Utilities shown do not purport to constitute or represent all utilities located upon or adjacent to the surveyed premises. Existing utility locations are approximate only. The Contractor shall field verify all utility conflicts. All discrepancies shall be reported to the Engineer. The Contractor shall contact Dig Safe (888-344-7233) prior to any construction. I 2. All existing utilities not incorporated into the final design shall be removed or abandoned as indicated on the plans or directed by the Engineer. 3. The Contractor shall maintain as -built plans (with ties) for all underground utilities. Those plans shall be submitted to the Owner at the completion of the project. 4. The Contractor shall repair/restore all disturbed areas (on or off the site) as a direct or indirect result of the construction. 5. All grassed areas shall be maintained until full vegetation is established. 6. Maintain all trees outside of construction limits. 7. The Contractor shall be responsible for all work necessary for complete and operable facilities and utilities. 8. If the building is to be sprinklered, backflow prevention shall be provided in accordance with AWWA M14. The Site Contractor shall construct the water line to two feet above the finished floor. See mechanical plans for riser detail. 9. The Contractor shall submit shop drawings for all items and materials incorporated into the site work. Work shall not begin on any item until shop drawing approval is granted. 10. In addition to the requirements set in these plans and specifications, the Contractor shall complete the work in accordance with all permit conditions and any local Public Works Standards. 11. The tolerance for finish grades for all pavement, walkways and lawn areas shall be 0.1 feet. 12. Any dewatering necessary for the completion of the sitework shall be considered as part of the contract and shall be the Contractor's responsibility. 13. The Contractor shall coordinate all work within the City R.O.W. with the City Public Works Department authorities and all work within the State R.O.W. with the Vermont Agency of Transportation. 14. The Contractor shall install the gas, electrical, cable and telephone services in accordance with the utility companies requirements. 15. Existing pavement and tree stumps to be removed shall be disposed of at an approved off -site location. All pavement cuts shall be made with a pavement saw. 16. If there are any conflicts or inconsistencies with the plans or specifications, the Contractor shall contact the Engineer for verification before work continues on the item in question. 17. Property line information is approximate and based upon a plan entitled "Plat Showing As -Built Survey Friendly Ice Cream", prepared by Warren A. Robenstien, L.S., dated Jan. 29, 1996. Monumentation found was consistent with the above reference plat. This plan is not a boundary survey and is not intended to be used as one. 18. The project benchmark, of 207.4', is a rebar set in the grassed median near the northeast corner of the property. Grandview Farms Inc, hereinafter referred to as the applicant, is seeking to amend a previously approved plan for a 116 seat standard restaurant. The amendment consists of: 1) constructing a 1,360 sq. ft. patio, 2) revise landscaping, and 3) revise parking layout, 1184 Shelburne Road. TRAFFIC This property is located in Traffic Overlay District Zone 2, which limits this property to a maximum of 26.15 PM Peak Hour Trips (based on a 52,291 sq. ft. lot). However, the property is currently grandfathered at an existing 47.56 PM Peak Hour Trips (based on 116 seats of high turnover sit down restaurant). The applicant and the Board agreed at the last meeting that the project would not be evaluated under the high turnover ITE land use category but instead, actual traffic counts would be gathered from a similar facility somewhere in New England. The applicant has submitted a cover letter from Civil Engineering Associates dated 7/6/12 and a copy of a report from a traffic engineer dated 7/2/12. The report concludes that the proposed restaurant could include up to 120 seats and not exceed the current trip generation maximum of 47.56 pm peak hour trip ends. Staff had a number of issues with the report and how, when and where the counts were conducted. First, the counts were only conducted for a total of two (2) days. These counts should be taken for more days and in consecutive weeks. Another issue was that the counts were taken from 5 pm to 8 pm which does not comply with Section 10.02 (F) (3) of the LDRs. Staff also notes that the property is within the Traffic Overlay District because it has a curb cut directly on Shelburne Road. Closing this curb cut will remove the property from the Traffic Overlay District and remove any cap on trip ends generated. The property has a second curb cut