The landowner shall record and index this permit in the South Burlington Land Records within thirty (3o) days of issuance of this permit and prior to the conveyance of any lot subject to the jurisdiction of this permit. 1.4 This project is approved for the addition of a one bedroom apartment to the existing three bedroom single family residence located on the 0.39 acre lot. Construction of additional nonexempt buildings, including commercial and residential buildings, is not allowed without prior review and approval by the Drinking Water and Groundwater Protection Division and such approval will not be granted unless the proposal conforms to the applicable laws and regulations. No construction is allowed that will cause non-compliance with an existing permit. 1.5 Each purchaser of any portion of the project shall be shown a copy of the Wastewater System and Potable Water Supply Permit and the stamped plan(s), if applicable, prior to conveyance of any portion of the project to that purchaser. 1.6 By acceptance of this permit, the landowner agrees to allow representatives of the State of Vermont access to the property subject to this permit, at reasonable times, for the purpose of ascertaining compliance with Vermont environmental/health statutes, regulations, and permit conditions, including performing an inspection of the wastewater disposal and water supply systems serving the/each structure. Chapter 22o and the Vermont Rules of Environmental Court Proceedings. 2.WATER SUPPLY 2.1 This project is approved with the existing connection to the water supply system owned by the City of South Burlington (VToo05091) for a maximum of 600 gallons of water per day. 2.2 The landowner shall install and maintain backflow prevention devices that conform to Vermont Department of Public Safety standards and NFPA 13 for the connection of any sprinkler fire suppression system to a public drinking water system. 2.3 This project is approved with an existing building's water service piping. The Drinking Water and Groundwater Protection Division assumes no liability for the adequacy of this water service. Should the water supply fail and not qualify for the minor repair or replacement exemption, the landowner shall engage a Licensed Designer to evaluate the cause of the failure and to submit a permit amendment application to this office, and receive approval thereof, prior to correcting the failure. 2.4 This permit -is based, in part, on a municipal approval for connection to their water distribution system. If the municipal approval expires, this permit shall be invalid unless the municipality renews its approval. If the municipality approval expires, a new permit must be issued for the project. An updated application form and an application fee will be required for the project. A new municipal approval letter shall be required. The rules in effect at the time of the filing of the application for a new permit will be applied to the project. 3.WASTEWATER DISPOSAL 3.1 This project is approved with the existing connection to the City of Burlington Main wastewater treatment facility for a maximum of 350 gallons of wastewater per day. 3.2 This project is approved with an existing building sewer. The Drinking Water and Groundwater Protection Division assumes no liability for the adequacy of this sewer piping. Should the wastewater system fail and not qualify for the minor repair or replacement exemption, the landowner shall engage a Licensed Designer to evaluate the cause of the failure and to submit a permit amendment application to this office, and receive approval thereof, prior to correcting the failure. 3.3 This permit is based, in part, on a municipal approval for connection to their wastewater treatment facility. Sketch Plan Application #SD-08-59 of 1080 Shelburne Road, LLC, for a planned unit development to: 1) raze an existing building formerly used as a restaurant, and 2) construct a 1600 sq. ft. retail building, 1080 Shelburne Rd. (Tuscan Kitchen): Mr. Knudsen noted that his office represents a neighboring property. If any conflict of interest issues arise, he is willing to step down; otherwise, he believed he could consider the application in an unbiased way. Mr. O'Leary said the applicant has no problem with this. Mr. O'Leary then showed the location of the former Tuscan Kitchen. Lot coverage was 58% as was front yard coverage on Shelburne Rd. Coverage on Baldwin was 52%. There is an existing sidewalk, municipal water and sewer. The proposed new building will house Goodwill Industries. They will locate the building on the corner of Baldwin/Shelbume Rd. They are asking for a 15' front yard setback waiver on Shelburne Rd. Associate Planner Cathyann LaRose and Administrative Officer Ray Belair, referred to herein as staff, reviewed the plan submitted on December 10, 2008 and have the following comments. A CCESSOR Y RESIDENTIA L UNITS Pursuant to Section 3.10(E)(1) of the proposed Land Development Regulations, in any district where a single-family residence is a principal permitted use, one (1) accessory residential unit within or attached to a primary single-family residence or within an existing, permitted accessory structure may be permitted by the DRB in accordance with Article 14, Site Plan Review, and the following additional criteria: (a) Floor space of the accessory residential unit shall not exceed thirty percent (30%) of the total habitable area of the single-family dwelling unit. The single family dwelling unit is 1850 SF. The accessory residential unit is 546 SF, or 29.5% of the habitable area of the principal dwelling. Thus, the applicant is in compliance with this criterion. (b) The principal dwelling shall be owner occupied. The principal dwelling unit is owner occupied and shall remain so. I. The principal dwelling shall remain owner -occupied. (c) Adequate wastewater capacity is available to service the accessory unit, as demonstrated by the issuance of a Wastewater Allocation or on -site wastewater permit pursuant to the South Burlington Sewage Ordinance. 2. The applicant shall apply for wastewater allocation. CITY OF SOUTH BURLINGTON 2 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING (d) Two additional off-street parking spaces shall be provided on the same lot, either in a garage or a driveway, or not in any areas required to meet coverage limitations, or any front yard other than a driveway, required by these Regulations. The single family home and accessory unit requires a total of four off-street parking spaces. There is a two -car garage on site, as well as ample driveway space. 3. The applicant shall maintain sufficient off-street parking for four vehicles in accordance with the criteria stated above. (e) A zoning permit shall be required for the accessory residential unit. 4. The applicant shall obtain a zoning permit from the Administrative Officer for the accessory residential unit. SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following general review standards for all site plan applications: (a) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. Staff finds the site plan adequate with respect to this criterion. (b) Parking shall be located to the rear or sides of buildings to the greatest extent practicable. Parking is to the front and side of the building. However, given that the nature of the project as a single-family residential use, staff finds this layout acceptable and in harmony with the rest of the neighborhood. (c) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or adjoining buildings. The height of the existing home is within the limits specified by the SBLDR. No exterior construction is planned. (d) Newly installed utility services and service modifications necessitated by exterior alterations or building expansions shall, to the extent feasible, be underground. The applicant has not proposed any additional lighting as part of this application. (e) The DRB shall encourage the use of a combination of common materials and architectural characteristics, landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. The principal residential dwelling and accessory unit are in compliance with this criterion. CITY OF SOUTH BURLINGTON 3 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING (� Proposed structures shall be related harmoniously to themselves, the terrain, and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. The principal residential dwelling and accessory unit are in compliance with this criterion Site plan applications shall meet the following specific standards as set forth in Section 14.07 of the South Burlington Land Development Regulations: (a) The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial of collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. Staff does not feel it is necessary to require any additional access easements as part of the proposed project. (b) Electric, telephone and other wire -served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications shall be underground. (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). As the subject building is a single family residence, staff understands that trash will be maintained inside the building until time for trash pickup. Traffic This project will not generate a sufficient amount of traffic to warrant concern or further review. RECOMMENDATION Staff recommends that the Development Review Board approve Site Plan application #SP-08-114 subject to the conditions included in this report.
