We have worked out details with the owner of the home that we built as well as the neighbor and our landscaper. He (the landscaper) has asked that we wait until spring to do the work in order to have the most satisfactory results. This seems like a logical conclusion to the issue. This note is to give you confirmation that the work will be performed in the spring of '06. Motion passed unanimously. 4. Public Hearing: Application #CU-05-09 of Burlington International Airport for a conditional use approval under Section 14.10, Conditional Use Review, of the South Burlington Land Development Regulations. Request is for permission to develop the property as a compensatory wetland mitigation site to compensate for the wetland impacts associated with the Airport's `South End Development," 250 Van Sickien Road: Mr. McEwing said it has taken 12 years to get where they are today so they can develop the south end of the Airport. They will fill in a number of acres of wetland. One condition that allows them to do this is that they must create a wetland mitigation site. This site will become a wetland preserve. Mr. Dinklage asked what happened to the development rights on that parcel. Mr. McEwing said John Larkin has retained them. Mr. Belair added that some of those units are allocated to the Marceau Meadows development. Mr. Kupferman asked about the development that was begun on that property. Mr. Belair said it will all be eliminated and will become open space. Mr. Dinklage asked about public access to this area. Ms. Brodie explained there is an existing access road that was going to the developer. It has an easement for a bus turnaround. That will be kept and there will be room for some parking and pedestrian access. Mr. Belair said there is no change from the Rec Path that was reviewed. Mr. Dinklage asked who will own the property. Mr. McEwing said that in the future the Airport will want to turn it over to some group willing to accept it. Until then, it will be owned by the City of Burlington. Ms. Brodie suggested putting up a sign at the entrance to the property. Mr. Dinklage said Mr. Belair can discuss that with her. Ms. Quimby moved to approve Application #CU-05-09 of Burlington International Airport subject to the stipulations in the draft motion. Mr. Kupferman seconded. Motion passed unanimously. Continued Public Hearing: Application #VR-04-02 of George Hubbard seeking a variance from Section 3.10, Accessory Structures and Uses, of the South Burlington Land Development Regulations. The request is for permission to allow a detached accessory structure (retaining wall) to be placed in the front yard, 6 Park Road: -2- DEViELOPNIMENT REVIEW BOARD i JUNE 2005 The applicant was not present. Members continued to application to the end of the meeting. The applicant was still not present, and the following motion was made: Ms. Quimby moved to approve Application #VR-04-02 of George Hubbard. Mr. Kupferman seconded. The motion failed 0-5 with Mr. Behr abstaining. 5. Continued Public Hearing: Preliminary Plat Application #SD-04-55 of South Village Communities, LLC, for a planned unit development of Phase 1 consisting of 150 residential units and a 100-student educational facility, of .1 344 residential unit project, 1840 Spear Street: Mr. Marshall said they have 2 points for discussion: rec paths and landscaping/screening. They did find a way to create a through system for cyclists on Spear Street South. Mr. Belair said Ms. Calkins wants to know where this will be in regard to her property. Mr. Marshall said there will be no additional encroachment toward her house. Mr. Greller gave members written information on what is planned. He showed 3 "sections" along Spear Street with vegetative buffers obscuring views from Spear Street into the development. The buffer is a mix of native trees, shrubs, etc. Mr. Marshall showed the areas where view protection zoning is in effect. Mr. Greller noted that in a third area they will take out all invasive species and use only native ones. He then showed photos of existing views at key intersections and points on the site. Mr. Belair reminded members they cannot approve the Preliminary Plat because the Master Plan application is still open. Mr. Dinklage asked about building the rec path prior to the roadway. Mr. Marshall said that does not make sense. Mr. Belair said this will be discussed at the 5 July meeting with the reopening of the Master Plan. The preliminary plat will have to comply with what happens at that hearing. Mr. Marshall said they are willing to discuss a "temporary" path. The applicant questioned the bike racks being asked for at the triplex units. Mr. Belair said they are required but can be waived. Mr. Dinklage said the Board may want to discuss this Arith the Planning Commission. Mr. Belair suggested a triplex "typical" to include setback coverage, parking, lighting, landscaping... instead of approving each unit. The applicant could then get a permit if the plan is within the parameters. Ms. Quimby moved to continue Preliminary Plat Application #SD-04-55 of South Village Communities, LLC, until 5 July 2005. Dublic Hearing: