarry Hill Road was constructed in the early 1960's to provide access to the commercial enterprises at Cupola Golf Course, Inc. As such it has always had a commercial purpose as evidenced by the commercial zoning on the majority of the land which it serves. Currently, the road serves only 4 driveways. One serving a triplex and single family home, a primary and emergency access serving the Horizon Heights Road, and the final access to Cupola Golf Course property. Horizon Heights has its own road system by design. It was never intended to alter the commercial nature of the Quarry Hill Road any more than Kennedy Drive's commercial nature is altered by its providing access to a number of condominium road systems. You are also correct in that both the City of South Burlington and Cupola Golf Course, Inc. anticipated upgrading the Quarry Road to a City Street for future development after Horizon Heights. However, the intent of this subdivision is to provide flexibility and financial opportunity to the Cupola Golf Course, Inc. Although anticipated access has been depicted at your request for planning purposes, no development is proposed in this subdivision application. This subdivision will have absolutely no effect on the health, safety, or welfare of any property owner in the vicinity of the Cupola Golf Course Property. Imposing a requirement to develop infrastructure necessary to support as yet unknown development constitutes poor planning (How can one tailor a project to a type of development, when one doesn't know what the development shall be) and places such an economic burden on the applicant defeating the entire purpose of the application. Accordingly, Cupola Golf Course, Inc. is respectfully requesting that the Planning Commission waive its requirement to upgrade the Quarry Road until actual development of some property is proposed and the Planning Commission has the opportunity to evaluate the purpose the road is to serve. Ray, please review these comments and share them with Joe Weith and the Planning Commission. I look forward to seeing you at the meeting June 10, 1996, and working towards resolving these issues. I am certain we can find a way to allow Cupola Golf Course, Inc. the flexibility to subdivide and manage its property in a manner consistent with the plans and best interests of the City of South Burlington. The proposed building is planned on top of a large drainage pipe which serves a large portion of Williston Road. The City replaced a portion of this pipe recently and the black top patch is visible. This pipe must be relocated if possible. 3. The street intersection r.o.w. is back of the concrete curb. An additional 6 feet should be deeded to the City to accommodate a sidewalk and a sign if necessary. 4. The 5 parking spaces along the north side of the liquor store are substandard. 3. Site plan should show how the site drains. ARRY HILL SUBDIVISION - SPEAR STREET 1. The proposed road has a reversed curve. I understand from Mr. Lougee that his client intends to have a closing on this property on Monday, October 16, 1995. Consequently, I believe this matter may qualify for the empty spot on the "A Priority List" which was recently vacated by Dynapower. Please note, however, that these instruments are not consistent with the City of South Burlington's longstanding policies. First of all, in both cases the Grantor, Cupola Golf Course, Inc., seeks to convey to the City the easement/right-of-way by way of a quitclaim deed rather than a wArKanty deed. In a transfer of property by a quitclaim deed the grantor does not make any warranties with respect to the property. It basically conveys whatever the owner has, but makes no ongoing representations or warranties. I believe that we ,should push for warranty deed language certainly with respect to the easement to be shared with Champlain Water District. Second, in both instances the property being conveyed is already encumbered. In one instance, there is a pre-existing 20 foot wide utility easement granted to Champlain Water District. In the other, the Grantor proposes to convey to us a right-of-way over their access road, a distance of 337 feet, within the existing 60 foot right -of --way. Sketch plan applicatiion of Wiemann-Lamphere Architects, Inc, for the construction of a 50,000 sq. ft. addition to an existing 82,700 sq. ft. light manufacturing facility (Dynapower), 1020 Hinesburg Rd: Mr. Lavigne showed the current access, loading dock and main entrance. The facility is expected to employ 150 people. There are now 120 employed. The new addition is for new equipment. They will close off one truck well and move it to the new addition. They will also continue the fire lane around the new addition. Sewage and parking are adequate. They will, however, add some handicapped spaces and a bike rack. They will also add one light over the truck access area. The color of the building siding will be matched as