HomeMy WebLinkAboutVR-98-0000 - Decision - 0794 Shelburne RoadSOUTH BURLINGTON ZONING BOARD OF ADJUSTMENT Re: Rexbo Development, Inc. d.b.a Dattilio Sunoco STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Request for a variance 794 Shelburne Road Findings of Fact, Conclusions of Law & Order This matter came before the South Burlington Zoning Board of Adjustment on June 8, 1998 by application of Heidi Bushway, for a variance to construct a 20' x 42' pump island canopy to within nine (9) feet of the required front yard at 794 Shelburne Road according to plans submitted. The Board of Adjustment finds as follows: 1) Area in question zoned C- I District. 2) Section 25.00 Dimensional requirements requires a minimum setback of fifty (50) feet from planned right-of-way. 3) The principal structure is non -complying to required setback. 4) Small lot (20,840 square feet) in a zone that requires 40,000 square feet. 5) Not possible to reconstruct any fueling area within front yard in strict conformity to zoning bylaws. 6) Appellant has not created the hardship, purchased property in July, 1976. 7) Proposed canopy would not alter essential character of the neighborhood or impair the appropriate use of adjacent properties. 8) In order to properly protect customers the minimum width of pump island canopy is twenty (20) feet. 9) All gasoline stations along Shelburne Road have a canopy in order to provide self -serve fueling.