from McIntosh Avenue, which forms a signalized intersection with Shelburne Road. Additional information maybe made available at the meeting indicating that the applicant is supportive of the technical report. (CEA) on September 24, 2012 regarding the application for a free- standing Panera Bread on Shelburne Road in South Burlington. The new material submitted is a traffic generation analysis for a free-standing Panera in Seven Hills, OH. We also obtained today some clarifications regarding the seating for the Seven Hills Panera. The Seven Hills, OH Panera has a floor area of 5,282 SF and 143 seats inside as well as 30 seats outside. A traffic study prepared by American Structurepoint, Inc. concludes that the PM peak -hour traffic generation is 64 vehicle trips, corresponding to a trip generation rate of 0.45 vehicle trips per seat or 12.12 vehicle trips per 1000 SF. We have the following comments: Calculation of Seven Hills Panera Traffic Generation: the consultants undertook traffic counts during the 4 to 6 PM peak period over 6 days (Tuesday, Wednesday and Thursday over 2 consecutive weeks), calculated the peak -hour traffic for each day, then took an average of the 6 measurements. This yielded the generation of 64 vehicle trips. However, if we were to take the averages for each day of the week, we would obtain the following generation numbers: Tuesday 61.5, Wednesday 59 and Thursday 71.5. If we were to undertake a traffic impact study we would use the rate that occurs on the highest day, i.e. 71.5 vehicle trips (with Friday probably being higher). However, I checked the ITE Trip Generation User's Guide in regards to how they accept the traffic generation studies that enter into their Trip Generation Informational Report. They expect average weekday (Monday -Friday) data. In view of our reliance on ITE methodologies 1 would accept the 64 vehicle generation for the Seven Hills Panera. 2. Determination of Independent Variable and Traffic Budget: It is our understanding that the former Friendly had a floor area of 4,750 SF and 116 seats (24 seats per 1000 SF). If we use the seats as an independent variable and use the land -use category of High - Turnover (Sit Down) Restaurant, this would give them a budget of 48 vehicle trips (1 16 X 0.41=47.56). Then using the traffic generation rate of 0.45 vehicle trips per seat from Seven Hills Panero would yield 107 seats inside. Based on the fact that the Seven Hills Panera also had 30 seats outside, and the "outside" traffic was included in the traffic generation, the traffic budget principle used by the City of South Burlington would allow an equivalent number of seats outside, i.e. 22 seats (30/143 X 107). If instead of the seats, we use the floor area as an independent variable (which would be more appropriate according to the City's rules, since it is a primary variable as opposed to a derived variable), we would calculate a budget of 53 vehicle trips (4.75 X 1 1.15 = 52.96). And if we apply the Seven Hills Panera traffic generation rate of 12.12 we obtain Ray Belair, Administrative Officer September 26, 2012 Pacae 2 a maximum of 4,373 SF of floor area, or 92% of the current floor area of the former Friendly's. Based on this analysis we propose that the proposed Panera be allowed to have 107 seats inside, and, if the City code allows, up to 22 seats outside. The proposed seating maximum of 107 seats is less than the 116 seats that Friendly's had. This is due to the fact that Panera generates more traffic per 1000 SF compared to Friendly's. I summarized the traffic generation data in the attached spreadsheet. Here are my preliminary conclusions: 1. The Thursday PM period is higher than the Friday PM period. This is true for the 3-hour period (5 to 8 PM) as well as for the 2 individual hours 5 to 6, and 6 to 713M. 2. The Friday traffic data show that the 4 to 5 PM hour is higher than the 5 to 6 PM hour. 3. We do not know whether a free-standing Panera has different traffic generation characteristics from a Panera that is attached to other buildings in a larger shopping setting. ITE does not seem to differentiate between these two settings, which may imply that there is no difference. ITE does differentiate between urban and suburban settings, and facilities with and without drive- throughs. My conclusion is that the Norwalk data are not sufficient to draw a conclusion regarding the traffic generation in relation to the City's TOD regulations. We do need to get traffic generation data for a Tuesd, Wedn or Thursday (preferably for all 3) for the time period from 4 to 6 PM. These data should be collected for an independent/free-standing site such as the one proposed in Arlington, TX. It would be useful to collect these data for similar periods as for the Norwalk site (in addition to the 4 to 6 period) so that the rates can be