This application shall be reviewed under Section 3.12 of the Land Development Regulations. The removal from land or the placing on land of fill, gravel, sand, loam, topsoil, or other similar material in an amount equal to or greater than twenty (20) cubic yards, except when incidental to or in connection with the construction of a structure on the same lot, shall require the approval of the Development Review Board. The Development Review Board may grant such approval where such modification is requested in connection with the approval of a site plan, planned unit development or subdivision plat. Standards and Conditions for Approval: (1) The Development Review Board shall review a request under this Section for compliance with the standards contained in this sub -Section 3.12(B). An application under Section 3.12(A) above shall include the submittal of a site plan, planned unit development or subdivision plat application showing the area to be filled or removed, and the existing grade and proposed grade created by removal or addition of material. The applicant submitted a plan, containing one (1) sheet showing the placement of the fill on the subject property. This plan is sufficient to satisfy this requirement. (2) The Development Review Board, in granting approval may impose any conditions it deems necessary, including, but not limited to, the following: (a) Duration or phasing of the permit for any length of time. Staff does not feel this requirement is applicable to the subject application. The phasing of the filling operation is proposed to take 3 to 4 years. Upon completion, the fill is proposed to be permanent. (b) Submission of an acceptable plan for the rehabilitation of the site at the conclusion of the operations, including grading, seeding and planting, fencing drainage, and other appropriate measures. The applicant has proposed that the site, when completely filled, will include drainage, underlayment and filling to grade with clean fill. Furthermore, the applicant, as a rehabilitation measure, has received approval to restore 4.9 acres of CITY OF SOUTH BURLINGTON 3 DEPARTMENT OF DEVELOPMENT REVIEW BOARD PLANNING & ZONING \d rb\m isc\crook\do rmer. srp. doc degraded upland habitat and 12.5 acres of degraded wetland habitat associated with the Muddy Brook corridor off of Van Sicklen Road in South Burlington. Staff does not feel that any further rehabilitation measures are necessary. (c) Provision of a suitable bond or other security adequate to assure compliance with the provisions of this Section. Staff does not feel this requirement will be necessary for the subject application. (d) Determination of what shall constitute pre -construction grade under Section 3.07, Height of Structures. The pre -construction height for future development will be the final grade. Pursuant to Section 12.02(E) of the SBLDR, encroachment into Class II wetlands is permitted by the City only in conjunction with issuance of a Conditional Use Determination (CUD) by the Vermont Department of Environmental Conservation and positive findings by the Development Review Board pursuant to the following criteria: a) The encroachment will not adversely affect the ability of the property to carry or store flood waters adequately; All new stormwater runoff from the new impervious area will be collected in catch basins, treated and directed to below -ground infiltration galleries. The CUD finding has stated that there will be no undue adverse impact on storm runoff function. b) The encroachment will not adversely affect the ability of the proposed stormwater treatment system to reduce sedimentation according to state standards; The proposed stormwater plan is to treat runoff from the new impervious areas while reducing contaminant levels to pre -construction background levels. The CUD finding has stated the proposed project will no adversely impact the stormwater treatment function. c) The impact of the encroachment on the specific wetland functions and values identified in the field delineation and wetland report is minimized and/pr offset by appropriate landscaping, stormwater treatment, stream buffering, and/or other mitigation measures. Staff reiterates the two most previous comments. This project will not unduly or adversely affect the stormwater runoff or stormwater treatment functions. Staff also reiterates the mitigation site off Van Sicklen Road. The applicant received Conditional Use Determination approval on January 5, 2005. This is the other half of the Airport's recently -approved proposal to create a wetland mitigation and enhancement site on the former Wessell property off of Van Sicklen Road. Federal and state approval of the Airport's South End expansion has involved a twelve-year process of detailing the purpose and need for the expansion, evaluating alternatives, and reducing impacts to the maximum extent possible while still allowing the Airport to function as needed. State and Federal regulators have been involved throughout and have issued all applicable permits. The City's review of the specifics of the fill activity is limited to ensuring that the site changes that will result from the fill are consistent with zoning regulations. This is a reminder that we have a