closely as possible. Mr. Sheahan noted the 1988 approval stipulations that rooftop aparatus must be screened. That was never done. Mr. Lavigne said the equipment is currently in a box enclosure and asked how it might be further screened. Mr. Sheahan noted that Lane Press did a very good screening job for their equipment. Mr. Sheahan also said there are some building mounted lights that are not downcasting and shielded and they project into the res- idential zone. He asked that those be downcast and shielded. Mr. Lavigne said all new lights will be shielded fixtures. Mr. Teeson asked about landscaping. Mr. Lavigne noted they had previously planted an orchard. Mr. Lavigne said they will put trees on Hinesburg Rd. and also move berms and some trees. Mr. Burgess said the Commission would reserve the right to ask for landscaping where it feels it is needed and will rely on staff comments. No other issues were raised. 9. Mr. Burgess noted that since this is a further subdivision, the applicant will have to follow the subdivision stipulations for Horizon Heights which require the road to be brought to city standard. A zoning permit should be obtained for the non -windmill tower. 9) CUPOLA GOLF COURSE, INC. - 4 LOT SUBDIVISION - SKETCH PLAN This project consists of the subdivision of a 25.7 acre parcel into four (4) lots of 2.9 acres, 3.2 acres, 8.3 acres and 11.3 acres. The 3.2 acre lot (lot #1) is to be merged with the adjacent 89-2 Realty Company property (Staples Plaza) as a boundary adjustment. A portion of the 8.3 acre lot is developed with the Quarry Hill Club. This property located at 360 Spear Street lies within the R4, R7, Cl and CO Districts. It is bounded on the north by the Burlington Tennis Club and Staples Plaza, on the east by I-89, on the south by the Horizon Heights residential development and on the west by residences along East Terrace. Access: Access to this property is provided by a private road (Quarry Hill Road) from Spear Street. However, this letter responds to the comments in your memorandum to the Planning Commission dated August 18, 1995. My client believes your memorandum contains several inaccuracies which affect its interest in its property and .requested that I respond to them. Access. The first issue regards access to the property. You correctly note that access is currently provided by the privately owned Quarry Hill Road. However, my client is concerned that you have quoted language pertaining to use of the 50' right of way to East Terrace (an existing quiet residential neighborhood) and applied it out of context.to the Quarry Hill Road. The Quarry Hill Road was constructed in the early 1960's to provide access to the connercial enterprises at Cupola Golf Course, Inc. As such it has always had a corrinercial purpose as evidenced by the commercial zoning on the majority of the land which it serves. Currently, the road serves only 4 driveways. One serving a triplex and single family home, a primary and emergency access serving the Horizon Heights Road, and the final access to Cupola Golf Course property. Horizon Heights has its own road system by design. This subdivision will have absolutely no effect on the health, Safety, or welfare of any property owner in the U vicinity of the Cupola Golf Course Prop�:rty. I,rf,osing a requirement to develop infrastructure neC_e�;3a-cy to eupport as yet unknown development constitutes p,)<--.- planting (How can one tailor a project to a type of development, when one doesn't know what the development shall be) and places such an economic burden on the applicant defeating the entire purpose of the application. Accordingly, Cupola Golf Course, Inc. is respectfully requesting that the Planning Commission waive its requirement to upgrade the Quarry Road until actual development of some property is proposed and the Planning Commission has the opportunity to evaluate the purpose the road is to serve. Zoning Districts. The second issue concerns the location of CO District and its impact on the Cupola Golf Course property. Your memorandum to the Planning Commission stated that "the CO Zoning District boundary line is not shown as the Planning Commission has previously interpreted how the 150 Interstate Co merges with the 50 foot CO zone along the interstate ramp." On the contrary, Cupola Golf Course, Inc. maintains that the CO zone as represented on the Sketch Plan accurately reflects the plain meaning of the City of South Burlington Zoning Regulations, past interpretation of the Planning Commission and past practice of the Planning Commission as it has applied the regulation to nearly every other property adjacent to interstate ramps in South Burlington. Accordingly, Cupola Golf Course, Inc. respectfully requests that you reinterpret your finding to acknowledge the location of the CO District in the area of the Ramp as it is represented on Cupola Golf Course, Iuc.'s Sketch Plan. Article III, Section 3.10, subsection 