compared. TRAFFIC This property is located in Traffic Overlay District Zone 2, which limits this property to a maximum of 26.15 PM Peak Hour Trips (based on a 52,291 sq. ft. lot). However, the property is currently grandfathered at an existing 47.56 PM Peak Hour Trips (based on 116 seats of high turnover sit down restaurant). The traffic count and trip generation study was conducted by Scott Hesketh. P.E. and F.A. Hesketh & Associates, Inc., a traffic engineering consulting firm located in East Granby, CT. This cover letter attempts to serve as the bridge between the results of this study and the impact on the Panera Bread restaurant proposed for 1184 Shelburne Rd. in South Burlington, VT that is under consideration by the Development Review Board. Short of recreating the report by F.A. Furthermore, although the Norwalk, CT facility is part of a strip center shopping area, the traffic counts performed by F.A. Hesketh & Associates, Inc. separated the Panera Bread trips out from the other destinations. A more detailed explanation of the traffic counts can be found in the attached report by F.A. Hesketh & Associates, Inc. Based on the average PM peak hour traffic count of 48 trips generated by this study, and the existing 121 seats associated with the Norwalk, CT Panera Bread facility, a rate of .397 trips per seat was calculated. With the understanding that the South Burlington site has an existing grandfathered PM peak hour trip count of 47.56, a direct correlation equates to a maximum allowable seat count of 120 seats (47.56 trips/397 trips per seat) for the proposed South Burlington facility. Although there are other mitigating factors to the trip generation that have been outlined in previous submittals, including the entrance only Shelburne Rd. access, the single exit location to McIntosh Ave. and the removal of the old Friendly's walk up window, that may allow for additional seating to be considered, the revised proposed seat count of 120 based on the Norwalk, CT facility study should be adequate for the proposed South Burlington, VT location. At this time, on behalf of the owner, Grandview Farms, Inc., and the applicant, Panera Bread, we would like to respectfully request the Development Review Board to consider allowing the inclusion of 120 total seats at the proposed Panera Bread to be located at 1184 Shelburne Rd. in South Burlington, VT. This letter presents a summary of our findings. It is our understanding that this letter will be submitted as part of an application for site plan approval and a special use permit for a conversion of a former Friendly's restaurant to a proposed Panera Bread restaurant use in South Burlington, Vermont. The Panera Bread restaurant in Norwalk, Connecticut is located on Route 1, Westport Avenue. The restaurant is part of a small strip center that includes Frame & Save, FedEx Kinkos, and other uses. The Norwalk restaurant has 4,600 s.f. of floor space and a total of 121 seats. The site is presented in Figure 1. Counts were conducted at the Norwalk restaurant from 5:00 p.m. to 8:00 p.m. on Thursday June 28 and Friday June 29, 2012. Observations were made of the number of patrons entering the facility. Observations were also made of each vehicle into and out of the site and the number of pedestrians to the restaurant. The results of the count are presented in Tables 1 and 2. Peak hour patron counts of 44, during the 6:00 — 7:00 on Thursday, and 43, during the 7:00 — 8:00 hour on Friday were observed. On Thursday a total of 65 entering vehicles and 64 exiting vehicles, resulting in a total of 129 trips were observed over the three hours of observation. On Friday a total of 57 entering vehicles and 57 exiting vehicles, resulting in a total of 114 trips were observed over the three hours of observation. A total of 4 pedestrians and 2 pedestrians were observed on each day, respectively. The average vehicle occupancy was 1.6 people per vehicle each day. Peak hour trip generation of 47 trips, made up of 25 entering and 22 exiting vehicles, and 49 trips, made up of 27 entering and 22 exiting vehicles, were observed on Thursday and Friday, respectively.. The Norwalk facility has a floor area of 4,600 s.f. and a total of 121 seats. With peak hour generation of 47 trips and 49 trips the trip generation rates are calculated to be on average 0.40 trips per seat and 10.43 trips per 1,000 s.f. of floor area. These generation rates are presented in Table 3 Applying these rates to the proposed South Burlington location, the existing 116 seat facility would have a trip generation of 46 trips, made up of 25 entering and 21 exiting movements. The proposed 160 seat facility would have a trip generation of 64 trips, made up of 35 entering and 29 exiting movements. Based on the floor area of 4,500 s.f. a trip generation of 47 trips, made up of 25 entering vehicles