meeting scheduled for Thursday, September 27. This was scheduled a week earlier than our usual meeting so that we could finalize the VYCC grant application. I hope that you have had time to ponder the VYCC grant. I am hoping that by Thursday we can finalize the grant proposal. The other item on the agenda for the September 27th meeting will be to discuss a proposal to fill approximately 8.3 acres of a scrub-shrub/emergent wetland at the Burlington International Airport. Miscellaneous application #MS-05-06 of City of Burlington, Burlington International Airport for approval to encroach into a class II wetland buffer and wetland by placing approximately 350,000 cubic yards of fill into the wetlands, Aviation Avenue: Mr Dinklage noted the application is providing an alternate wetland as mitigation. Mr. McEwing provided some history for the project. He noted it began 15 years ago. As a result of a Master Plan study, the need to develop this area was determined. This requires filling part of the wetland. They have reduced the impacted area to 8 acres. The Airport then went to the state and eventually agreed on a mitigating wetland site in South Burlington. They have all the permits in place for that. The new wetland will be turned over to a public body. The Airport is now ready to begin the filling process. Some fill will come from the Airport and quarry and some from development and off -site locations. They expect it will take about 5 years to complete the filling process. COMMITTEE MINUTES OF September 27, 2005 The South Burlington Natural Resources Committee met on Thursday, September 29, 2005 at 7:30 P.M. Members Present: Peter Jones, Bill Schuele, Bill Toussaint, Russ Agne. Others Present: Associate Planner Cathyann LaRose, Juli Beth Hinds, Bob McEwing, Greg Goyette, Charlotte Brody, John Lindwall The meeting was called to order with a quorum of committee members present at approximately 7:10 P.M. Burlington International Airport — Miscellaneous Application #MS-05-06 Bob McEwing, representing the airport, introduced the project and explained the site layout to the Committee. He explained where the wetlands were located on the property and where the proposed fill would be located. He also explained that the airport has received its conditional use determination from the State of Vermont. Mr. McEwing clarified to the Committee that the current application before them was for a turf parking area, but that the CUD allows for eventual paving of the area. There will be no stormwater retention basins until the area is paved. Greg Goyette explained the plans to berm the wetland so that no sediment would flow into the untouched areas of the wetland during construction. Cathyann asked how many acres of wetland would remain after the approximately eight acres were filled. Greg answered that there were 26 acres remaining. Bill Schuele inquired about the runoff from airplanes parked on the turf field, specifically from the use of de-icers. Bob said that the airport already limits the use of de-icing materials to those that are environmentally friendly, JuliBeth added that it is advantageous for these products to be used on dirt rather than pavement because of the natural filtering ability of soil. Bill Toussaint asked about the location of streams or other water bodies in the wetlands. John replied that there were none identified. Bill Scheule asked about the successfulness of other wetland mitigation sites. Charlotte responded that she has worked with several in the state. At first wetland mitigation sites were largely unsuccessful because the approach was poor. The thought was that flooding fields would suffice as wetland recreation. Now, however, they have produced much better results with better methodology. Bill asked if they would remain self-sustaining. Charlotte answered that the goal is that they will be as close to natural conditions as possible, and thus could sustain themselves without further intrusion from man. JuliBeth reminded the committee of the impacts of airport sprawl; creating new airports creates new problems- more traffic, parking, hotels, housing, etc. Working with existing airports to better serve the need is often a better approach. City of South Burlington Natural Resources Committee Minutes of April 7, 2005 Page 2of3 Cathyann asked the Committee to discuss the project and offer any comments or questions. All members expressed acceptance of the application and recommended approval to the Development Review Board. The informal motion passed unanimously 4-0. Other Business- VYCC Grant Application The Committee continued the discussion regarding the Vermont Youth Conservation Corps grant application. Peter expressed his concern that previous ideas were unsuitable for a transportation grant. Other members agreed. Discussion turned to the idea of supporting possible Recreation Path Committee ideas. The concern is that there may not be appropriate application issues for the Natural Resources Committee. Furthermore, the oversight of a suitable project would require more planning than the time that has been available this year. Next year might provide for a better application and better oversight. The meeting was adjourned at approximately 9:30 P.M. The next