HomeMy WebLinkAboutVR-97-0000 - Decision - 0067 Proctor AvenueSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 28th day of April, 1997, the South Burlington Zoning Board of Adjustment heard testimony of Michael Jordan regarding a variance application located at 67 Proctor Avenue. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The area in question zoned R-4 District. 2) Section 25.00 requires a minimum side yard of ten (10) feet. A side yard of seven (7) feet is proposed. 3) Lot contains 10,500 square feet with 75 feet frontage. 4) Proposed is the removal of a 6' x 7" lean-to addition and construction of a 91x 14' addition. 5) Property is developed with a single family 24' x 32' cape style dwelling. Conclusion 1) Adjoining property owners support this variance request. 2) The existing bathroom (42 square feet) is sub -standard and in poor condition and must be replaced. 3 ) The proposed new bathroom (126 square feet) would be fitted up with modern facilities to include the washer & dryer and storage area. 4) The dwelling has only a quarter basement area and plumbing would be difficult to relocate. 5) Dwelling constructed over a hundred years ago and modern bathroom is mandated by the age and condition. 6) General character of the area not affected by the variance, side yard abuts wooded area of Rice High School. 1 Based upon the findings and conclusion setforth above, the Zoning Board of Adjustment hereby grants the applicant's request to replace an existing 42 square foot bathroom with a 126 square foot addition to within seven (7) feet to the side yard located at 67 Proctor Avenue.