3:101 governs the boundaries of the CO District in the vicinity of I-89 and I-189 and the interstate ramps. It states the boundaries of the CO District shall include; a. All land within 150 feet horizontal distance of Interstate 89 and Interstate 189 rights of way and within 50 horizontal distance of the Interstate ramps right-of-way_, both existing Aad planned.. South Burlington Zoning Regulations at Page 7. (Emphasis added). The plain meaning of the subsection 3,101(a) quoted above establishes two separate boundaries for the CO Zoning District. One from the ramps of 50 fPet acid one from the highway of 150 feet. I have asked Mr. DeeLauriers to provide you with a map from the highway department of where the Interstate ramp right of way begins in the area of Cupola Golf Course Property. Cupola Golf Course, Inc.'s sketch plan reflects a 50 foot set -rack from that location. In your memorandum you implied that the language defining the zoning district should be read to include the larger of the two districts in all cases and further implied the Planning Commission ha8 adopted that reading. Accordingly, Cupola Golf Course, Inc. respectfully requests that the Planning Commission interpret Article III, section 3.10, subsection 3.101(a) within its plain meaning and in accordance with past precedent. Recreational Path._ This is the first Cupola Golf Course, Inc. has heard of this issue. My client has some ideas as to locations more aesthetically pleasing to the user and which may work better for itself, but is willing to keep an open mind on this subject. Preliminary Plat. Cupola Golf Course, Inc. hopes it may be able to combine its' preliminary plat and final plat review and hereby requests that the Planning Commission consider this request since no construction is anticipated. Synon Group Subdivision, Cupola Golf Course, Quarry Hill Road The Synon Group proposes to subdivide a 1.55 acre parcel from the 26+ acre golf course property. The area is zoned Residential Seven. Streets: Access is proposed from Quarry Hill Road that also serves Horizon Heights and the Quarry Hill Club. In the Horizon Heights approval it is clear that the road must be upgraded to a City Street upon any further development in this area. Ralph Deslauriers is requesting that this upgrading be phased with development of this lot and additional lots. I believe the street should be 30 feet of pavement width with curbs and sidewalk on one side with no waiver to this requirement. (See enclosed minutes from 1976 and 1977.) Utilities: The plans show sewer lines. Water has not been located accurately yet but should be shown prior to recording. See Bill Szymanski's comments regarding this. Other: As requested by the Planning Commission at sketch plan, the closest Horizon Heights building is shown on the subdivision plan. The Zoning boundaries are not shown but should be available at the meeting as the Commission requested. See Bill Szymanski's comments. 3. Synon Group Day Care, Quarry Hill Road The Synon Group proposes to construct a 9800 square foot daycare/office building on two floors (4900 square feet per floor) for MCHV. The property is zoned R7 and this conditional use was approved by the Zoning Board. Access: Access is shown from Quarry Hill Road. This should be upgraded to a City Street and a bond posted prior to permit. The driveway into the property is 22 feet wide. Circulation: Circulation is shown on two sides of the building with a cul de sac / drop off area on the south side of the building. . �yemorand uin May 27, 1988 Page 2 Parking: The 4900 square foot office care for 60 children requires 12 standards for 32 total spaces. The dumpster blocks one of these spaces. requires 20 spaces. The day spaces using Burlington's plan shows 41 spaces but a Landscaping: The $700,000 building requires $14,500 in new landscaping. The plan is valued at approximately $10,200 and should be revised to reflect the required amount prior to permit. 1:6,� . Traffic: En osed is a traffic study by Roger Dickinson. The study conc des that 78 trip ends will be generated during the p.m. pea hour. It estimates that 75% will access from Spear Street. Quarry Hill Road will have a level of service A both with and without the project in 1988 and 1993. Although the study finds that no additional turning lanes are needed, the width of Quarry Hill Road is substandard, according to the study. Upgradin i to a C' Street will solve this problem. Craig Leiner has reviewed the study and has no comments on it. Sewer: The office requires 300 gallons per day sewer allocation; the day care requires 1005 gpd for children and staff for 1305 total. The $2.50 per gallon fee must be paid prior to permit. Setbacks: The proposed building does not infringe on the 50 foot setback from the interstate ramp or the setback from the brook (Conservation Zone). Other: See Bill Szymanski's and Chief Goddette's comments. 