HomeMy WebLinkAboutSP-96-0000 - Decision - 1030 1048 Shelburne RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Shearer Motor Company, Ltd., to construct a 912 square foot building from retail (photo developing) to auto rental use on a 3.06 acre parcel also containing an auto sales and service facility, 1030 & 1048 Shelburne Road. On the 13th day of February, 1996, the South Burlington Planning Commission approved the request of Shearer Motor Company, Ltd. for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of converting a 912 square foot building from retail (photo developing) to auto rental use on a 3.06 acre lot also containing an auto sales and service facility. The ZBA on 6/26/95 granted the applicant a use variance for the auto rental use since this use is not permitted in the district. 2. This property located at 1030 and 1048 Shelburne Road lies within the Cl District. It is bounded on the north by a motel, on the west by Shelburne Road, on the south by a restaurant, and on the east by Orchard School. 3. Access/circulation: The property is served by two (2) 32 foot curb cuts and a 22 foot curb cut. No changes proposed. Circulation is adequate. 4. Coverage/setbacks: Building coverage is 18.7% (maximum allowed is 30%). Overall coverage is 93.6% (maximum allowed is 70%). Front yard coverage is 91.5% (maximum allowed is 30%). Overall and front yard coverages are existing and will not be made worse by this application. 5. The auto dealership and auto rental buildings do not meet the front setback requirement and the accessory building (auto body shop) does not meet the rear setback requirement. Additionally, there is more than one (1) principal building on this lot and the lot has less than four ( 4 ) acres and does not qualify as a PUD. These buildings are therefore noncomplying structures subject to the limitations of Section 26.002 of the zoning regulations. 6. Parking: A total of the (3) parking spaces are required and four (4) spaces including one (1) handicapped space is being provided for the auto rental use. 1 7. Landscaping: There is no minimum landscaping requirement, based on building costs, for this project. Applicant is proposing to remove two (2) Austrian Pine trees at the southwest corner of the property. Five (5) Honeylocust trees will be planted along the property's frontage in the Shelburne Road r.o.w. at staff's recommendation. VAOT has approved the trees in the r.o.w. These trees have a value of $1738. 8. Traffic: This property is located in Traffic Overlay Zone 2 which would allow this property to generate a maximum of 66.6 vehicle trip ends (vte's) during the P.M. peak hour. ITE estimates the existing uses to generate 69.3 vte's which is 2.7 vte's or 4% more vte's than allowed. ITE estimates that the change in use from retail to auto rental will decrease vte's by 2.5 for a total of 66.8 vte's. 9. Sewer: The sewer allocation requested is 120 gpd. The applicant will be required to pay the per gallon fee prior to permit issuance. 10. Lighting: Existing exterior lighting consists of the following: --- seven (7) 400 watt high pressure sodium flood lights. --- one (1) 400 watt mercury vapor flood light. --- one (1) 250 watt mercury vapor light. --- eleven (11) 400 watt mercury vapor lights. 11. No additional lighting proposed. DECISION & CONDITIONS Based on the above Findings of Fact, South Burlington Planning Commission approves the site plan application of Shearer Motor Company, Ltd., to convert a 912 square foot building from retail (photo developing) to auto rental use on a 3.06 acre parcel also containing an auto sales and service facility, 1030 & 1048 Shelburne Road, as depicted on a site plan entitled "Proposed Auto Rental Facility, 1048 Shelburne Road, South Burlington, VT", prepared by Graphic/Construction Management Services, Inc., dated 12/31/95, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. For the purpose of calculating required road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the proposed change in use will generate zero (0) additional vehicle trip ends during the P.M. peak hour. 2 3. The Planning Commission approves a sewer allocation of 120 gpd. The applicant shall pay the per gallon fee prior to permit issuance. 4. The applicant shall post a $1738 landscape bond prior to issuance of a zoning permit. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 5. Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in lighting shall be approved by the City Planner prior to installation. 6. The applicant shall obtain a zoning permit for the change in use within six (6) months or this approval is null and void. 7. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to use of the newly constructed space. 8.