meeting was set for Thursday, November 3, 2005 at 7:30 P.M. at the City Hall. Water storage for flood water and storm runoff. The wetland is not significant for this function, being generally sloping; the project will neither increase nor decrease the very limited capacity of the wetland to detain water. b. Surface and groundwater protection. The wetland is significant for this function, being densely vegetated with reed canary grass (Phalaris atundinacea). The paved road will have a grassed side slope which will filter runoff prior to entering the wetland. In any event, the capacity of the wetland will not be unduly adversely affected, as the plant community in it is anticipated to remain reed canary grass. c. Fisheries habitat. There is no fisheries habitat in this wetland; even if construed to incude the man- made pond, the pond is separated from the wetland by underdrains and there is no surface water connection. d. Wildlife and migratory bird habitat. M This wetland is not considered significant for this function and there will be no impact. e. Hydrophytic vegetation habitat. This wetland is not considered significant for this function and there will be no impact. f. Threatened or endangered species habitat. This wetland is not considered significant for this function and there will be no impact. g. Education and research in natural sciences. This wetland is not considered significant for this function and there will be no impact. h. Recreational value and economic benefits. This wetland is not considered significant for this function and there will be no impact. i. Open space and aesthetics. This wetland is not considered significant for this function and there will be no impact. j. Erosion control through binding and stabilizing the soil. There are no erosive forces present, so this wetland is not significant for this function. 15. Demonstrate by narrative and reference to plans that the following mitigation measures have been used to achieve no undue adverse impacts to wetland functions. a. Can the proposed activity practicably be located on an upland portion of the sites or another site owned, controlled, or available to satisfy the basic project purpose? (explain). No, the impacts are limited to an area that is an existing farm road; the only other access to the site would involve a road essentially through the dooryard and landscaped yard of the existing residence, and would involve crossing a wetland finger (considered to be Class 3, but essentially the same type of wetland as the Class Two wetland. It makes good sense to use the existing farm road that has been in place for many years. b. Demonstrate how all practicable measures have been taken to avoid or minimize adverse impacts on protected functions, including project redesign or project scale - back. The project consists of only 3 house lots, and cannot logically be smaller than that; the building envelopes and the roadway have been planned to avoid intrusion into wetland. The site is large enough to have accomodated more building lots, but this would have resulted in more wetland impact. c. For wetlands that have been disturbed, what steps will be taken to restore impact functions (e.g., plantings, seedings, mulching exposed soil, removal of fill, etc.)? Erosion prevention and sedimentation control measures will be undertaken along the proposed roadway, and the sideslopes will be immediately seeded and mulched. There should be no effects outside of the limits of disturbance, and the disturbed area will be rehabilitated immediately. 16. Wetland compensation (creating replacement wetlands) is a measure to mitigate adverse impacts on protected functions that will only be possible in rare cases for specific functions (see Section 8.5c of the Vermont Wetland Rules). If a compensation plan is a part of this proposal, demonstrate by narrative and reference to plans how the steps in Section 8.5c(1)-(7) will be met. No compensation is proposed for this project. Other construction activities include lighting, landscaping, installing conduit for vehicle charging stations, striping, signing, erosion prevention and sediment control and other incidental items. The existing subbase, lighting, landscaping and curbing will remain in -place 1.3 AREA OF DISTRUBANCE Total area of disturbance as shown on the EPSC plan is approximately 0 39 acres Removing concrete from the existing base will not be considered disturbance. The Airport's Taxiway Construction Project anticipates a total of 12.98 acres of disturbance. The Rehabilitation of the Terminal Apron Project anticipates an additional 2.18 acres of disturbance but will be self-contained and will not contribute towards the total allowable disturbance. The Quarry Fill project anticipates 1 98 acres of disturbance. 