4) Village at Dorset Park, Southsett Partnership, 900 Dorset Street Southsett Partnership proposes to develop 108 multi -family units in 27 buildings and 70 single-family lots on 40 acres. The area is zoned Agricultural- Rural Residential. Access: Access is shown from the 32 foot wide Swift Street Extension within an 80 foot right-of-way that will be deeded to the City. Two streets run northerly from Swift Street extension to serve the development. Circulation: Circulation is adequate with all public streets throughout the project. Parking: The multi -family buildings show 12 spaces for every 4 units including garage spaces. Subdivision applications of Horizon Heights and Cupola Golf Course, Inc. Mr. Page explained there were two applications, one from Cupola Golf Course to subdivide their land, and another from Milot and Bruce to develop 11 acres. Mr. Poger said he had thought it was to be considered a single parcel in order to get the road approved. Mr. Page said that was really a technicality. The subdivision would not be approved unless it were on the 39 acres. The 11 acre lot is new and the creation of that lot has to be approved by the Planning Commission. There were two applicants; one, the owner of the property being subdivided into two lots; the other, the party developing that lot being set off. MY. Poger referred to the motion prepared by Mr. Page for approval for the Horizon Heights Apartment proposal, saying that nowhere does it say the road must be upgraded to City standards. If anybody else comes in, Quarry Hill would have to bring it up to City standards. Mr. Page explained this was covered under Section --9 of the motion. In the motion prepared for Cupola Golf Course approval, Chairman Wessel questioned the use of the words "are waived" in Section 4 because he thought the monuments and lot markers had already been deleted. Mr. Page explained it was correct as written because the monuments and lot markers are permanent. The things which had been excluded were the temporary lot. markers. Poger explained that by voting approval of the road to be brought up to City standards the Commission has already decided the Cupola or the developer will bring it up to City standards. Mr. Morency asked if traffic had been resolved for the remaining lot of 29 acres. Mr. Poger said the Commission had stated it would not allow commercial development to take place with access through that residential area, so if It was developed commercially it would have to have some other access. They have been warned that by allowing residential development they have precluded their option of having something other than housing in that area unless they find some other access. Mr. Wessel said he thought it was the respcnsibility of the Planning Com- mission to rezone the rest of the property. Mr. Poger said the thought had been that this would be commercial and have some other access. There might be some possibility of Cupola working with Gaynes. But if they have land locked themselves, he didn't think they would come to the Planning Commission. He felt the point had been wade very clearly to both the developer and to Mrs. DesLaurters that the zone could be changed. Mr. Wessel asked about the pedestrian trail along the Interstate. Mr. Page referred to Section 3 in his motion and added that the layout of the trail is not going to change the layout of the property. Mr. Schuele said in two or three years this could be very difficult unless It was spelled out now. Regarding access to the remaining 28 acres, Mx. INC. - 4 LOT SUBDIVISION - SKETCH PLAN --- plan should show access to the 2.9A., 11.3A. and 3.2A lots. -- lots should be numbered. --- the plan should show the Conservation and Open Space District boundary along the interstate (see Section 3.101 of the zoning regulations). The 2.9 acre lot is basically undevelopable. --- the legend identifies the zoning boundary lines as right-of- way or easement lines, this should be corrected. --- zoning boundary lines do not appear to be correctly depicted, consult with planning office for correct locations. --- staff is concerned with possible future ramifications of approving this subdivision. If loans are defaulted, it could end up with four different owners wanting to develop. The City of South Burlington has a small parcel of adjacent land. It should be shown on the plan. 2. There exists a 60 foot r.o.w. adjacent to Dooley property to this parcel. It should be shown. 3. There exists water and sewer easements across this parcel from the Williston Road direction. They should be shown on the plan. DYNAPOWER CORPORATION- HINESBURG ROAD Preliminary site plan is acceptable, however, final plan shall include site drainage, etc. TIMBERLAKE ASSOCIATION - EXXON STATION - WILLISTON ROAD 1. It is recommended that a 3 foot grass strip be provided between the sidewalk and curb at the intersection of East Terrace and Williston Road. This is mainly because of snow removal. 2.
