HomeMy WebLinkAboutCU-93-0000 - Decision - 0004 Berard DriveFINDINGS OF FACT & DECISION C)0 0 STATE OF VERMONT C COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Pat Ayer for use of 3,200 square feet within an existing 9760 square foot building for a printing and copying business, 4 Berard Drive. On the 15th of September, 1992 the South Burlington Planning Commission approved the request of Pat Ayer for site plan review under Section 19.10 of the South Burlington Zoning Regulations based on the following findings: 1. This proposal is for conversion of 3200 square feet of a 9,761 square foot building for printing and copying use. The remainder of the building, 6561 square feet, will be used for auto repair. 2. This property located at 4 Berard Drive is within the IC District. It is bounded on the east by Pizza -Putt restaurant, on the north by undeveloped land (steep bank), on the south by Berard Drive and on the west by Omega Electric warehouse. 3. Access/circulation: Access is via one (1) 20 foot curb cut on Berard Drive. The auto repair business located in the rear of the building is currently using an access on the adjacent Pizza -Putt property without benefit of an access agreement. Traffic circulation on the site is adequate. 4. Coverage/setbacks: Building coverage is 24.2% (maximum allowed is 30%). Overall coverage is 66.17% (maximum allowed is 70%). Front yard coverage is 13.39% (maximum allowed is 30%). The building does not meet the rear setback requirement, the building is therefore a noncomplying structure. Proposed improvements will not exceed 25% of the fair market value. 5. Parking: The proposed and existing uses on the property require a total of 20 parking spaces, one (1) of which must be a handicapped space The plan shows 20 spaces and no handicapped spaces. 6. Landscaping: The landscaping requirement for this project is $60 which will be met. Plantings will include Norway Maple and rose bushes. Site plan does not show all of the existing landscaping. Plan submitted is confusing as it shows that two (2) large Norway Maple trees are to be planted at the same location where two (2) large 1 d parking lot and it is suggested that one (1) of the Norway Maples be planted in its place. 7. Sewer: Sewer allocation is not necessary since the site has on- site septic disposal. 8. Dumpster: The site currently has one (1) dumpster located at the northeasterly corner of the site on the adjacent property to the north which is not shown or screened. 9. Lighting: Existing and proposed exterior lighting details not submitted. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Pat Ayer for use of 3200 square feet within an existing 9,760 square foot building for a printing and copying business as depicted on a plan entitled "Autobahn Auto Works, 4 Berard Drive, South Burlington , Vermont", prepared by Fitzpatrick -Llewellyn, Inc., and dated May 1992, last revised 8/25/92 with the following stipulations: 1. The plan shall be revised prior to occupancy to show the following: a) One parking space designated as a handicapped space, b) location of septic system, c) location and details of existing exterior lighting. 2. Vehicle storage shall be in designated parking spaces only. 3. A zoning/building permit, if necessary, shall be obtained within 6 months or this approval is null and void.
