Discussion regarding land acquisition for the recreation path Mr. Craiq noted one resident had asked how easements would impact property owners nearby. He didn't think people should go out and get easements and then be told the easement isn't in a good place. He felt there should be guidelines as to where easements should be. Mr. Weith noted the following topics were discussed with the Committee: voluntary easements, 20-foot permanent easements with 5 ft. temporary easements during construction, contacting of private property owners by the Committee, residents within 100 ft. of the route crossing private property would be contacted (Mr. Craiq felt this should be 150 ft.), obtaining of easements by the Planning Commission through the subdivision process. Mr. Weith also noted the Recreation Committee and the Natural Resources Committee have agreed on what happens when both paths are in the same area. 5. Public Hearing: Preliminary Plat application of Dennis Blodgett for an 18 unit planned residential development on a 4.4 acre parcel located on Holmes Rd. east of Shelburne Rd. Mr. Llewellyn reviewed the history of the project. There are now 5 buildings planned which will ring the private street. The street will be 24 ft. wide with no curbs or sidewalks. Utilities will be extended from Mery Brown's commercial project on the ad- jacent lot. Mr. Weith noted that Mr. Gardner of CWD would prefer to have the water line looped in with the Green Mountain Dr., or at minimum to extend it to the end of the Holmes Rd. Extension and across the road and capped and valved. A turn -around at the end of Holmes Rd. Extension will be paved. Mr. Weith noted a drainage plan has now been submitted to Heindel & Noyes who have not yet responded. The question of density was raised. The allowable number of units is 17.6. No members had a problem with allowing 18 units. There will be 45 parking spaces. 42 are required. There will be a qarage in each unit. No parking will be allowed on one side of the 24 ft. road. It will be signed to this effect. Mr. Craig said there should be no conversion of garages to living space, and by-laws must indicate this cannot be changed without City approval. Mr. Llewellyn said they are looking for credit for existing trees. Mr. Weith will visit the property and mark the trees to be saved. A 50 ft. buffer around the project will be provided and the area in the center will be undisturbed. PLANNING COMMISSION 11 JULY 1989 page 3 144 peak hour trips are allowed for this property. It is estimated the project will generate only 13. Mrs. Maher moved the Planning Commission approve the Preliminary Plat application of Dennis Blodgett for construction of an 18 unit planned residential development as depicted on a 7 page set of plans entitled "Blodgett Property Development, Overall Site Plan," prepared by Fitzpatrick -Llewellyn, Inc, and dated May, 1989 with the following stipulations: 1. A $20,500, 3 year landscaping bond shall be posted prior to permit. A $7,500 credit is granted for existing trees. The ex- isting trees which will make up the credit must be tagged and ap- proved by the City Planner prior to Final Plat review. 2. Stormwater drainage and runoff shall be evaluated by Heindel & Noyse and results of the analysis shall be reviewed by the City Engineer prior to Final Plat review. 3. Street lights shall be installed prior to the sale of units. 4. A bond in an amount to be determined by the City Engineer for the new street, sewer, water & sidewalk shall be posted prior to permit. 5. A $200.00 per unit recreation fee shall be paid prior to permit. 6. A $462 Shelburne Road intersection fee shall be paid prior to permit based on the 13 trip ends generated by the development. peak hour � 7. A 25 ft. buffer along the north and eastern property lines shall be left undisturbed. This buffer strip shall be shown on the Final plat and addressed in the condominium assosiaction rules 8. A 8100 gpd sewer allocation is granted. The $2.50 per gallon fee shall be paid prior to permit. 9. The developer shall furnish and install the street signs and stop signs. 10. "No parking" signs shall be installed along one side of the private street. 11. Legal documents for the new street (Offer of Dedication and Deed) shall be submitted to the City Attorney for approval prior to permit. PLANNING COMMISSION 11 JULY 1989 page 4 12. Condominium association rules and covenants which address the 25 ft. buffer strip and prohibit the conversion of qaraqe space to living space (in order to preserve number of parking spaces) shall be submitted to the City Attorney for review and approval prior to permit. No changes shall be made to rules and covenants without Planninq Commission approval. The City reserves the riqht to enforce this provision. 13. The property shall be staked prior to Final Plat review in order to show the proposed location of Holmes Rd, the private road and units. 14. The plan shall be revised prior to Final Plat to clearly show th portion of land to be dedicated to the City for Holmes Road. 15. Driveways shall have a depressed concrete curb. Sidewalks shall be concrete and shall be 8 inches thick at driveways and 5 inches thick otherwise. This shall be indicated on the plans. 16. More inlets for site drainaqe shall be shown. The location and number of inlets shall be approved by the City Engineer prior to Final Plat. 17. The plan shall be revised to show underqround electric and telephone lines in an easement outside the Holmes Road r.o.w. 18. Water line shall be extended to the south side of Holmes Rd. and shall be valved and capped. 19. The private road shall be built to City specifications with the exception of curbs. 20. Page one of the plans shall be corrected (Note #5 referring to off-street parking) to read "require 42 spaces, provided: 45 spaces. 21. The Final Plat shall be submitted within 12 months or this approval is null and void. Mr. Burqess seconded. The motion passed unanimously. .Public Hearinq: Proposed amendment to the South Burlinqton Zoninq Regulations to establish a Queen City Park Zoning District in an area of the city generally bounded on the west by Lake Champlain & Red Rocks Park, on the north by Queen City Park Rd., on the east by the Vermont Railroad and Potash Brook, and on the south by Potash Brook.