and 22 exiting vehicles are projected. Generally, these restaurants serve lunch and dinner; they may also be open for breakfast and are sometimes open 24 hours per day. These restaurants typically do not take reservations. Patrons commonly wait to be seated, are served by a waiter/waitress, order from menus and pay for their meal after they eat. Some facilities contained within this land use may also contain a bar area for serving food and alcoholic drinks. Quality restaurant (Land Use 931), fast-food restaurant without drive -through window (Land Use 933), fast-food restaurant with drive -through window (Land Use 934) and fast-food restaurant with drive -through window and no indoor seating (Land Use 935) are related uses. Additional Data Users should exercise caution when applying statistics during the a.m. peak periods, as the sites contained in the database for this land use may or may not be open for breakfast. In cases where it was confirmed that the sites were not open for breakfast, data for the a.m. peak hour of the adjacent street traffic were removed from the database. Vehicle occupancy ranged from 1.39 to 1.69 persons per automobile on an average weekday. The average for the sites surveyed was approximately 1.52. Stormwater is conveyed via storm drains and piping to the drainage system under McIntosh Avenue. This system connects to the drainage system beneath Route 7 and water is eventually discharged to North Brook and Lake Champlain. Changes to the site plan could provide some on -site stormwater treatment. Possible changes include: • The applicant is proposing to add a green belt median in the parking lot. I recommend configuring the median so that stormwater treatment can be provided within the median. As shown on the "Local Zoning Requirements" chart on sheet C 1.0, although the proposed site has a non -conforming lot coverage calculation, the proposed coverage represents an improvement over the existing lot coverage by 1.2%. • Portions of concrete sidewalk and curbing are planned to be replaced to accommodate the new handicap parking scheme and building entrances, as well as update some areas that were in need of maintenance. • Install a new dumpster enclosure as shown on sheet C 1.1 and as detailed on sheet C2.2. Install a new bike rack as shown on sheet C 1.1. • Install a new sewer service and 1,500 gal. heavy duty grit/oil separator to adequately meet the needs of the proposed restaurant renovation. These will both be tied into the existing sewer service on site. • Install a new 6" D.I. water service to serve both the commercial and fire suppression systems of the proposed restaurant renovation. These plans, as well as the water allocation request, have all ready been provided to the Champlain Water District and received preliminary approval. • Install a new landscaping plan as shown on sheet L 1.0 prepared by Distinctive Landscaping in coordination with the City's landscaping requirements. This plan has all ready been provided to Craig Lambert and received preliminary approval. • Resurface the entire parking lot as a maintenance item upon completion of all other work. The parking spaces will be slightly realigned to accommodate the new green space median and handicap space locations, but a total of 84 spaces will be provided, consistent with the existing layout. We believe this represents a 2 parking space (2.3%) waiver request. Regarding site lighting, a photometric study was conducted and the existing light fixtures were determined to provide sufficient lighting for the existing parking lot, so no changes to the parking lot lighting are proposed. However, the light poles themselves will be painted dark bronze to match the existing light fixture covers. Based on our recent correspondence, we have revised this application to eliminate the additional seating associated with the Administrative Amendment application previously submitted. The proposed plans now call to only retain the existing 116 seats. Based on the previous Friendly's restaurant use with 116 seats, and using ITE Land Use Code 932 (High Turnover Sit Down Restaurant), we calculate the existing Peak PM trips ends for the site at 47.56 trips. As we have discussed, there does not appear to be an applicable ITE Land Use Code for the proposed Panera Bread restaurant. It is our contention, that ITE Land Use Code 932 is the most applicable Land Use Code, and as we are not altering the number of seats, the existing 47.56 trips should meet the needs of the project. The proposed Panera bread restaurant meets most of the description of ITE Land Use Code 932, with the exception of not having wait staff and prepaying for your meal as opposed to paying after you eat. All other general conditions, including turn over time, pricing, number of meals served and a lack of a drive through, are met. The