Application #VR-04-02 of George Hubbard seeking a variance from Section 3.10, Accessory Structures and Uses of the South Burlington Land Development Regulations. The request is for permission to allow a detached accessory structure (retaining wall) to be placed in the front yard, 6 Park Road: Mr. Dinklage asked why the applicant has already constructed the wall. Mr. Hubbard said he knew nothing about the regulations until Mr. Belair called him. He had thought it was a landscaping issue. The wall makes the garage work and allows for drainage. Mr. Dinklage explained that a variance must meet 5 criteria. He felt the applicant had other options for the driveway. Mr. Hubbard said he wasn't prepared to address the 5 criteria at this meeting. Mr. Dinklage felt it would be hard to convince the Board. Ms. Dimmer, president of the neighboring homeowner group, said the wall is now against their property line. She thought there was a difference of 3 ft. in height there. Taking down the wall would cause a problem with washing out of gravel and dirt from the driveway. Mr. Belair said the issue is a wall in the front yard. Regulations say it can't be in the front yard. In addition, 3-4 feet of that wall is within the city's right-of-way. The applicant asked to continue to see what he can do. Ms. Quimby moved to continue Application #VR-04-88 of George Hubbard until 1 March 2005. Mr. Farley seconded. Motion passed unanimously. 12. Public Hearing: Final Plat Application #SP-04-48 of Randall Hart to construct a three unit multi -family dwelling, 253 Shunpike Road: Mr. Henson showed the location of the 2 lots. He noted that the City Engineer has made requests for changes. This will require an easement across lot # 1 for sewer force main for lot #2. Mr. Henson showed the location of the requested sidewalk. The sidewalk will curve out to protect 2 large trees. The following stipulations were added to the approval motion: #6. The applicant shall comply with the requests of the City Engineer as outlined in his comments dated January 13, 2005. #7. Burlington, VT 05403 To the Planning and Zoning Commission: The Board of the Gleneagles Homeowners' Association has been made aware that the retaining wall built at 6 Park Rd., a property that is adjacent to Gleneagles property, is not in compliance with city regulations. We do not have an issue with the regulations but we do want to state our position on the potential consequences of enforcing those regulations at this point in time. The original layout for this particular property had the curb -cut off of Golf Course Road. Once the property came under contract, that curb -cut was moved to Park Road. The grade change between 6 Park Road and our adjoining property at 24 Park Road is significant (estimated to be over 3.5 to 4 feet). The driveway to the property in question borders our property for at least 25 feet. Before the current retaining wall was built, large boulders were installed to enable a driveway to be built and retained. That solution was faulty in that stones and dirt from the driveway regularly fell out due to rainfall and general activity on the surface. In addition to the long-term effect this would have on the wearability of the driveway, this created an upkeep problem for us as we have a planting bed on our side of the property which was overrun with mud and stones. The building of the more substantial wall has solved both of those problems. Our Board would like the Commission to be aware of how we feel about this issue at this point in time. It appears that our interests and the city's would have been well served if the original curb -cut had never been moved. Gradual grading and landscaping of the property could have probably been done so as to minimize runoff. But, now that it is too late to go back to that point in time, we feel that the only practical solution is to allow the retaining wall to remain. Thank you for considering our position on this issue. The request is for permission to allow a detached accessory structure (retaining wall) to be placed in the front yard, 6 Park Road. Associate Planner Brian Robertson and Administrative Officer Raymond Belair, referred to herein as Staff, have reviewed the plans and have the following comments: Staff discovered that the subject retaining wall was constructed without a zoning permit and is in violation of the Accessory Structure requirements in the Land Development Regulations. Staff contacted the appellant and requested that they apply for a zoning permit. However, a zoning permit can not be issued unless this variance request of first approved. VARIANCE REVIEW STANDARDS Title 24, Section 4468 of the Vermont Municipal and Regional Planning and Development Act establishes the following review standards for all variance requests: On an appeal under section 4464 or section 4471 of this title wherein a variance from the Provisions of a zoning regulation is requested for a structure that is not primarily a renewable energy resource structure, the board of adjustment or the development review board, or the environmental court created under 4 V.S.A. chapter 27 shall grant