HomeMy WebLinkAboutSP-98-0000 - Decision - 0794 Shelburne RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Rexbo Development, Inc. to construct an 840 square foot canopy and add one (1) fueling position on a property developed with a 1299 square foot service station, 794 Shelburne Road. On the 91' day of June, 1998 the South Burlington Planning Commission approved the request of Rexbo Development, Inc. for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of the construction of an 840 square foot canopy and adding one (1) fueling position on a property developed with a 1299 square foot service station. The ZBA on June 8, 1998 granted a request from the applicant for a variance from the front yard setback requirement. 2. This property located at 794 Shelburne Road lies within the C 1 District. It is bounded on the south by Lindenwood Drive, on the west by Shelburne Road, on the north by a restaurant, and on the east by a residence. 3. Access/circulation: Access is currently provided by four (4) curb cuts, two (2) 35 foot curb cuts on Shelburne Road and a 16 foot and 18 foot curb cut on Lindenwood Drive. Staff recommended that the two (2) Lindenwood Drive curb cuts be removed and the area seeded. Circulation on the site is adequate. 4. Coverage/setbacks: Building coverage is 10.3% (maximum allowed is 30%). Overall coverage is 38.2% (maximum allowed is 70%). Front yard coverage is 96.4% (maximum allowed is 30%). This is an existing situation which will not be made worse by this application. 5. The existing service station building meets the setback requirements. The proposed canopy does not meet the front yard setback requirement. The ZBA on 6/8/98 granted a variance request from the applicant. 6. Parking: A total of six (6) parking spaces are required and seven (7) spaces including one (1) handicapped space and a bike rack are being provided. The site plan should be revised to lengthen the southerly parallel parking space to 22 feet. 7. Landscaping The minimum landscaping requirement based on building costs, is $450 which is being met. Proposed plantings include Crabapple, Dogwood, Viburnum, and Rose. 8. Traffic: This property is located in Traffic Overlay Zone 1 which allows this property to generate a maximum of 7.8 vehicle trip ends (vte's) during the P.M. peak hour. ITE estimates that the existing facility generates 47.46 vte's and with the additional fueling position to generate 62.64 vte's. This represents a 15.18 vte increase. Section 21.50 of the zoning regulations allows the Planning Commission to approve peak hour traffic volumes above the normal standards if it determines that other site improvements will produce a net benefit for traffic flow in the vicinity. Improvements proposed include: 1) elimination of the two (2) curb cuts on Lindenwood Drive, and 2) moving the pumps further away from the Shelburne Road r.o.w. The applicant was made aware that the road impact fee for the additional traffic is approximately $3150. 9. Sewer: No additional sewer allocation needed. 10. Dumpster: A screened dumpster storage area will be provided. 11. Lighting Existing exterior lighting will be removed and replaced with the following: — two (2) 175 watt metal halide lamps with downcasting shielded fixtures mounted on 15 foot poles. — six (6) 175 watt metal halide lamps mounted under the canopy. 12. A point by point lighting plan was submitted which indicates that the proposed lighting level will not exceed the three (3) foot candle average measured at ground level. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Rexbo Development, Inc. to construct an 840 square foot canopy and add one (1) fueling position on a property developed with a 1299 square foot service station, 794 Shelburne Road, as depicted on a six (6) page set of plans, page two (2) entitled, "Site Plan Dattilio's Sunoco 794 Shelburne Road South Burlington, VT." prepared by A.R. Sandri, Inc., dated 2/20/98, last revised on 6/1/98, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This property is located in Traffic Overlay Zone 1 which allows this property to generate a maximum of 7.8 vehicle trip ends (vte's) during the P.M. peak hour. Based on ITE trip generation rates, it is estimated that the existing facility generates 47.46 vte's and with the additional fueling position to generate 62.64 vte's. This represents a 15.18 vte or 32% increase. The Planning Commission pursuant to Section 21.50 of the zoning regulations may approve peak hour traffic volumes above the normal standards if the Commission determines that other site improvements will produce a net benefit for traffic flow in the vicinity. It is the Planning Commission's determination 2 that the following improvements will produce a net benefit for traffic flow in the vicinity: a) elimination of the two (2) curb cuts on Lindenwood Drive, and b) moving the pumps further away from the Shelburne Road r.o.w. 3. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the additional fueling position will generate 15.18 additional vehicle trip ends during the P.M. peak hour. 4. Any exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change to approved lights shall require approval of the Director of Planning & Zoning prior to installation. 5. Prior to issuance of a zoning permit, the applicant shall post a $450 landscape bond. The bond shall remain in effect for three (3) years to assure that the landscaping takes root and has a good chance of surviving. 6. There shall be no parking or storage of vehicles or equipment in any area designated on the plan as green space. 7. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 8. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to the use of the canopy and additional fueling position. 9. Any change to the site plan shall require approval by the South Burlington Planning Commission. 10. The plan shall be revised prior to permit as follows: 1) add paving in front of dumpster and add an equal amount of green space to the southwest corner of the property, 2) add a 5 foot strip of green area along the front sidewalk, and 3) relocate a proposed tree to the gap in the treeline along Lindenwood Drive.