alternative ITE Land Use Code would be 933 (Fast -Food Restaurant without Drive -Through Window), which we don't feel accurately reflects Panera's clientele, as most of Panera's clientele are sit down patrons and a majority of the clientele associated with Land Use Code 933 are carryout patrons. Furthermore, we fell there are some additional mitigating factors specifically related to the existing and proposed trip end generation. First, the existing Friendly's restaurant had a drive up window for ice cream service that is proposed to be eliminated in conjunction with this project. This component is not accurately accounted for in Land Use Code 932. Second, we believe that Friendly's, although a three meal a day restaurant, was predominantly associated with dinner clientele, contributing to a higher Peak PM trip end count. Panera, which also serves three meals a day, typically sees their peak hours around lunch time from 12pm-2pm. In summary, we feel the proposed Panera Bread restaurant would be a welcome addition to the area and represents a use that is consistent with the surrounding properties. There should not be a change in water usage, sewer flow or trip generation associated with this project compared to previous uses on this property. To accommodate this, an existing building will be taken down and replaced with a 30,000 sq. ft. building (with second floor space increasing this to 40,000 sq. ft.) to include a hangar and office space. Mr. McEwing showed the location on the plan. The present uses are being relocated. After the Air Guard moves out of this hangar, a fixed base operator will use the facility. The building is being designed with that in mind. Mr. Boucher asked if there are any asbestos issues. Mr. McEwing said there are some and they will be addressed. Mr. Belair noted several waivers are involved. They are a few hundred dollars short on landscaping. Some landscaping is being placed on Airport property away from this building. They also need additional handicapped spaces. There is also an issue of a floodlight being requested. City regulations don't allow flood- lights. Mr. McEwing said this is to flood aircraft parking and is a safety consideration they must comply with. Floodlights will be cast down, and they are sensitive to lights going off the Airport property. Mr. Dinklage asked about the sign that is supposed to have been placed on the stone wall. Mr. McEwing said they still want to do that, but they haven't had the time. They may come back with a shared parking request, depending on the use of the building. Mr. Llewellyn showed the location of landscaping. There is a question of Bacon Street becoming a public street. Mr. Robertson explained this is an Act 250 issue. Eric Farrell has said he would address this in a few weeks. Mr. Kupferman asked about the rear yard setback. The applicant is requesting the removal of these plants to increase the visibility of the exiting building. The City Arborist reviewed the proposed landscaping modifications and conducted a site visit to assess the condition of the subject landscaping. He provided comments in a memorandum dated February 10, 2005 (attached). In summary, the Arborist stated that the replacement of the two (2) crabapple trees and the juniper adjacent to the sign is warranted due to their condition. In addition, he stated that replacement of two (2) of the Norway Maples was warranted due to their condition. Finally, he recommended preserving the three (3) Norway Maples closest to the building. These plants are each between 1 l" and 13" in diameter. In the event that they are replaced, he recommended replacing them on an inch -by -inch basis, not on a tree -by -tree basis. The applicant shall comply with the requests of the City Arborist, as outlined in his memorandum dated February 10, 2005. 2. The applicant shall submit a landscape plan and landscape budget, prepared by a landscape professional, for any new landscaping on the property. 3. The applicant shall post a landscape bond for the value of the proposed landscaping, prior to the issuance of a zoning permit. This bond shall remain in effect for three (3) years to ensure that the landscaping has taken root and has a good chance of surviving. Friendly's Restaurant Shelburne Rd 2/10/05 The removal of junipers and 2 crabapples around the sign and proposed shrub and perennial bed is acceptable. The trees are in poor condition due to improper pruning. Three of the five Norway Maples in front are in good condition and removal is not recommended. These three trees, which are located closest to the building, have reached 11-13 inch diameter and are starting to provide some of the benefits associated with larger trees. If these three trees are replaced I would suggest an inch for inch replacement rather than a tree for tree replacement. For example two, three-inch