variances, and render a decision in favor of the appellant, if all the following facts are found and the finding is specified in its decision. (1) That there are unique physical circumstances or conditions, including irregularity, narrowness, or shallowness of lot size or shape, or exceptional topographical or other physical conditions peculiar to the particular property, and that unnecessary hardship is due to such conditions, and not the circumstances or conditions generally created by the provisions of the zoning regulation in the neighborhood or district in which the property is located. Staff cannot identify any "unique circumstances or conditions" associated with the subject property, and therefore it is staffs opinion that this property does not meet this requirement. The retaining wall could have been constructed in compliance with the Land development Regulations, or not constructed at all, if it had been planned accordingly. (2) That because of such physical circumstances or conditions, there is no possibility that the property can be developed in strict conformity with the provisions of the zoning regulation and that the authorization of a variance is therefore necessary to enable the reasonable use of the property. In addition, the subject property is currently developed with a single-family dwelling, which staff feels is a reasonable use of the property. (3) That the unnecessary hardship has not been created by the appellant. The unnecessary hardship is being created by the appellant, as the retaining wall was constructed in the front yard. A variance would not be necessary if the driveway had been constructed off of Golf Course Road. (4) That the variance, if authorized, will not alter the essential character of the neighborhood or district in which the property is located, substantially or permanently impair the appropriate use or development of adjacent property, reduce access to renewable energy resources, nor be detrimental to the public welfare. Staff does not feel that the variance, if authorized, would alter the essential character of the neighborhood, nor would it permanently impair the appropriate use or development of adjacent property, reduce access to renewable energy resources, or be detrimental to public welfare. (5) That the variance, if authorized, will represent the minimum variance that will afford relief and will represent the least deviation possible from the zoning regulation and from the plan. Staff does not feel that the variance, if authorized, would represent the minimum variance that will afford relief or represent the least deviation possible from the South Burlington Land Development Regulations. Pursuant to Section 3.10(A)(2) of the South Burlington Land Development Regulations, detached accessory structures shall not be placed in the front yard. Allowing it to be placed in the front yard would represent a significant variance. RECOMMENDATION Staff recommends that the Development Review Board deny Variance application #VR-04-02, as all five of the above criteria are not met. Respectfully submitted, Brian Robertson, Associate Planner Copy to: George Hubbard, applicant BMW EVER McGeoch North 94.590 29-860 To Whom it may concern, I was informed by Ray Belaire on October 29, 2004 that a house that we had just finished building at 6 Park Road was in violation of a zoning ordinance regarding retaining walls. We built a retaining wall along the northern border of the customers property ( with enthusiastic approval of the neighbors) in order to maintain a grade from the house that was suitable for access of vehicles to and from their garage as well as an easily maintained transition from one lot to another. Apparently, when a retaining wall is holding something like a grade for a driveway it becomes a "structure" and not a landscape item. I'm told that a structure such as this needs to be 5' from the property line. Not knowing that this was an issue, we went to great lengths to insure that we were following a surveyed property line but we are very near the edge of that line and not 5' away. We did not apply for any permits because we thought that this was a landscaping item and not subject to any town review. By way of this application, I am asking for a variance in order to avoid a notice of violation. Besides my lack of knowledge of this requirement, this issue would create a serious hardship for both Hubbard Construction and our customers, Bruce and Cynthia McGeoch. The house was angled as much as possible in order to allow access to the garage. Part of the equation was the ability to have the driveway come to the edge of the property line. By removing the retaining wall and moving it 5' closer to the house, the access to the third bay of the garage becomes impossible. In addition, as we have already installed the wall and gravel and asphalt, the expense to move Y would be enormous and would do nothing for the aesthetics nor increase any functional use of the property. I would please ask that those responsible for reviewing these matters take practicality into consideration and allow for this non -offensive use of a retaining wall.