1.4 CONSTRUCTION SEQUENCE PHASE 1 - EXCAVATE INFILTRATION BASINS AND PRE-TREATMENT AREAS (September, 0.26 acres disturbance) Install silt fence and delineate project limits Construct infiltration basins and pilot channel Topsoil, seed and mulch and use a Rolled Erosion Control Product (RECP) to permanently stabilize area PHASE 2- Pave Lot (September, 0.13 acres disturbance) - Remove existing porous concrete pavement while leaving the existing subbase in place - Excavated soil and place subbase material for expanded lot area - Install Conduit and Light Poles - Stabilize any disturbed area with topsoil, seed and mulch - Excavate utility trench and Install conduit for lighting then backfill trench - Fine grade subbase and pave lot 1.5 ALLOWABLE EARTH DISTURBANCE - The earth disturbance for this project will be limited to 0 31 acres prior to temporary or permanent stabilization. The Airport Taxiway Construction project will be limited to 5 acres of disturbance prior to temporary or permanent stabilization. The Rehabilitation of the Terminal Apron project disturbance is limited by vertical walls of excavation. 1.6 VEGETATED BUFFERS - Stormwater leaving the site will first pass through a vegetated buffer before being discharged into the receiving wetland 1.7 EXPOSED SOIL DURATION Seed and mulch will be used for both permanent and temporary stabilization measures. Rolled erosion control product (RECP) will be used in place of mulch for slopes 1 V 3H or greater. Mulch is to be applied at a minimum application rate of 2 Ib/sy, unless directed otherwise by the engineer Disturbed areas and soil stockpiles that will not be worked for more than 7 days shall be temporarily stabilized with mulch/RECP within 48 hours. Disturbed areas and soil stockpiles that will not be worked for more than 30 days shall be temporarily stabilized with seed and mulch/RECP within 48 hours. Exposed areas that have achieved final grade shall be permanently stabilized with 48 hours In areas where vegetative cover will provide permanent stabilization, seeding to be completed between April 15 and September 15. 1.8 RECEIVING WATERS - Stormwater from the site will discharge to a Wetland Contiguous to Muddy Brook. There is one discrete discharge point to the receiving water. The nearest earth disturbance will be approximately 400' from this discharge point. 1.9 DRAINAGE AREAS - No drainage area with proposed earth disturbance of 0.5 acres is anticipated for this project. 1.10 STREAM ALTERATION - No stream crossings will take place as part of this project 1.11 WETLANDS - The nearby wetlands will not be Impacted by proposed activities 1.12 WASTE, BORROW, AND STAGING AREAS Off -site waste and borrow areas have not been identified for this project. Large quantities of waste and borrow are not anticipated, however, as this project has cut and fill operations that are roughly balanced it will be the contractor's responsibility to identify and permit, as necessary, any off -site waste and borrow areas that are needed. Locate additional areas for disposal of stumps, excess soils and collected sediment, if necessary. Dispose of these materials in a manner that will not result in sediments entering waters of the state. Disposal sites require relatively level terrain with an isolation distance of at least 100 ft from any surface waters, including wetlands. Vehicle and equipment storage areas or areas adjacent to construction trailers or other high traffic areas shall be covered with geotextile fabric and 12" of gravel. Following completion of construction, all non-native materials shall be removed from the staging area. Compacted, rutted, or otherwise disturbed soils shall be seeded and mulched. Erodible materials stockpiled within the material storage areas shall be isolated with silt fence or other acceptable sediment barrier. Soil stockpiled on the site shall be seeded and mulched. 1.13WINTER CONSTRUCTION REQUIREMENTS It is expected that all construction will be completed in the standard construction season, between April 15 and October 15. Any construction deemed necessary outside the construction season, the contractor shall follow requirements for winter construction, as follows: Enlarged access points, stabilized to provide for snow stockpiling Limits of disturbance moved or replaced to reflect boundary of winter work. Development of a snow management plan that includes: o Adequate storage and control of melt -water o Storage of cleared snow to be placed down slope of disturbed areas and out of stormwater treatment structures A minimum 25-foot buffer shall be maintained from perimeter controls. Drainage structures must be kept open and free of snow and ice dams - Silt fence and other practices requiring earth disturbance must be installed ahead of frozen ground. Mulch to be applied at twice the regular rate, as shown in specification T-901, unless directed otherwise by the engineer. Areas of disturbed soils must be stabilized at the end of each work day, with the following exceptions: o If no precipitation within 24 hours is forecast and work will resume in the some area within 24 hours o Disturbed areas that collect and retain runoff, such as open utility trenches, must be stabilized at the end of each work week. Prior to stabilization, snow or ice must be removed to less than V thickness. If permanent vegetative stabilization is applied during the winter season, the regular seed mixture shall be amended to include an additional 20 Ibs/acre of winter rye. If winter construction is planned these measures will need to be followed and a specific winter construction erosion prevention and sediment control plan will need to be created along with amending this permit.