diameter trees would replace a six-inch diameter tree. Some credit could also be given for pruning the existing trees to remove dead, broken, or weak limbs, provided the pruning is done to ANSI A-300 standards. The two maples planted closest to Shelburne Rd are only in fair condition and replacement may be warranted. If Callery Pear is used, `Bradford' is an unacceptable cultivar. Mr. Poger agreed, saying the Commission should not re - engineer the building. The motion failed with Messrs. Poger, Woolery and Ewing voting no and Messrs. Mona and Draper voting yes. Mr. Ewing then moved to amend stipulation #2 to read that "Building #2 shall be located at least 40' west of the properlZ line the wa it is shown in red on the plan of record." Mr. Mona seconded the motion and it passed with Mr. Draper voting no. Site plan review for expansion of Friendly Ice Cream's parking lot Mr. Richard Maher represented Friendly and said that they proposed to purchase the lot at 21 McIntosh Avenue and extend their parking lot. The lot is now zoned commercial. He said they had talked to Mr. Bolduc, the adjoining owner, and he did not object. There will be a 15' buffer between the two properties and a 6' fence. A row of white pines will be planted and the present curb cut for the McIntosh property will be closed. Lighting will be cut-off lighting. Mr. Woolery moved that the South Burlington Planning Commission approve the site plan proposal of Friendly's Ice Cream Corporation, to expand its present parking lot as depicted on a plan entitled "Preliminary Plot Plan...", drawn by T B.B dated 5 22 7 subiect to the following stipulations: 1. The 2 lighting fixtures to be relocated to the east Pr_oper line shall be screened so that the adjoining residential yard is not illuminated. 2. The curb cut on the LaJeunesse lot shall be closed. 3. An adequate bond shall be posted to insure the fence extension, new plantings, and closing of the curb cut shown on the plan. 4. The parking lot shall be restriped as shown on the plan. He said there had been a communication problem here and that the work had already been done, because Reilly Tire said they had been told to go ahead and do it. The city has no written confirmation of this, but Reilly feels they did the work in good faith. Mr. Page said that eventually the building would be extended but there are no plans for that now and it will just be used for storage of cars. Because of the separate left -turn stacking lane in the middle of Shelburne Road, it is my opinion that left -turning vehicles into this proposed development should not significantly affect the flow of traffic on Shelburne Road or create an unsafe traffic condition. My limited knowledge of Friendly's Ice Cream restaurants suggests that the patron turnover rate is relatively moderate, even during peak hours of restaurant operations. I concur with the opinion of the South Burlington Planning Commission that the curb cut on Shelburne Road should be signed "Entrance Only" and that the McIntosh Avenue curb cut should be used for both entering and exiting traffic. Sometime in the future, no doubt, the McIntosh Avenue - Shelburne Road intersection probably will have to be signalized; therefore, it appears reasonable to channelize the existing traffic from Friendly's onto McIntosh Avenue and through the signalized intersection, hopefully avoiding the possibility of the access point on Shelburne Road being blocked by the queuing of traffic and restricting the exit movement. It appears from the site plan that with the parking layout and internal flow of traffic illustrated, these recommendations can be satisfactorily implemented without any modifications to the plan. ... After lengthy discussions with our Planning Department, it is obvious that very little can be done to reduce the amount of front yard variance requested. I was told that the traffic aisle leading to McIntosh Avenue could be reduced to 25', but that this reduction would lead to a potentially dangerous situation as cars back out of parking spaces into two -,way traffic ingressing from and egressing to McIntosh Avenue. The concrete pad at the rear of our building is enclosed on all sides, but has no roof. I've learned that not only is our refuse container located here, but a very large condenser occupies approximately half of this area. Although the refuse container could be moved, the condenser cannot. This location has been approved by our Corporate Real Estate Committee subject to our obtaining this variance. Therefore, our execution of the purchase and sale agreement will necessarily be contingent upon the Board's favorable disposition of this request, I'm certain that Friendly Ice Cream Corporation will be an asset to your community in many ways. Moreover, we will all be glad to rectify the unattractiveness of the existing use.
